The prime suspect in the Madeleine McCann case has been ruled out of having any involvement in the rape and murder of another child.
Christian Brueckner was accused of being involved in the rape and murder of 11-year-old girl Claudia Ruf in his native home of Germany.
But DNA of the 43-year-old was no match for that found at the scene of Ruf's death.
It comes after police in Portugal failed to match the convicted paedophile to the rape of Irish tour guide Hazel Behan, 37.
A source told The Sun: "It is a setback, there's a sense of disappointment as this is the second time."
Portuguese police fear Brueckner will never be convicted for his suspected crimes against McCann.
Brueckner is currently in jail for drug offences and is appealing a seven-year sentence for raping a 73-year-old woman.
Sources told the Sun while police are working around the clock, leads have dried up.
"They know [he] will never talk. So it will be up to them to find the missing pieces of the jigsaw to lead them to finally find out what happened to Maddie."
Despite this, German officials say they have "concrete evidence" McCann is dead, and firmly believe Brueckner is behind her death.
But with leads drying up, Brueckner has boasted he's onto the police's strategies and won't fall their "dirty tricks" to get him to confess to having anything to do with the youngster's disappearance.
Brueckner, who was in the vicinity when McCann disappeared from the resort while on holiday in Portugal in 2007, is reportedly raging over reports a fellow inmate may have been recruited by detectives to try and get him to confess.
The Sun reported that Portuguese police are "concerned" at claims German authorities have resorted to "planting" spies inside the prison Brueckner is locked up in.
Brueckner is reportedly furious and says he's one step ahead of the police.
"Despite the silence of prosecutors, he is convinced that the police have been using all sorts of dirty tricks to try and nail him," a source told The Sun.

Bei dem Anhörungstermin in Braunschweig kam es nach dpa-Informationen zu einem Zwischenfall, nach dem der 43-Jährige in einer Klinik behandelt wurde. Die Polizei bestätigte auf Nachfrage einen Einsatz im Landgericht, ohne aber weitere Details zu nennen.

The convicted rapist and paedophile, 43, was treated for two broken ribs after being allegedly attacked as he waited in a court cell ahead of a parole hearing.
His lawyer Friedrich Fulscher claimed he had been hurt by officials and he would be filing charges but the court insisted he had ''fallen over'' while waiting downstairs in the cell.
Police were said to have been called to the court to deal with the incident and Christian B was taken to a nearby hospital for treatment.
Last night a spokesperson for the court said: ''The exact sequence of events is now the subject of investigation.
"Against this background, we cannot comment on the details.''
Christian B was identified by German police as the man responsible for Madeleine's abduction and murder in May 2007.
Today he was driven from prison in Kiel, two hours south to Braunschweig court where he appeared for a parole hearing.
He is currently serving 21 months for drug offences but he is eligible for parole on January 6 after serving two thirds of his sentence.
Wearing a white mask he was driven into the back of the court building flanked by two police officers before being escorted into the building for the hearing.

According to witnesses the incident occurred in a holding cell where he spent 40 minutes waiting for the Parole hearing. When the Ambulance staff arrived, they were told “someone was rioting in there”.
His Lawyer Herr Fülschers has viewed the Security Cameras in the Area and was heard shouting loudly outside the Cell at the Jail staff.

Herr Fulscher his Lawyer has lodged a formal complaint about two Guards in the holding Cell area.
It cannot be he got upset about any bad news as he did not receive any, the incident happened before the hearing.
Even after his return from Hospital, at the hearing no decision has been made as to his possible release date.

Christian Brueckner is not the prime suspect in the disappearance of Madeleine McCann. Her parents Gerry and Kate McCann are the prime suspects until such times as they are pronounced innocent by a court of law. Even if the case reaches statute limitation they will remain the prime suspects for eternity.

Prime suspect Christian Brueckner, 43, is back in jail following hospital treatment for two broken ribs which, he alleges, came from a scuffle with guards.
Chief prosecutor Hans Christian Wolters said: “We got leads from England, including ones from tourists on holiday in Portugal during this time.
“We got some photos where there might be some interesting things on them.
"There are quite good leads we are following up.”
But he said the information would take time to pursue and when the UK leaves the European Union this could take even longer as “many things can’t just be clarified at short notice”.
There were reports in Germany of developments in the case of three-year-old Madeleine who vanished on holiday in the Portuguese resort of Praia da Luz in May 2007.
But police in Hanover categorically denied any searches carried out were linked to her disappearance.
Mr Wolters said the formal hurdles in the McCann case post-Brexit will get bigger.
He said: “In the EU everything was unified, and there was a uniform legal assistance between the European countries.”
But when the UK leaves he said Germany would have to “make a formal request, which means that we then write a very formal letter and then query everything individually”.
Phone records put Brueckner near the scene on the night Madeleine went missing.
He is serving a jail term for drug offences in Kiel, Germany.
He was sentenced to another seven years for raping a pensioner in Praia da Luz in 2005 but is appealing against his conviction.

I have long thought that Brexit may have some big impact on this case, now is the case covered up by the British Government or the EU? Will support for the McCanns end once we leave the EU?
Tony Blair was probably the first to rush to the aid of the McCanns, he even forfeited his PR officer to control what came out in the press on this case. Remainer Blair has immunity from prosecution and it was he who doubled our contributions to the EU, he was also pulling the strings to thwart Brexit. Why? Would he lose his immunity? What was he covering up that would be exposed in the McCann case?

That's not strictly true.
At the time of the Portuguese investigation in 2007/2008, international policing protocol was in existence, hence the application for information by the rogatory processes. It was said they cut corners, using direct contact, in order to save time but somehow I think it was more a case of being compromised, forced, into the situation.
Officers from Leicester police, the CEOP, the diplomatic corps and such like, all rapidly descended on Portuguese soil for a bit of the action. That simple act of interference broke the international policing code of practice before the investigation even got under way.
I wonder just how much was borderline illegal.

The prime suspect in the disappearance of Madeleine McCann allegedly suffered two broken ribs when he fell during an altercation with court officials after he was refused permission to smoke.
Christian Brückner was taken to hospital for treatment following the incident in the northern German city of Braunschweig on Monday.
His lawyers have filed a criminal complaint against court officials over the incident, but the full details of what took place have only now begun to emerge.
The incident began when Brückner, who had been transferred to a holding cell ahead of a court appearance in connection with another case, was told he could not smoke, according to an account leaked to Zeit newspaper.
The convicted paedophile and rapist reacted by staging a furious protest, smearing the walls of the cell with yoghurt and blocking the toilet with paper. Officers intervened and in the course of the altercation, Brückner’s legs were kicked from under him and he fell against the wooden bed, breaking two ribs.
The details emerged as Brückner’s application for parole in another case was rejected on Thursday and judges ruled he should remain behind bars.
German authorities have not confirmed what happened inside the courthouse but the account has been backed by Brückner’s lawyers, one of whom claimed he witnessed officers filming with a smartphone as ambulance workers treated his client’s injuries following the incident.
Friedrich Fülscher claimed he asked the officers to stop, but had to call a judge to get them to delete the video.
“The officers were enjoying themselves. In my opinion, that allows one to draw conclusions to be drawn about the actual events, but in any case it was extremely unprofessional and inappropriate,” Mr Fülscher said.
Brückner was identified as a suspect in Madeleine McCann’s disappearance in June. German prosecutors claim they have evidence she is dead and say they are treating the case as a murder investigation, but Scotland Yard still consider it a missing persons inquiry.
The 43-year-old career criminal is currently serving a 21-month sentence for drug offences, and was transferred to the Braunschweig courthouse on Monday ahead of a routine parole hearing.
On arrival he was taken to a holding cell in the courthouse, where officers allegedly taunted him with comments such as “Nice to see you back!” and “We’ve got a very special room for you today, suite number 2!”
According to details leaked to the German press, when he asked if he could smoke, the guards replied, “We decide who gets to smoke here”.
Brückner then staged his protest by smearing the walls with yoghurt and blocking the toilet. Officers moved in to restrain him. They handcuffed him and ordered him to kneel so his legs could be shackled, and when he did not comply his feet were knocked from under him.
“The chances of a restrained person injuring himself in the presence of officials are limited,” Johann Schwenn, another lawyer for Brückner said.
“Unfortunately, an attack by officers in the manner described by our client would not be an isolated case. The presumption of innocence is sometimes difficult for the police and judiciary, especially when it comes to an alleged sex murderer. Then inhibitions fall away.”
The incident comes a week after the Portuguese press reported a leaked memo from their Policia Judiciaria which said they were “shocked” after being briefed on the case by German prosecutors, adding there is “no evidence, just speculation”.
Brückner’s application for parole was rejected on Thursday after judges ruled his early release “could not be justified, taking into account the security interests of the general public”. The court noted he had several previous convictions and had previously broken parole conditions.
Even if he had been granted parole, Brückner would have remained behind bars. He is also facing a seven-year sentence for rape. He has appealed but will be remanded in custody until his appeal is heard.

A court in northern Germany said Christian B, as he is known under German privacy laws, has a long criminal record and has violated parole regulations in the past, including those relating to narcotics.

Earlier this week, Christian B was injured while being taken to the court hearing.
He sustained rib injuries while officers were putting ankle cuffs on him on Monday, the court said.
He suffered two broken ribs and needed hospital treatment, according to the national newspaper Bild.
The way in which he was shackled and the "following course of events" are being investigated, the court added.

Developments in the House search in Hannover due to possibly false information.
The son of the Houseowner was removed in handcuffs by the SEK (SWAT) team around 06:30 on Wed 18, followed by the Mother.
The entire House and Garden were being searched due to information being supplied that “bad things happened in the past” at the address.
On completion of the search, nothing was reported to have been found.
Police are not confirming it has anything to do with CB, who is believed to have been a previous tenant.

Christian B claims he was left with two broken ribs after a "fight" with prison guards last week.
Now the 43-year-old - who spent one hour in hospital after the incident - allegedly wants an apology and a compo payout.
“He is refusing to let this lie," a source told Sun Online.
"He wants the authorities to say sorry and he wants compensation for the injuries he sustained," the source claimed.
But they added: "The guards in charge of him inside think he is just trying to stir up trouble and play system."
Convicted rapist and paedophile Christian B allegedly started the scuffle after "throwing a tantrum'' in his cell, smearing it with yoghurt and blocking the toilet with loo roll.
A source at the Braunschweig courthouse where the incident happened said: ''He got angry at being filmed and complained.
"He reacted angrily and when he refused to put the shackles on there was a more violent tussle and he hurt himself.''
Speaking to The Sun Online, his lawyer Friedrich Fulscher said Christian B had suffered serious injuries after "dirtying" his cell.
But now a source says that ever since Christian B returned from his short A&E jaunt, "he has made one thing crystal clear - he wants someone to pay for what happened”.
The Sun Online understands the suspect plans to point to the fact a female official was caught filming part of the attack on her mobile phone.
She was later ordered to delete footage by a judge.
“[Christian B] believes this footage was deleted as it would have shown the officers assaulting him," our source continued. "He thinks the woman should be made to come forward and at least say what she saw on oath.”
Mr Fuelscher confirmed Christian B has filed a formal complaint.
But he refused to comment on whether his client was aiming to secure compensation in the future or any other details about his complaint.

Still no further developments in the Hannover house search that the British Press linked to Christian B.
Data is still being viewed by the Police who described the tip off they received as being “thin”. No further information is being given out so far in order to protect the Suspect from coming to harm.
Should it be proved to be False information was supplied to the Police, Oberstadtsanwalt (Chief prosecutor) Herr Klinge warned the suspect may be liable for a punishment between 3 months and 5 years in Prison.

MADELEINE McCann suspect Christian B is moving to a maximum security prison ahead of questioning in the New Year.
The convicted paedophile and rapist 43, is currently serving a 21-month drugs sentence and is in isolation for his own safety.
In January, that term will end and he will be moved from Kiel maximum security prison to one 200 miles south in Lower Saxony at either Celle or Wolfenbuttel.
Both are Category A maximum security.
Christian B has already spent time in Wolfenbuttel when he was on remand ahead of his trial last year for raping a 72-year-old woman in Praia da Luz in 2005 - just two years before Madeleine vanished.
MAXIMUM SECURITY
Judges at Germany's Federal court confirmed the sentence earlier this month and while on remand investigators used an informant to spy on him to gain evidence for their investigation into Madeleine's disappearance.
The move will make it easier for prosecutors based at Braunsweig to question him in connection with the Madeleine case, and two other sex crimes they are trying to pin on him.
Christian B was identified as the prime suspect in the Madeleine disappearance last June by German investigators.
They said they had ''concrete evidence'' she was dead and that he was responsible, although no charges have been brought yet.

Lawyer Friedrich Fulscher, who is defending him and insists the police have the wrong man, said: ''It's very likely he will be transferred in January but I have no comment to make.''

MADELEINE McCann suspect Christian B is moving to a maximum security prison ahead of questioning in the New Year.
The convicted paedophile and rapist 43, is currently serving a 21-month drugs sentence and is in isolation for his own safety.
In January, that term will end and he will be moved from Kiel maximum security prison to one 200 miles south in Lower Saxony at either Celle or Wolfenbuttel.
Both are Category A maximum security.
Christian B has already spent time in Wolfenbuttel when he was on remand ahead of his trial last year for raping a 72-year-old woman in Praia da Luz in 2005 - just two years before Madeleine vanished.
MAXIMUM SECURITY
Judges at Germany's Federal court confirmed the sentence earlier this month and while on remand investigators used an informant to spy on him to gain evidence for their investigation into Madeleine's disappearance.
The move will make it easier for prosecutors based at Braunsweig to question him in connection with the Madeleine case, and two other sex crimes they are trying to pin on him.
Christian B was identified as the prime suspect in the Madeleine disappearance last June by German investigators.
They said they had ''concrete evidence'' she was dead and that he was responsible, although no charges have been brought yet.

I can't believe I've just read that, what absolute nonsense.
Still, I guess it's a good lead-up to the inevitable twaddle the readers will be subjected to in the course of the next four weeks. Another Christmas passes without the girl - what was her name? The misery never stops for Kate and Gerry, not only are they living without the toddler but the latest suspect refuses to tell all.
Christmas is coming, the Fund is getting lean - please put some money in our campaign machine. Or a plain brown envelope addressed to Kate and Gerry - Roafley. It'll get there!

The chief suspect in the disappearance of Madeleine McCann is being moved to a maximum security former Gestapo guillotine jail ahead of interrogation in the New Year.
Christian Brueckner, 43, a convicted rapist and paedophile, is serving a 21-month sentence on an unrelated drugs matter at a prison in Kiel.
In January, he will be transferred south to the Category A Wolfenbuttel prison to start a seven-year sentence for raping a 72-year-old woman in Praia da Luz in 2005.
Wolfenbuttel was an infamous execution centre used by the Nazis to hang and guillotine deserters, PoWs, and civilians during the Second World War.
Brueckner was previously remanded at the prison ahead of last year's trial for raping the elderly American woman.
She was attacked just two years before Madeleine disappeared from the same Algarve resort.
Earlier this month, a court in Karslruhe rejected Brueckner's appeal against the 2005 rape conviction and confirmed his seven-year sentence.
The move will make it easier for detectives in Braunschweig, around 15 minutes' drive away, to question Brueckner about the Madeleine case, as well as two others.

The reason that Brueckner is being moved to a prison in central Germany is because sentences are served in the state that hands them down.
Keeping prisoners is expensive and under Germany's federal system the states are obliged to deal with their own prisoners rather than it being handled by a central judiciary.
Even though Brueckner is a suspect in the McCann case, prosecutors have said they do not yet have enough evidence to hold him on that case alone.
Madeleine was three years old at the time of her disappearance in 2007 from an apartment where her family was on holiday in Praia da Luz in Portugal's Algarve region.
German authorities in June said they had identified Brueckner, a German citizen, as a suspect in the case and were investigating him on suspicion of murder.
Earlier this month, Brueckner suffered two broken ribs in an incident at a German court and was treated in a hospital, but was then able to return for a hearing that same day, authorities said.
