Usually it is the witnesses who are intimidated, or in Northern Ireland, the jury for terrorist offences. Herr Schwenn surrendered rather easily from defending Christian Brueckner and frankly, the language used and and form of attack are rather tame.
Is lawyer intimidation prevalent, or viewed as an extremely serious crime in Germany?
Someone really, really wants Bruckner to be charged of spurious allegations and by association, the killing of MBM.

Is lawyer intimidation prevalent, or viewed as an extremely serious crime in Germany?
A. This was the first time I have ever heard of it, although Lawyers, Private Detectives get Threats regularly, Physical Damage is rare.
The State seems to view these Threats as being part of the Job, just like Stuntmen being injured or Doormen being assaulted.

22 May 2024: On day 17, the head of the BKA's Operational Case Analysis (Profiling Section) was supposed to testify.
The Federal Criminal Police Office compared the rape of Hazel B. with the rape of the 72-year-old American woman for which Christian B. was convicted.
However, the Chief Profiler was absent due to illness. Christian B.'s lawyers file a motion for recusal - due to bias.

An anonymous witness in Portugal handed over to German police Brueckner’s hard drive containing disgusting cartoons supposedly written by Brueckner.
Now Brueckner’s team is demanding that the Braunschweig Regional Court not officially admit the hard drive as evidence.
Brueckner’s lawyer, Friedrich Fülscher, said: “This is simply not permitted.” The German police cannot simply go looking for evidence in another country without authorization.
‘The Portuguese authorities were not even informed of this. It’s as if the German police simply went to England and started conducting a police investigation there and then confiscated evidence and took it back to Germany. Email account inboxes were completely deleted during the first half of 2007, including around the time Madeleine ‘Maddie’ McCann disappeared.
Brueckner’s lawyer, Friedrich Fülscher, said: “The German police cannot simply go looking for evidence in another country without any authorization.”
Details of the hard drive were given in court yesterday by Titus Stampa, detective commissioner of the Federal Criminal Police (BKA), the German equivalent of the FBI.
In addition to the hard drive details, Stampa revealed that Brueckner had three email accounts.
Two of them were used to send pornographic photographs, including those of himself and his erect penis.
Stampa and his colleagues from the Federal Criminal Police (BKA) asked Microsoft Ireland in 2017 to try to secure access to the account, which after going through extensive procedures was finally granted to them in 2018.
Here they discovered that the inboxes of these accounts had been completely deleted during the first half of 2007, which includes the time when Madeleine ‘Maddie’ McCann disappeared.
But when they checked the accounts’ outboxes, they discovered that Brueckner had sent a multitude of files containing obscene photographs, including photographs of himself with an erect penis.
In addition, it also included several versions of two stories, the ‘Mother/Daughter’ story and the ‘Zofen story’.
The first is about a mother and daughter who are captured, transported in a van to a farm, tortured, and brutally raped.
The second is about children who decide to take revenge on a pedophile who has abused them.
The prosecution claims that they all found this story on a USB stick that was found during a police search in 2016 at the dilapidated Brueckner box factory in Neuwegesleben.
But the defense has consistently tried to prevent this story from being heard in court, arguing that the police search was unauthorized and therefore the evidence obtained there is inadmissible.
On Tuesday, the court heard police had informed colleagues about a dead dog at the Breuckner premises, prompting a police search.
Here, under intense interrogation by judge Ute Insa Engemann, police officer Katharina Schmidt, 47, admitted to having been on Brueckner’s premises without any permission.
And she even admitted that she knew that she was not allowed to be there, nor take photographs, nor send them to the police to start an investigation.
Taking all this into account, it seemed that the prosecution had no chance of revealing details of this story in court.
But instead, by focusing on Brueckner’s emails, the prosecution yesterday indirectly got the harrowing summary of these stories mentioned in court.
However, regarding the third email, Stampa said he was not authorized to discuss it because it concerned the investigation into Madeleine McCann’s murder.
Speaking outside the courtroom this morning, one of Brueckner’s defense team members, Phillip Marquort, said: “You have to remember that the file with this story was an RTF file, and these files do not identify the author.”
“So, regardless of what was written about what happened yesterday in court, these facts remain, and even Mr. Stampa admitted in court yesterday that they have no way of knowing whether my client wrote the story or not because the RTF files do not record the author.

Big surprise in the trial against Christian Brückner (47): The defence lawyer for the man on trial at Braunschweig District Court for five sexual offences has applied to the court to lift the arrest warrant against the accused.
"For an arrest warrant to be upheld, there must be a strong suspicion of the offence," said defence lawyer Dr Friedrich Fülscher (40). "Since the essential evidence has been collected and it has not been established that any of the charges are true, the arrest warrant can no longer be upheld."
After almost 30 days of trial, almost all witnesses have been heard. Brückner, whom the Braunschweig public prosecutor's office also suspects of having abducted and murdered little Madeleine McCann (then 3) from her parents' flat in 2007, is accused of three rapes. The victims of two of the offences are still unknown.
Two witnesses claim to have seen the offences on stolen video tapes. In the third crime, Irish woman Hazel B. (40) claims to have recognised her tormentor by his eyes.
Another witness testified in court that Brückner was the man who molested her on a beach in the Algarve in 2007 and masturbated in front of her. Further witnesses claim that the accused masturbated in front of children at a festival in a playground in the Algarve in 2017. The defence claims that Brückner only wanted to urinate there.
The court must now decide whether the arrest warrant will be cancelled. "If this is the case, the defendant will be acquitted unless the public prosecutor pulls another rabbit out of the hat," says lawyer Fülscher. "Otherwise, we know where we have to start with further motions for evidence.”
Will the Maddie suspect now go free?
No. Brückner is still serving a seven-year prison sentence for the rape of an American woman (72 at the time) in Portugal.
He could be released in 2025 at the earliest.

Dicke Überraschung im Prozess gegen Christian Brückner (47): Der Verteidiger des Mannes, der wegen fünf Sexualstraftaten vor dem Landgericht Braunschweig steht, hat bei Gericht beantragt, den Haftbefehl gegen den Angeklagten aufzuheben.
„Für die Aufrechterhaltung eines Haftbefehls ist ein dringender Tatverdacht erforderlich“, so Verteidiger Dr. Friedrich Fülscher (40). „Da die wesentlichen Beweise erhoben wurden und bezüglich keinem der Anklagevorwürfe festgestellt werden konnte, dass die Vorwürfe zutreffend sind, kann der Haftbefehl keinen Bestand mehr haben.“
Nach knapp 30 Prozesstagen sind fast alle Zeugen gehört. Brückner, den die Staatsanwaltschaft Braunschweig auch verdächtigt, 2007 die kleine Madeleine McCann (damals 3) aus dem Apartment ihrer Eltern entführt und ermordet zu haben, werden drei Vergewaltigungen vorgeworfen. Bei zwei der angeklagten Taten sind die Opfer bis heute unbekannt.
Zwei Zeugen wollen die Taten auf gestohlenen Videokassetten gesehen haben. Bei der dritten Tat will die Irin Hazel B. (40) ihren Peiniger an seinen Augen erkannt haben.
Eine weitere Zeugin sagte vor Gericht aus, Brückner sei der Mann, der sie 2007 an einem Strand an der Algarve belästigte und vor ihren Augen masturbierte. Weitere Zeugen behaupten, der Angeklagte habe 2017 bei einem Fest auf einem Spielplatz an der Algarve vor Kindern masturbiert. Die Verteidigung gibt an, Brückner habe dort nur urinieren wollen.
Das Gericht muss nun darüber entscheiden, ob der Haftbefehl aufgehoben wird. „Sollte dies der Fall sein, wird der Angeklagte freigesprochen werden, sofern die Staatsanwaltschaft nicht noch ein Kaninchen aus dem Hut zaubert“, so Anwalt Fülscher. „Andernfalls wissen wir, wo wir noch durch weitere Beweisanträge anzusetzen haben.“
Kommt der Maddie-Verdächtige jetzt frei?
Nein. Noch sitzt Brückner eine siebenjährige Haftstrafe wegen der Vergewaltigung einer Amerikanerin (damals 72) in Portugal ab.

Important witnesses have raised doubts with contradictory statements. In some cases, they only corrected their statements after being insistently reminded of their duty to tell the truth. Many of those involved shared their knowledge with the media long before the trial and were often "compensated" for it.
As expected, the court and the public prosecutor's office are not commenting on the current state of proceedings. The defence, however, did: "In our opinion, one problem that runs through all the cases is that the BKA's investigation was totally one-sided," lawyer Friedrich Fülscher told the news agency dpa. He criticised that obvious investigations, for example to clarify the credibility of witnesses, had been omitted. "Potentially exculpatory matters were not taken into account accordingly."
In order to demand an interim result from the criminal division, the defence has requested that the arrest warrant be revoked. "The further an evidentiary hearing has progressed, the stricter the requirements for the assumption of urgent suspicion of an offence must be," said Fülscher. According to the course of evidence taken so far, the arrest warrant can no longer be upheld.
With regard to two rapes that two witnesses claim to have seen on video, Fülscher also speaks of "contradictory witness statements" that no court would probably base a guilty verdict on. "The quality is simply too poor for that," said the defence lawyer. The whereabouts of the videos are unclear and it has not yet been possible to identify any victims.
In the case of an Irish woman who was raped in Portugal in 2004 and testified as a witness in the trial, the accused is excluded as the perpetrator due to physical characteristics such as a scar on his thigh, according to the defence. "We also believe that it is simply impossible to recognise him based solely on the colour of his blue eyes," said Fülscher. The witness had reported "piercing blue eyes" in court. "His eyes, I think this man is the attacker," she said.
Despite the serious offences, for many observers the trial is also a kind of test procedure before a possible indictment in the Maddie case. If there is another trial against Christian B., important witnesses are likely to be heard again in Braunschweig. This is another reason why their credibility is already so much in focus in this trial and the pressure is clearly noticeable in the courtroom. In the sometimes very tense atmosphere, there are repeated heated exchanges between the criminal chamber, the public prosecution and the defence.
The accused Christian B. will then only act as a silent observer in a trial with the serious allegations against him - and the Maddie complex behind the scenes. The trial will continue on Friday (28 June). Whether the criminal division will then comment on the requested cancellation of the arrest warrant remains unclear. The investigation into the disappearance of little Maddie more than 17 years ago is continuing in parallel.

Is this not the ideal result for TM in that if nothing actually comes to Court, them and their friends do not have to get involved in any embarrassing testimony, which based on their previous statements would get torn to shreds by any decent councel, yet they can say "we now know what happened and who did it, but in view of the time that has elapsed, the evidence can't be satisfactorily substantiated, blah, blah, blah........'
Case closed?
Wind up the fund & run for the hills?
Not forgetting the Court costs which they (still?) owe, which I suspect will miraculously get paid out of the fund, in spite of all their previous assurances to the contrary.
And I'm sure KM could then pen another book 'My trials and tribulations since 2007 etc........'

The reasons for this unusual appearance in the almost one-hour trial in the Braunschweig district court was not addressed.

According to the Associated Press (AP), which cites the German news agency DPA, the Braunschweig state court decided to lift the arrest warrant in a case in which Brückner is accused of three counts of rape and two counts of sexual abuse of children, between 2000 and 2017, understanding that there is “no urgent suspicion”.
The German is currently serving a seven-year prison sentence for another crime committed in Portugal in 2005, when he raped an elderly woman in her holiday apartment in Praia da Luz, in the Algarve, the same place where the English child disappeared in 2007.
Brückner has not been formally charged with any crime in the Madeleine McCann case.
The German spent several years in Portugal, including in Praia da Luz, around the time the English child disappeared in 2007, but always denied any involvement in her disappearance.
In the ongoing trial regarding sexual assaults, Brückner's lawyers presented a request to annul the arrest warrant, with the court deciding that there were no “strong suspicions” regarding the charges against him.
According to the AP, a decision in this process is expected in the autumn.
In 2020, Brückner was designated as the main suspect in the case of Madeleine McCann's disappearance, a case investigated over years without the child being found.

Success for the Maddie suspect Christian Brückner (47)!
At the request of his Defence lawyer, the Braunschweig District Court has cancelled the arrest warrant against him.
This is about the current trial: Brückner is on trial for three rapes and two cases of sexual abuse of children. The prosecutor's office also considers him to be the man responsible for the disappearance of little Madeleine McCann (then 3) in Portugal in 2007. But in the case of Maddie, Brückner is Brückner not (yet) accused, the investigation is still ongoing.
The court chaired by Judge Dr. Uta Engemann now cancelled the arrest warrant at the request of Defence lawyer Dr. Friedrich Fülscher (40) because it "denies an urgent suspicion of all charges".
This means that the judges no longer consider Brückner to be urgently suspected in the five accused cases!
Brückner is accused of raping the Irish woman Hazel B. (then 21) in her apartment in the Algarve in 2004. The victims of the two other accused rapes are unknown. Witnesses want to have seen the deeds on videos. In April 2007, according to the indictment, Brückner is said to have masturbated in front of a German girl (then 10) in the Algarve. In 2017, he was arrested at a folk festival because he is said to have masturbated there in front of children.
Dozens of witnesses have been heard from all five charges since February. At the end of the taking of evidence, the district court no longer seems to be convinced that Brückner committed the accused acts. "Any other decision would not have reflected the result of the taking of evidence," says Defence lawyer Fülscher to BILD.
"We will examine the justification of the decision and then decide how we will proceed," prosecutor Hans Christian Wolters announced to BILD.
Will the Maddie suspect be released now?
Not at first. Brückner is still in criminal custody, that is: He is sitting for the seven years to which the District Court of Braunschweig sentenced him in 2019 because he raped the American Diana M. (then 72) in Portugal in 2005.
However, if the district court acquitted him in the current proceedings - for which the current decision could be an indication - then he would have served the current prison sentence in 2025 and would be released. Unless he is accused in the Maddie case by then - and the court allows the indictment.
The judgement in the current trial is expected in October.

A GERMAN court has quashed an arrest warrant that was issued for Madeleine Mccann suspect Christian Brueckner for a series of alleged sexual assaults and rapes.
It means the paedophile and rapist, who is currently on trial for said crimes, could be freed within months.
A judge at Braunschweig Court agreed with Brueckner’s defence that there was not enough evidence to keep him behind bars for five separate sex offences.
Ute Engemann believes that the evidence in the case of three rapes and two child abuse cases is not strong enough.
This is despite the German expat being caught exposing himself to a group of children in Portugal in 2017.
This afternoon a press release was issued by the court announcing that the warrant had been quashed.
The document says that ‘the Chamber cancels the arrest warrant.’
It adds: “In proceedings 2 KLs 213 Js 52790/18 (15/22) in connection with five acts against sexual self-determination, the Chamber revoked the arrest warrant at the request of the Defence because the Chamber denies an urgent suspicion of all charges.”
The move is almost certain to be appealed and will cause huge controversy.
Today one of the witnesses Helge Busching told the Olive Press: “This makes a total mockery of German justice.
“It’s taken years off my life and now they want to set this sick man free?”

Christian Brueckner is the leading suspect in the disappearance of Madeliene mccann
German Busching, who lived for many years in Spain and Portugal, had helped to convict Brueckner of the rape of an American pensioner Diana Menkes, in 2005.
The seven-year sentence comes to an end next year but he could be freed earlier. Busching spent three years in witness protection.
In that case, in Praia da Luz, where Madeleine went missing in 2007, police found a hair in the 71-year-old victim’s bedroom.
The hair, which had been kept in a crime storage box, matched Brucekner’s DNA.
She had been sadistically beaten and raped during a three hour ordeal which he filmed.
The lawyer of Irish rape victim Hazel Behan described the court’s decision today as a ‘very bad signal’. Hazel has declined to comment so far.
Prosecutor Hans Christian Wolters is away on a three-week holiday and is unavailable for comment.
It is likely that a quick decision will now be made on whether to prosecute Brueckner over the abduction of Madeleine McCann.
This is despite prosecutor Hans Christian Wolters indicating to the Olive Press that a trial wouldn’t be until next year.
The court last week confirmed Brueckner’s legal team had applied to get the arrest warrant overturned.
His lawyer Friedrich Fulscher said he could soon be released from prison if it proved successful.
“If it is overturned and he is ultimately acquitted, he would be released in spring next year at the latest,” he told Sky News.
He added: “I am sure this will be granted. I can’t imagine it any other way.
“After the evidence had been taken, not a single accusation had been substantiated in such a way that one can speak of a suspicion of an offence.”

OH DEAR Not enough evidence even to keep him on remand, Not even enough for a reasonable suspicion let alone to find him Guilty of anything.
What is Clarke going to do now. ?
I have a suggestion.
He can Re-print the book but just change the name Brückner to Hewitt or Montiero, Reid, Ney or even Murat and re-issue it. I am sure pro-McCann acolytes will buy it and lap it all up.
