English defamation law puts the burden of proving the truth of allegedly defamatory statements on the defendant, and does not require the plaintiff to prove falsehood, and for that reason, has been considered an impediment to free speech in much of the developed world.
And there's the rub.
If you say the someone did it, and they say they didn't, they do not have to prove they didn't
It is up to you to prove - at least to the civil standard (and I suspect if you are alleging crime to the Criminal standard) that they did.
The onus of proof is on the DEFENDANT
In one case close to all our hearts the Defendant was threatened that if one, just one, statement proved to be libellous, ( in other words he could not prove its truth on the balance of probabilities, and it did not fit into the Fair Comment or other defence categories) then he would lose and be immediately liable to all the Plaintiff's and the court fees, which by then were in 6 figures.
So under that threat of financial ruin he signed the Undertaking.
In Plain English it is called duress, threats and intimidation, which are the words used in the Crime of Blackmail

Then in the Case you describe, the Defendant (Accusor) is Guilty/ wrong until he proves himself Innocent / correct?
I see your point. It differs only slightly in Germany because bearing False Witness and Setting someone up for doing a Crime they did not do - has to be done on purpose. With an intent. (As far as I know)
It can not be Fulfilled by Acting in the true belief it was the Suspect at the time, who is later cleared.
If Herr Fülscher wants to prove his Client has been Falsely Accused - then I hope the MSM and certain Witnesses can prove without reasonable doubt that Christian B “DID IT”.
Or he will surely try his best to make them pay.

The prime suspect in the Madeleine McCann case has employed a team of British lawyers to help his case, it has been revealed.
Christian Brueckner, 43, has instructed a UK legal firm to assist him as he tries to prove his innocence.
His German lawyer Friedrich Fuelscher said: “I can confirm we are using UK lawyers.”
But it remains unclear who is paying the lawyers’ fees.
Penniless Brueckner is currently doing time in a German jail and has no source of income.
When asked who was funding Brueckner’s representation, Mr Fuelscher replied: “I’m afraid I cannot answer that question.”
However, he said one of the lawyers’ roles was “looking at the media coverage surrounding him”.
It is possible the fees will be funded under the German legal aid system, which would mean the German taxpayers would be footing the bill.
Fuelscher has gone on record complaining about the “lack of objectivity” in some of the press reporting in Germany and the UK.
It is understood the legal firm combs all British news websites and reads every national newspaper each day to check coverage.

Police said the drifter’s mobile phone records placed him in the Portuguese seaside resort of Praia da Luz on the night she went missing in 2007. She was nearly four years old at the time.

If the McCanns wanted to put Charges in for the Murder of their Daughter at the hands of Christian B, they have not done it within the Three month “Antragsfrist” or Deadline.

Madeleine McCann suspect Christian Brueckner has today lost his bid to be freed from prison in Germany.
Lawyers for the 43-year-old had argued that European Arrest Warrant protocols had been breached, meaning he qualified for release.
But this morning that claim was rejected by European Court of Justice judges, who ordered that he remains behind bars.
He was arrested in 2018 in Italy, and is currently serving a 21 month sentence for drug dealing.
In December he was convicted of raping a 72-year-old woman in Portugal and sentenced to seven years in prison - a conviction is appealing against.
Brueckner, who denies having anything to do with Madeleine's disappearance, has served two thirds of his sentence.
Brueckner was named earlier this year as the chief suspect in Madeleine’s disappearance.
According to court documents, in which Brueckner is referred to as XC, he was extradited from Portugal for sexually abusing a minor in June 2017, then travelled to the Netherlands and Italy whilst still on probation after his release.
He was extradited to Germany from Italy in October 2018 on a warrant for drug trafficking before being tried and convicted of rape and extortion in December last year.
The ECJ case centred on whether the German authorities needed Portugal's consent to bring rape proceedings because of the 2017 extradition.

It was in early June that the "revelations" about CB first broke the news, so it's close to being four months now. And it even feels way longer than that since it has been the same day by day ever since: No progress considering his claimed involvement in the Madeleine case, just some dirty laundry for the gutter press and some dubious statements by untrustworthy witnesses. Apart from being beneficial to team McCann and potential for another documentary, or blockbuster stateside movie, it must surely be used as a reason to prolong Operation Grange. Home Office funding in that direction has suddenly gone undercover but is usually around March and this time of year that talks of application for further funding, or extending operations.
It's boring. As I repeatedly say, if the German authorities have any substantial evidence to implicate the Germanman in any way with the disappearance of Madeleine McCann, then show your hand or, failing that, proceed with a prosecution. Then and only then tell the world.
I'm not remotely interested in the sordid life of Germanman, past, present or future.
If there is evidence cough up, if not .... shut up!

It's mainly Portuguese/German languages but Ms Felgueiras does ask a few questions in English. I think you can tell all by the composure and facial expressions of the interviewee. even if you can't understand the language. As you can quite clearly see the general direction Sexta9 is taking.

Braunschweig-based Hans Christian Wolters claims the authorities simply need to be 'convinced' she is dead to be able to put a suspect on trial.

It really boggles the mind that Wolters keeps embarrassing himself with this nonsense yet remains so confident. So what are those strong pieces of evidence he keeps talking about? The latest "evidence" is just more gossip from dubious witnesses - how often have we had that before? Either they have clear evidence, then they should present it - or they have nothing, then they should better keep quiet. Bild were Reporting last night that there were unsubstantiated Witnesses in the Cagiva commune that are willing to State that CB also made “Confessions “ to them at the Mar 2008 Dragon Festival that he climbed out of the Grilled window. According to the Reporter.
Only problem is - the Grill was added afterwards! Kai obviously did not know!

I think as Maxheadroom has pointed out, there can be probably two Options...
1. They set Brückner up so Good, we all HAVE to believe it.
2. Or he will be ruled out of the Enquiries and will Sue everyone he can get his hands on. He is probably writing a Book already in his Cell?
Because Option 3 is not allowed to be Pursued, is it?
