Will the McCanns take their appeal to the ECHR?
--------------------------
Is that the Every Child Has Rights (ECHR) 'court'
The McCan'ts will steer well clear of that!
They 'forfeited' Madeleine's 'child rights'...years ago!

Re: **updated** Appeal rejected. McCann's request for annulment of the Supreme Court's decision
An excellent result for GA.
It could have been rejected so quickly because of a late application , outside the 10 day limit.
The UK has been helpful ,supplying the dogs , but I hope they will let the Portuguese finish the job without any further intervening.
I don't think any diplomatic playground squabbling should get in the way of justice.

I am speed reading through some of the articles in the European convention on human rights, and from what I have read, so far, the McCanns have no case. I believe it’s all over for them, in regards to overturning the decision of the SC.

McCann’s “frivolity” complaint rejected. Gonçalo Amaral’s ‘libel win’ confirmed for 3rd time
This may be the end of the line for the long-running civil case taken out by the parents of Madeleine McCann to ‘silence’ their bête-noir, former PJ coordinator Gonçalo Amaral.
After all the hullaballoo and recriminations filling UK tabloids, Supreme court judge Dr Jorge Manuel Roque Nogueira has rejected the complaint lodged by Kate and Gerry McCann over what they considered a frivolous decision by fellow judges to uphold Gonçalo Amaral’s right to freedom of expression, sanctioning the intrinsic legality of his damning thesis ‘Maddie: the Truth of the Lie’.
Roque Nogueira’s decision, taken earlier today and published in PDF format online, means that Amaral has won the case for the third and possibly final time.
There is no higher court in Portugal to which the McCanns can take this fight - and the grounds for appeal to the European Court of Human Rights are “highly dubious”, said a source, particularly as Supreme Court judges referred to tenets set out by the ECHR in their 75-page deliberation.
For Amaral who has remained silent through this last tense stand-off over the Supreme Court ruling in January, the decision today means that finally his assets and property should be ‘unfrozen’, allowing him to return to the full control of his life.
As blogwriter Joana Morais has commented, Roque Nogueira’s decision came “sooner than we expected” and was “no doubt due to the weaknesses of the reasoning presented in the request for annulment of the Supreme Court’s ruling”.
For now, there has been no reaction from either the McCanns in UK, or their Portuguese legal team over here.
UK tabloids appear not yet to have the news.

Re: **updated** Appeal rejected. McCann's request for annulment of the Supreme Court's decision
If the Mc’s think they can go to the ECHR:
‘An application can be made by…….….who claim to be the victim of a human rights violation by one of the member states to the Convention’
‘….it is important you know which article(s) of the ECHR you are relying on in your application’
Amaral is now out of the picture and the Mc’s would be going up against Portugal!
From the list of articles linked in sallyP’s post above, I’m really struggling to see any article the Mc’s could succesfully go after Portugal for.

Doug, I think it is all over for them. The McCanns are minnows when it comes to the ECHR. The ECHR is more concerned with much bigger issues, such as torture, state killings etc. The McCanns have had their time in the sun, (in more ways than one) and now the sun is setting. Time to give up the ghost!

No, Brexit will not have any affect on a case taken by the McCanns to the European Court of Human Rights. Having said that, I think the McCanns would be stark raving mad to even attempt that route - it appears to be an idle threat to cover their extreme embarrassment at being defeated by the Lisbon Supreme Court's (the ultimate in the land) decision and being snookered by their arch-enemy and Madeleine McCann's hero of the decade - Dr. Goncalo Amaral!

Many moons ago when Mitchell first said Rocky was being watched blah blah many posters advised against the suing malarkey. All free advice and you know what - those posters were right.
I do hope that Rocky will now take legal action himself and that the legal action will be in UK against all who have insulted him and made his life hell.

The best way to proceed IMO would be for him to secure a publisher for his book in the UK. The revenue this will bring in and the fact that people can read it and make up their own minds would serve a higher purpose than any counter libel case. I am so thrilled with the news today Congratulations Mr Amaral

The news has gone Internaitonal without any help from the UK MSM.
More and more people are turning to the internet for their news.
It's mainly the older generation who buy the dailies anyway as those who can view the online versions can also view forums and other news outlets.
We need them less and less when celebsand others are prepared to speak out on Facebook and Youtube imo.

Yes, like Mark, there's still some journalists with integrity left...just not in the UK it would seem.
