We are now well into February.   Day 39 / 365. More than a tenth of the year gone already.

May we assume that Wolters has by now had his "meeting" and his "mock trial" and that Brückner is about to be formally charged ? 

Or is it more likely that the application to move the proceedings to Magdeburg where he actually lived, or to Frankfurt, where he was formally arrested have caused someone to open the folder of evidence only to find there is nothing much in it except cuttings from the Olive Press and a few pages of Clarke's book ?

The Mock trial (pure Olive Press style fantasy) would have been wonderful to contemplate.

Arraignment of suspect in Madeleine "Maddie" McCann case on multiple sex offence charges.

The Braunschweig Public Prosecutor's Office today brought charges before the Braunschweig Regional Court against a 45-year-old German man for several sexual offences he is alleged to have committed in Portugal between 28 December 2000 and 11 June 2017.

The accused is the same person who is being investigated on suspicion of murder in connection with the disappearance of the then 3-year-old British girl Madeleine Beth McCann on 03.05.2007 from an apartment complex in Praia da Luz in Portugal.

Specifically, the accused is charged with three counts of aggravated rape and two counts of sexual abuse of children:

1. At an unspecified time between 28.12.2000 and 08.04.2006, to have surprised an unknown approx. 70-80 year old woman in her holiday flat in Portugal in her bedroom. The masked accused then allegedly tied up the victim and raped her. He then beat the victim several times with a whip. The accused allegedly recorded the entire event with a video camera.

2. On another day between 28 December 2000 and 8 April 2006, which can no longer be precisely determined, the accused allegedly tied an unknown German-speaking girl aged at least 14 to a wooden pole in the living room of the house he lived in in Praia da Luz in Portugal. First, he beat the naked girl with a whip. Afterwards, the accused allegedly brutally forced the girl to perform oral sex. The accused had also videotaped this act.

3. On 16 June 2004 at around 3 a.m., the accused allegedly gained access to the flat of a then 20-year-old woman from Ireland via the balcony in Praia da Rocha in Portugal. The sleeping woman was then awakened by the masked suspect at knifepoint and brutally raped. The accused then tied the woman to a table and gagged her and raped her again. He then whipped the victim on the back with a whip he had brought with him and finally forcibly performed oral sex on the victim. The accused had filmed large parts of the events with a video camera he had brought with him. While the accused later fled over the balcony, the victim managed to free herself and asked for help, crying.

4. On 7 April 2007, at around 3.30 p.m., the accused allegedly ambushed a ten-year-old German girl playing on the rocks behind a rockhole on a stretch of beach in Salema in the district of Faro in Portugal, wearing only shoes and otherwise naked. He grabbed the child by the wrist and began to perform masturbation movements on his naked penis. While doing so, he grinned and asked the girl to look at his naked genitals and the masturbation movements performed on them in order to get sexually excited. After the accused had ejaculated, he let go of the girl and fled.

5. On 11 June 2017, in the early hours of the morning at around 2 a.m., during the so-called Snail Festival at a playground in Bartolomeu de Messines in Portugal, the accused made eye contact with an 11-year-old Portuguese girl who was sitting on the swing of the playground there. Then, while maintaining eye contact with the child, the accused pulled down his trousers and pants and made masturbation movements on his naked penis in order to become sexually aroused until the frightened girl ran to her father for help. The accused was arrested on the spot by the Portuguese police.

On the basis of the indictment, a warrant for his arrest was requested because the public prosecutor's office believes that there is strong suspicion of the crime. In addition, there is a risk of flight and repetition.

The indictment, which is over 100 pages long, was preceded by several years of very intensive and elaborate investigations in several European countries, especially by the Federal Criminal Police Office.

The accused is a sex offender with several previous convictions, including for sexual abuse of children.

Currently, the accused is serving a 7-year prison sentence for a rape he also committed in Portugal in 2005.

The jurisdiction of the public prosecutor's office in Braunschweig results from the fact that the accused had his last residence in Braunschweig before his stay abroad.

The Braunschweig Public Prosecutor's Office, which employs about 250 people, is the largest of the public prosecutor's offices in the district of the Braunschweig General Public Prosecutor's Office. Prosecutors admit they still cannot prove Christian Brueckner is the man who snatched Madeleine McCann, a friend has claimed.

German authorities are “convinced” the 46-year-old paedophile abducted and murdered the British youngster in Portugal in 2007.

But more than three years since they named Brueckner as their prime suspect, they appear no nearer charging him.

And now the Mirror can reveal a friend claims prosecutors have admitted they are struggling to get enough evidence against him.

They have begun re-interviewing Brueckner’s friends and associates in a bid to crack the case once and for all.

One pal, who knew the German when they were living in the Algarve together, spoke to detectives in recent months.

He told the Mirror: “They believe Chris did it, they say they know he did it, but they told me they don’t have proof.

“That’s why they are going back over old interviews. When they spoke to me they were very open about what the situation is.

“It felt like they are struggling. They just asked the same questions again, there was nothing new.”

Another friend, who still lives in the Algarve, was approached before Christmas and asked to go over their statement.

“It was a surprise to hear from them after so long,” said the pal, who asked not to be named.

“They said they wanted to make sure they hadn’t missed anything from the first face-to-face interview.”

Brueckner, who denies any involvement in Madeleine’s disappearance, is currently serving a seven-year jail term for rape.

He was charged last October with five sex crimes allegedly carried out in Portugal between 2000 and 2017.

But the Mirror can reveal a German legal wrangle over jurisdictions is threatening to delay any trial for months.

It could see the Madeleine investigation or the case handed over to new prosecutors.

Prosecutors in Braunschweig have overall charge of the case because Brueckner’s last registered address was in the city in 2016.

But his lawyer Friedrich Fuelscher says he was actually living in a warehouse in Neuwegersleben, Lower Saxony.

He is arguing that prosecutors in that region have jurisdiction and wants the Braunschweig team thrown off the case.

Mr Fuelscher is believed to be preparing a formal application for the case to be transferred to Lower Saxony.

Braunschweig prosecutor Hans-Christian Wolters told the Mirror: “There is no news to report regarding Maddie.

“We are conducting the investigations as we deem appropriate and necessary.”

Asked about the jurisdiction row, he said: “The regional court has not yet made a decision on how and when the proceedings will continue.

“We still assume that we are responsible.

“Should this be judged differently in the context of a judicial review, we would of course have to accept it as such.

“Nothing would be lost as a result, because our files would simply move from one prosecutor’s office to another.”

Mr Wolters said last year that investigators are now working “solely” on the Madeleine probe.

Kate and Gerry McCann, from Rothley, Leics, previously welcomed the investigation and remain hopeful their daughter is still alive.

Their daughter was three-years-old when she vanished from their Praia da Luz holiday apartment in May 2007.

Brueckner is not expected to make any court appearances ahead of his trial at Braunschweig Regional Court.

Prosecutors are waiting on judges to formally indict him on the five sex crimes once they have reviewed the evidence.

German prosecutors say they will not charge suspect Christian Brueckner over Madeleine McCann ’s disappearance this year as the investigation continues.

Hans Christian Wolters insisted he was confident authorities would have enough to indict the German paedophile next year.

His comments follow reports prosecutors had admitted to his friends and associates they were struggling to get enough evidence against him while interviewing them in a bid to crack the case once and for all.

Mr Wolters told respected Portuguese daily Expresso: “The investigation is ongoing but it’s going to take a lot longer.

“Perhaps we won’t finish this year.”

He declined to explain the delays in bringing the case to court despite German prosecutors identifying Brueckner in June 2020 as the man “responsible” for Madeleine’s kidnap and murder, telling Expresso he didn't want to “share the results or the current state of the investigation.”

Mr Wolters has repeatedly insisted he believes they have the right man despite growing concern about the failure so far to charge him over the British youngster’s May 2007 disappearance and increasing fears he may never stand trial.

He told Portuguese journalist Sandra Felgueiras during an interview last May: “We are convinced he is the murderer of Maddie McCann.

“We have one suspicious person and this is Christian B.

“There is no other person for us who is suspicious.”

The German prosecutor said in October 2021 authorities there had “strong evidence” against Brueckner and hoped to have an “update soon.”

Those comments sparked reports the 46-year-old, currently serving time for the September 2005 rape of an American OAP in Praia da Luz, could be charged by Christmas 2021.

Mr Wolters made it clear the indictment against Brueckner would be made in Germany and said that although Portuguese authorities were assisting them, there was no “joint investigation.”

A Portuguese PJ team based in the northern Portuguese city of Porto, led by Helena Monteiro, is still working on the case.

A source involved in the Portuguese side of the investigation said last night: “The team in Porto continue to have direct contact with the German and British authorities.

“Now of course it’s more with the Germans.

“It’s an informal bilateral contact in which direct help involving the checking of information is provided.”

Last autumn Brueckner was charged in Germany with several sex crimes on the Portuguese Algarve against women and children including the rape of an Irish holiday rep in 2004 and the sexual abuse of a 10-year-old girl on a beach near Praia da Luz in 2007.

No date has yet been set for the trials.

Brueckner, who denies any involvement in Madeleine’s disappearance, claimed in a letter penned from his prison cell that the decision to charge him was linked to a “fairy tale” indictment.

He also moaned in a rant from Oldenburg jail where he is serving his time for the American OAP rape that he was being treated worse than feared Nazi war criminal Joseph Goebbels.

Informers with chequered pasts who knew Brueckner when he lived in Portugal and were involved in criminal activity with him are understood to be key to the case German prosecutors are trying to build up against him over Madeleine’s disappearance.

One friend, who knew the German when they were living in the Algarve together and spoke to detectives in recent months, told the Mirror last month: “They believe Chris did it, they say they know he did it, but they told me they don’t have proof.

“That’s why they are going back over old interviews. When they spoke to me they were very open about what the situation is.

“It felt like they are struggling. They just asked the same questions again, there was nothing new.”

Kate and Gerry McCann welcomed news last April Brueckner had also been made an official suspect or arguido in Portugal.

It was labelled a “procedural trick” linked to statute of limitations legislation by Brueckner's defence lawyer at the time.

Crap - to use the vernacular.

There is everything wrong with this report - for a start it again veers away from the basics recorded by the PJ files.

I about don't give a monkeys about the German prisoner, he is not the prime suspect in the disappearance of Madeleine McCann - Gerry and Kate McCann wear that badge until proven otherwise.

There is not a scrap of evidence to suggest, let alone prove, that Madeleine McCann was kidnapped/abducted/stolen, nor murdered.

Please please get your facts right, do you understand how deceptive this is?

Why is this even happening, who is masterminding the mechanics.  I don't believe for a single nano-second that anyone is being investigated as regards Madeleine McCann's tragic disappearance so why are we routinely subjected to these tabloid non-stories?

When spreading these falsehoods remember - there is a little lost child at the centre of it all.

It's boring, isn't it? Whatever they come up  with after his death, they still won't be able to connect him to Madeleine's disappearance. 'Perhaps we won't finish this year', and 'Madeleine will be home by Christmas'.  'I think I'm Madeleine McCann'. So many people lying, to put themselves in the headlines.

Charge Brueckner with the crimes they can prove he's committed and stop trying to pin crimes on him that he hasn't.

And got out of Jail early.

Well yeah, but don't forget that Super-Jon has no concept of time.  2 weeks to him could be anything from a split second to a million years.

Isn't CB due for release from prison 2025 after serving his time for the crimes he's been convicted of? or earlier if he gets parol.

If the other charges result in a Conviction additional Security Arrest could be Ordered, which means he would be in for life.

It sounds unlikely from the StA Braunschweig that he will even be released on Parole due to a risk of fleeing and re-offending.

Time is of no importance to the Investigative Phase under German Law.

Wolters can therefore, Suspect CB forever. (Which is why it had to be a German Suspect?)

What about the Visitors he has invited / allowed into his Office?

Is this information taken from Bild (the German equivalent of the British tabloid - The Sun) or from your usual source of sketchy misinformation?

Before embarking on possibilities about the German's future position, it needs to be established from an official source, exactly what crimes he has committed in order to consider his present status under German law.  So far all I've seen are tabloid press claims of past crimes - invariably they can't even get his current status correct, most likely because it's unknown outside the German authorities - if anything even exists.

More importantly, it's very unhelpful to opine on a subject one knows little or nothing about.

The law in any jurisdiction is very complicated, never black and white.  To claim knowledge without the expertise is foolhardy to say the least.  Only experts on the subject of law, trained in the discipline, are in a position to comment on the subject - even they have to resort to precedence, try their luck on legal technicalities so to speak.

More hell for Madeleine McCann family as probe into prime suspect to last until 2024

It comes after the case of missing Madeleine hit headlines again in recent weeks after a Polish woman claimed she could be her on social media.

Madeleine McCann’s parents face fresh misery as it emerged the prime suspect in her disappearance will not be charged this year.

German prosecutors said in 2020 that jailed paedophile Christian Brueckner was “responsible” for her kidnap and murder.

The following year they promised “an update soon” but are now struggling to crack the case.

Prosecutor Hans Christian Wolters admitted: “The investigation is going to take a lot longer. Perhaps we won’t finish this year.”

Rapist Brueckner, 46, who denies involvement, lived near the Algarve resort where Madeleine, three, from Rothley, Leics, vanished in 2007.

A friend who was quizzed by detectives said: “It felt like they are struggling. They just asked the same questions again, there was nothing new.”

Madeleine’s parents Kate, 54, and Gerry, 55, welcomed news last April that Brueckner had been made an official suspect, or arguido, in Portugal.

It comes after the case of missing Madeleine hit headlines again in recent weeks after a Polish woman claimed she could be her on social media.

Madeleine was just four years old when she disappeared from her holiday apartment while on holiday in Praia da Luz in Portugal in 2007.

Mystery has surrounded the search for Madeleine in recent years but no trace of her has ever been found.

Julia Wandelt set up an Instagram account in mid-February and claimed that she is missing Madeleine.

The 21-year-old from Poland claims to have a freckle on her leg and a speck in her eye in the same places as the British girl, as well as looking similar to Madeleine's parents Kate and Gerry.

The Instagram profile, which consisted of dozens of posts she thinks acts as proof, racked up more than 1 million followers - but has since been deleted.

I wonder if Herr Wolters has heard of Julia Wandelt, but then he knows it can't be Madeleine because he has concrete evidence CB killed her.

Shouldn't he be putting the McCanns out of their hell by telling them what evidence he's got against CB.

The saga has been going on for nigh on three years, the story told has been the same since the beginning.

We've got all the evidence we need but we've just got a few ends to tidy before moving forward charging him .... in the spring, summer, late summer, before the end of the year, in the new year, by spring, before the end of summer, not until the new year, definitely during spring, not quite there - make that late summer. Nah, new year.

Errrrrr .... looks like another years before we can proceed.

There is something very worrying and extremely sinister about the Germans announcing to the entire world that a man has committed a crime but being unable to present a single piece of evidence to back it up.

There is a long but recent history in Germany of doing this.
Blaming the 'Communists' for the burning of the Reichstag being one example, and the 'Jews' for all the economic woes and the loss of WW1 being the most egregious. Both with the results we know too well.

What is more sinister is the number of Media outlets who continue to promulgate this unevidenced allegation.
It is almost as if they were being controlled or coerced, as was the Press in 1930s Germany.

This goes deeper than a few tabloid hacks writing rubbish.   It is actually very worrying.

Of all the E-fits and artists' impressions of persons of interest that the FM page and Grange have released over the years, there is not a single one that bears any resemblance to Christian Brückner. 
Not one.

Jon Clarke knows this, which is why last year he was insisting that Brückner had undergone extensive facio-maxilliary surgery and orthodontic procedures, in order to insist that he might have been 'buck-tooth-man'.
