McCanns may renew legal battle with Portuguese police chief

Madeleine McCann’s parents will pursue “with renewed vigour” a former Portuguese police chief who claimed they accidentally killed their daughter if any new suspect is convicted of her abduction or murder.
For more than a decade, Kate and Gerry McCann have been locked in a legal battle with Goncalo Amaral, the officer who led the original investigation into the girl’s disappearance, after he wrote a book claiming they had faked her abduction.
The couple, from Leicestershire, issued a writ against Mr Amaral, 59, after he published his book The Truth of the Lie containing his controversial claims.
Now, a source connected to the legal battle has said if the latest developments resulted in a successful prosecution for either the abduction or murder of Madeleine it would “demolish” the former detective’s arguments published back in 2008. Any criminal conviction would prove his claims “utterly defamatory”, the source said....

The last thing on my mind at present would be possible legal action against Rocky Amaral.

After an epic failure through the Lisbon courts to further crucify Mr Amaral, the McCanns submitted a case against Portgual to the ECHR.
That's where it stays until the ECHR conduct a hearing or reject the application. The ECHR is notoriously slow.
The McCanns cannot renew court proceedings with vigour or any other feigned emotion.
No abduction - end of.

My previous post. I wasn't sure which crime he is in prison for.
Is it the rape of the elderly lady, or a drugs offence?

As I understand it the drugs offence - as while he was convicted of the rape of Elderly lady in December he is still appealing the conviction therefore the sentence is suspended until such time as all proceedings are finished.MaddieMay13YEARS wrote:My previous post. As far as I can see mine is on topic. Lengthy but on topic.
Whether the McCanns can pursue any further legal action against Goncalo Amaral hinges does it not on whether Brueckner is charged convicted and Madeleine's remains found?
This is what I have spoken about in my post, reaching the conclusion as I did , that without the latter happening (charged convicted, remains found) the former - going after Amaral - is less than likely.

Thank you for clearing that up for me re two cases.
Oh and you are quite right. A confession and suicide could perhaps trigger for McCanns the green light to once more attack Goncalo Amaral through Court system.

In law the McCanns -v- Amaral is over.
Res Judicata. The matter has been adjudicated.
The facts of the case were in any event irrelevant.
The issue was whether Dr Amaral was entitled under the consitution to say it. Not whether it was true.
The Mccanns have been very careful to avoid having to give evidence about the 'facts' under oath
Carter–Ruck specialise in keeping their clients OUT of court. And they do it very well.
Interesting though that because of the obiter dicta or mumblings on the record in McCanns v Bennett by Tugendhat J. that case might be open to an appeal, since there has never been one, in the event that it is shown that
there was NO abduction.
We live in hope.

says a lot when the worlds' media is alight with the new revelations, their spokesman is claiming they are preparing for the worst in that she might be dead already....all the while being able to park all this and, allegedly, start planning the court case comeback.
