Of note for such a claim must be Article 17, which provides that no one may use the rights guaranteed by the Convention to seek the abolition or limitation of rights guaranteed in the Convention, an allegation Gonçalo Amaral will surely consider against Kate and Bro. Gerry McCann?
If any lawyer should advise the McCanns to take this case to the European Court of Human Rights, they should be struck off - their case wouldn't even get through passport control. Mr Amaral on the other hand....
I'm rather hoping this latest development will be the finale. I don't see Mr Amaral as a vindictive man out for revenge through the law courts - unlike some one could mention. This is a tremendous victory for Mr Amaral, he now needs to re-build his life and maybe, just maybe, continue working 'behind the scenes' in pursuit of justice for little Madeleine McCann - which I believe has always been his primary objective.

In all the news coverage I've read, The Telegraph for some reason, is the one that still seems completely biased against Mr Amaral.
He was sacked 'following a series of blunders'
He 'falsely accused the McCanns'
He wrote a 'widely discredited book'
discredited by who? I can think of two people particularly and most other people didn't get to read it in order for anyone to discredit it! It wasn't discredited by any one reviewing it and finding it wanting, it was discredited by the very libel action that has now been overturned!

Surely these three quotes breach reporting standards of fairness, and should be challenged?
They are unsubstantiated allegations, and they libel Goncalo Amaral. They also fly in the face of the judgement of the Portuguese Supreme Court... not to mention the conclusions of the PJ files. To which Press regulator should this be referred, please?
People need to be made to understand that unless their allegations against G. A. can be examined and substantiated in a court of law, which would necessarily involve the appearance on the witness stand (for the very first time!) of all parties involved, the British press must now desist from their sickening ten-year campaign of libel and slander against the one person who, had it not been for political interference from the very top, would have solved this case in 2007.

Judex, I don't know if it counts as libel, the 'bungled' bit and the 'discredited' could be seen as opinion I suppose but I'm certainly no expert. I wonder if the comments are there because they were in the story originally before it was updated with news of the recent ruling? Again I don't know if that has any bearing on it being considered libelous now.
If I was in Mr Amaral's position, I'm not sure I would have anymore appetite for legal cases. (Apart from a trial involving the guilty parties in this case) I would have had enough! Being now free to do so, I would just want to get a new book out that put the facts straight.

The anguished parents of Madeleine McCann today told of their fury at failing to silence a Portuguese police chief from 'spouting false smears' over their daughter's disappearance.
Kate and Gerry McCann said their eight-year libel battle with detective Goncalo Amaral, who claims Maddie died and they covered it up, had become deeply personal - and was not about money.
The 'devastated' couple could face financial ruin after losing their fight with Amaral, on the eve of their twins Sean and Amilie's 12th birthday.
But a close friend today insisted their legal fight wasn't about compensation, but to gag their 'tormentor-in-chief' whose theories they felt hampered the search to find her.
'It was never about winning big libel damages,' said the friend. 'It's always been more of a personal battle. They are bitterly disappointed they have lost but not totally surprised.
'It was all about them silencing him to stop him spouting untruths. The whole point of the libel action was to try and stop Mr Amaral spreading false accusations, which they felt hampered the search for Madeleine.
The friend went on: 'Any award would have gone into the Madeleine's Fund to help find their daughter and would never have been used for Kate and Gerry's own use.
'They are considering whether to appeal the decision and need to take advice from their Portuguese lawyer. But I think they just want to draw a line under it.'
The friend said the couple are now considering whether to appeal and will seek advice from their legal team in Portugal before deciding on their next move.
But the source added: 'To say they are upset and angry would be an understatement. But their main and only focus is to find Madeleine who has been missing for nearly 10 years. They will be able to concentrate on this totally now.'
In the bitter legal battle, the McCanns successfully sued Amaral for €500,000 damages, whom they branded 'a poisonous liar'.
But a higher court reversed the decision and judges in Lisbon have upheld the U-turn.
The payout would have been added to the official Find Maddie Fund set up through public donations and boosted by big-hearted celebrities to finance the worldwide hunt for the missing girl.
The Fund once stood at £1million but is now closer to £300,000 and could be wiped out by the Portugal's Supreme Court shock ruling.
A source close to the family said: 'This news is devastating, not just for Kate and Gerry but for Madeleine wherever she is.
'It's not good news. We just don't know what to do but we need to sit down with our lawyer and discuss it.
'We've gone to the pinnacle of the Portuguese legal system and we've lost. We now have to pay a sizeable amount in costs.'
As the Scotland Yard search for Madeleine – who disappeared as a three-year-old from a holiday apartment in the Algarve's Praia da Luz – is being wound down the McCann's had been keeping the soon-to-be-obliterated fund as a life-line to pay for their own ongoing search the moment the investigation, codenamed Operation Grange, ends.
Ex GP Kate and heart doctor Gerry, both 48, from Rothley, Leicestershire, live in hope that 'a miracle' will one day reunite them with their daughter. If still alive, she would turn 14 in mid May.
The appeal hearing in Lisbon which ruled against the McCanns was held in private.
A spokesperson from their lawyer's office said: 'This is a big disappointment and very bitter for us and for Mr and Mrs McCann.
'We know the libel decision has gone against us but we do not know the basis of the ruling and will not find out until Thursday.'

He has since made a fortune from his best-seller 'The Truth of the Lie' in which he claims Madeleine is dead and her parents 'staged a cover up'.
It has been translated into six languages and sold hundreds of thousands of copies worldwide.
It led to libel action from the distraught McCanns and action in a civil court, an appeal court and finally the Supreme Court.
Amaral is understood to have earned 400,000 euros (£344,000) from his book before it was banned and a subsequent TV documentary.
He claimed in the book Madeleine had died in their holiday flat and they had faked her abduction to cover up the tragedy.
The book was released just three days after Gerry and Kate McCann were told their status as arguidos or formal suspects had been lifted on July 21, 2008.
Amaral's lawyer claimed the McCanns had taken legal action 'to rid themselves of guilt for their negligent conduct' in leaving Madeleine and her siblings alone while they ate tapas with friends nearby.
He also claimed their lack of co-operation with the Portuguese police authorities had led to the archiving of the investigation in 2008.
The McCann's fiercely deny his allegations. In a 36-page writ, lodged nearly eight years ago, they describe him as a self obsessed, manipulative money-grabber and accuse him of libel and breaching their human rights.
In documents they describe in detail the pain and anguish he has caused the family by repeatedly smearing them, and say his slurs have left them 'totally destroyed' and most importantly had hindered the search for Madeleine.
Scotland Yard are busy investigating one 'last throw of the dice' lead in a bid to end the family's torment but time could be running out as police now have just two months left of guaranteed Government funding to continue to unravel an 'important' new tip.
Detectives on the Madeleine inquiry recently revealed they are working on a final theory that the youngster was kidnapped by a European trafficking gang.
The 'spotters' are believed to have targeted the blonde toddler taking photographs of her while she was playing on the beach and beside the pool at her holiday apartment.

So they finally admit it then, the case was not about money it was to 'gag their tormentor in chief'.
It's what many could see all along, if you keep fining someone enough they will have no way of paying it back and will have to shut up......didn't work did it, as many people donated to the person being 'gagged'.

RUTH Langsford has defended Kate McCann against claims she ‘shows no emotion’ about the disappearance of her daughter Madeline.
On today’s Loose Women, the panel discussed the McCann’s legal battle to silence Portuguese cop Goncalo Amaral’s book in which he claims that the couple covered up their daughter’s death.
Janet Street Porter compared Kate McCann to Lindy Chamberlain, whose daughter was snatched by a dingo in Australia
Ruth said: “You could never give up hope could you?
“Unless you’re presented with evidence that was conclusive to say sorry but your your daughter had died, you have to believe she is alive.”
Janet Street-Porter then compared the case to Azaria Chamberlain, the baby snatched by a dingo in 1980.
She explained that the tot’s mum Lindy had been to jail for killing her, although she was completely innocent.
Janet said: “Michael and Lindy Chamberlain were camping by Ayres Rock and a dingo took their baby and has never been found.

“Because Lindy had a rather forbidding presence and she didn’t smile alot and she looked quite stern, the public judged her as being a murderer and she went to jail until she was released.”
Ruth then compared her to Kate, citing people who often comment on the doctor’s lack of emotion.
She said: “People say, ‘she seems quite cold and she doesn’t cry’… people expect you to be weeping.”
Speaking about Maddie’s disappearance – which happened ten years ago in May – the panel agreed that they, like the rest of the UK had been totally fascinated by the case.

Lisa Riley revealed that she was so obsessed with the case that she travelled to the resort in Portugal where she was last seen and worked out how far the family’s holiday apartment was from the restaurant they dined in the fateful night that she went missing.
She admitted: “I didn’t want to judge her, so I got the book and I read it and I have to admit, chapter by chapter I kept changing my opinion of her.
“When I was in the Algarve I did actually go and I went to the holiday complex where they were.
“I kind of wanted to judge where the restaurant was myself and the actual distance to the apartment.
“I haven’t got kids… would I have done it? No I wouldn’t.
“It’s a long way, it is a long way. I personally couldn’t have done that.
“My problem is the amount of children that are going missing day by day in England – one every three minutes.
“Millions has been ploughed in to this one case – can we spread the money? Can we see some other cases?”
Ruth agreed: “It is staggering.”
The McCanns were left devastated on Tuesday morning after after Portuguese Supreme Court judges ruled against a lower court’s decision last April to reverse their 2015 libel win against the former cop.

Supreme Court judges met in Lisbon on Tuesday to resolve the couple’s fight against a lower court’s decision in April last year to reverse their 2015 libel win against the former detective – with the ruling handed down on the eve of their younger twin children’s 12th birthdays.
Although the hearing took place in private – and an official public decision is not set to be sent to lawyers acting for the litigants until later in the week – it emerged late in the afternoon that the case had gone against Gerry and Kate McCann.
It’s a blow to the couple who have committed thousands of pounds in the search for Maddie, and who hoped to force the former detective to pay more than £1million in compensation.

Panel discussed the grieving parents' latest legal setback

RUTH Langsford has defended Kate McCann against claims she ‘shows no emotion’ about the disappearance of her daughter Madeline.
On today’s Loose Women, the panel discussed the McCann’s legal battle to silence Portuguese cop Goncalo Amaral’s book in which he claims that the couple covered up their daughter’s death.
Janet Street Porter compared Kate McCann to Lindy Chamberlain, whose daughter was snatched by a dingo in Australia
Ruth said: “You could never give up hope could you?
“Unless you’re presented with evidence that was conclusive to say sorry but your your daughter had died, you have to believe she is alive.”
Janet Street-Porter then compared the case to Azaria Chamberlain, the baby snatched by a dingo in 1980.
She explained that the tot’s mum Lindy had been to jail for killing her, although she was completely innocent.
Janet said: “Michael and Lindy Chamberlain were camping by Ayres Rock and a dingo took their baby and has never been found.

“Because Lindy had a rather forbidding presence and she didn’t smile alot and she looked quite stern, the public judged her as being a murderer and she went to jail until she was released.”
Ruth then compared her to Kate, citing people who often comment on the doctor’s lack of emotion.
She said: “People say, ‘she seems quite cold and she doesn’t cry’… people expect you to be weeping.”
Speaking about Maddie’s disappearance – which happened ten years ago in May – the panel agreed that they, like the rest of the UK had been totally fascinated by the case.

Lisa Riley revealed that she was so obsessed with the case that she travelled to the resort in Portugal where she was last seen and worked out how far the family’s holiday apartment was from the restaurant they dined in the fateful night that she went missing.
She admitted: “I didn’t want to judge her, so I got the book and I read it and I have to admit, chapter by chapter I kept changing my opinion of her.
“When I was in the Algarve I did actually go and I went to the holiday complex where they were.
“I kind of wanted to judge where the restaurant was myself and the actual distance to the apartment.
“I haven’t got kids… would I have done it? No I wouldn’t.
“It’s a long way, it is a long way. I personally couldn’t have done that.
“My problem is the amount of children that are going missing day by day in England – one every three minutes.
“Millions has been ploughed in to this one case – can we spread the money? Can we see some other cases?”
Ruth agreed: “It is staggering.”
The McCanns were left devastated on Tuesday morning after after Portuguese Supreme Court judges ruled against a lower court’s decision last April to reverse their 2015 libel win against the former cop.

Supreme Court judges met in Lisbon on Tuesday to resolve the couple’s fight against a lower court’s decision in April last year to reverse their 2015 libel win against the former detective – with the ruling handed down on the eve of their younger twin children’s 12th birthdays.
Although the hearing took place in private – and an official public decision is not set to be sent to lawyers acting for the litigants until later in the week – it emerged late in the afternoon that the case had gone against Gerry and Kate McCann.
It’s a blow to the couple who have committed thousands of pounds in the search for Maddie, and who hoped to force the former detective to pay more than £1million in compensation.

The anguished parents of Madeleine McCann today told of their fury at failing to silence a Portuguese police chief from 'spouting false smears' over their daughter's disappearance.
Kate and Gerry McCann said their eight-year libel battle with detective Goncalo Amaral, who claims Maddie died and they covered it up, had become deeply personal - and was not about money.
The 'devastated' couple could face financial ruin after losing their fight with Amaral, on the eve of their twins Sean and Amilie's 12th birthday.
But a close friend today insisted their legal fight wasn't about compensation, but to gag their 'tormentor-in-chief' whose theories they felt hampered the search to find her.
'It was never about winning big libel damages,' said the friend. 'It's always been more of a personal battle. They are bitterly disappointed they have lost but not totally surprised.
'It was all about them silencing him to stop him spouting untruths. The whole point of the libel action was to try and stop Mr Amaral spreading false accusations, which they felt hampered the search for Madeleine.
The friend went on: 'Any award would have gone into the Madeleine's Fund to help find their daughter and would never have been used for Kate and Gerry's own use.
'They are considering whether to appeal the decision and need to take advice from their Portuguese lawyer. But I think they just want to draw a line under it.'
The friend said the couple are now considering whether to appeal and will seek advice from their legal team in Portugal before deciding on their next move.
But the source added: 'To say they are upset and angry would be an understatement. But their main and only focus is to find Madeleine who has been missing for nearly 10 years. They will be able to concentrate on this totally now.'
In the bitter legal battle, the McCanns successfully sued Amaral for €500,000 damages, whom they branded 'a poisonous liar'.
But a higher court reversed the decision and judges in Lisbon have upheld the U-turn.
The payout would have been added to the official Find Maddie Fund set up through public donations and boosted by big-hearted celebrities to finance the worldwide hunt for the missing girl.
The Fund once stood at £1million but is now closer to £300,000 and could be wiped out by the Portugal's Supreme Court shock ruling.
A source close to the family said: 'This news is devastating, not just for Kate and Gerry but for Madeleine wherever she is.
'It's not good news. We just don't know what to do but we need to sit down with our lawyer and discuss it.
'We've gone to the pinnacle of the Portuguese legal system and we've lost. We now have to pay a sizeable amount in costs.'
As the Scotland Yard search for Madeleine – who disappeared as a three-year-old from a holiday apartment in the Algarve's Praia da Luz – is being wound down the McCann's had been keeping the soon-to-be-obliterated fund as a life-line to pay for their own ongoing search the moment the investigation, codenamed Operation Grange, ends.
Ex GP Kate and heart doctor Gerry, both 48, from Rothley, Leicestershire, live in hope that 'a miracle' will one day reunite them with their daughter. If still alive, she would turn 14 in mid May.
The appeal hearing in Lisbon which ruled against the McCanns was held in private.
A spokesperson from their lawyer's office said: 'This is a big disappointment and very bitter for us and for Mr and Mrs McCann.
'We know the libel decision has gone against us but we do not know the basis of the ruling and will not find out until Thursday.'
Mr Amaral, 56, who the McCanns first sued for libel in June 2009, won the lengthy legal fight after judges decided he had the 'right to freedom of expression.'
Madeleine's parents could now lodge an appeal to the highest court in Europe, the European Court of Human Rights.
But a source close to the exasperated couple said: 'I think the fight is finally over. They want to concentrate on finding Madeleine and don't think they have the time or energy to lodge yet another appeal.'
Mr Amaral, who led the initial bungled search to help find their daughter, claimed in a once banned book that Madeleine was dead.
He was later sacked for criticising the British police handling of the case.
He has since made a fortune from his best-seller 'The Truth of the Lie' in which he claims Madeleine is dead and her parents 'staged a cover up'.
It has been translated into six languages and sold hundreds of thousands of copies worldwide.
It led to libel action from the distraught McCanns and action in a civil court, an appeal court and finally the Supreme Court.
Amaral is understood to have earned 400,000 euros (£344,000) from his book before it was banned and a subsequent TV documentary.
He claimed in the book Madeleine had died in their holiday flat and they had faked her abduction to cover up the tragedy.
The book was released just three days after Gerry and Kate McCann were told their status as arguidos or formal suspects had been lifted on July 21, 2008.
Amaral's lawyer claimed the McCanns had taken legal action 'to rid themselves of guilt for their negligent conduct' in leaving Madeleine and her siblings alone while they ate tapas with friends nearby.
He also claimed their lack of co-operation with the Portuguese police authorities had led to the archiving of the investigation in 2008.
The McCann's fiercely deny his allegations. In a 36-page writ, lodged nearly eight years ago, they describe him as a self obsessed, manipulative money-grabber and accuse him of libel and breaching their human rights.
In documents they describe in detail the pain and anguish he has caused the family by repeatedly smearing them, and say his slurs have left them 'totally destroyed' and most importantly had hindered the search for Madeleine.
Scotland Yard are busy investigating one 'last throw of the dice' lead in a bid to end the family's torment but time could be running out as police now have just two months left of guaranteed Government funding to continue to unravel an 'important' new tip.
Detectives on the Madeleine inquiry recently revealed they are working on a final theory that the youngster was kidnapped by a European trafficking gang.
The 'spotters' are believed to have targeted the blonde toddler taking photographs of her while she was playing on the beach and beside the pool at her holiday apartment.

The following is from the judgement from the first 'appeal' case the McCan'ts LOST in 2010.
"We conclude that the applicants voluntarily decided to limit their right to the intimacy of private life, certainly envisaging higher values like the discovery of their daughter Madeleine's whereabouts, but upon voluntarily limiting that right, they opened the doors for other people to give their opinion about the case, in synchrony with what they were saying, but also possibly in contradiction with their directions, yet always within the bounds of a legitimate and constitutionally consecrated right to opinion and freedom of expression of thought.
We do not see that the right of the book's author, the defendant, can be limited by a right to the reservation of intimacy that suffered voluntary limitations by their holders, the applicants.
In the same way, concerning the applicants' right to image and a good name: upon placing the case in the public square and giving it worldwide notoriety, the applicants opened all doors to all opinions, even those that are adversarial to them.
In any case, we understand that the allegation of facts that are profusely contained in the judicial inquiry and that were even published through an initiative of the Republic's Attorney General's Office, can in no way be seen as an offence against the right to image and a good name of the subjects in the process."

This is the culmination of a costly, difficult process that caused a lot of pain and distress, not only to the persons directly involved, but also to many who refused to be silenced, both on the internet and 'offline'.
Nonetheless, it also brought out the very best in so many people who have shown their support, both morally and materially, over so many years. It has been tremendously encouraging and heartening, and it must unequivocally be stated that without you, it would simply not have been possible to walk this road towards Justice.
We await the publication of the Court's decision and will update you soon with relevant information.
In the meantime, there are simply no words that even remotely match the strength and the tenacity that you have dedicated to this process.
So a mere "Thank you" will have to do.

IF it 'was NEVER about money'.... why did they want over £1million from GA then?
Why not 'sue' GA for 10p and 'apology'?
Will 'Dirty Des' now 'print' all the 'discrepancies and contradictions' in sworn statements, to UK police officers and PJ, from the T9, contained in the publicly available, officially in the public domain, Portuguese 'files'?

Will 'Dirty Des' now 'print' all the 'discrepancies and contradictions' in sworn statements, to UK police officers and PJ, from the T9, contained in the publicly available, officially in the public domain, Portuguese 'files'?

In a case of “second time proved right” former PJ coordinator Gonçalo Amaral has seen a national court take his side in the long-running civil action taken out by the parents of Madeleine McCann.
The Supreme Court convened on Tuesday to consider the case. SIC television was the first media source to report that judges decided to dismiss it.
This means that Supreme Court judges do not consider there are grounds to appeal against the decision given in April last year by Lisbon’s Appellate Court which ruled that Amaral was well within his rights of freedom of expression when he wrote the book: “Madeleine: The Truth of the Lie” ([You must be registered and logged in to see this link.]).
SIC’s report says the McCanns have now “lost the case against Gonçalo Amaral” as “there are now no further opportunities to reverse the decision” of the Appellate Court.
Whether this is in fact the truth, remains to be seen. The McCanns lawyer Isabel Duarte has intimated to British press that the couple could take the case to the European Court of Human Rights if they lost in Portugal.
The Supreme Court's full judgement will be published later this week, and is expected to award all costs against the McCanns.
British tabloid journalists on their way to Portugal for the reading of the decision have told the Resident that this will be "devastating" for the couple who initiated the case against Amaral almost a decade ago. At the time, damages sought for the thesis that Madeleine had died in a tragic accident which her parents had subsequently concealed were set at over €1 million.
For now, Amaral is keeping the silence he has always said was so necessary for justice to be allowed to work. The Projecto Justiça Gonçalo Amaral website, which has kept supporters up to date with his battle for vindication has posted two announcements since the breaking news on Tuesday.
The first said simply "Justice has prevailed", the second: "Thank you".
"This is the culmination of a costly, difficult process that caused a lot of pain and distress, not only to the persons directly involved, but also to many who refused to be silenced, both on the internet and 'offline', said the second post, published on Wednesday.
"Nonetheless, it also brought out the very best in so many people who have shown their support, both morally and materially, over so many years. It has been tremendously encouraging and heartening, and it must unequivocally be stated that without you, it would simply not have been possible to walk this road towards Justice.
"We await the publication of the Court's decision and will update you soon with relevant information.
"In the meantime, there are simply no words that even remotely match the strength and the tenacity that you have dedicated to this process.
"So a mere "Thank you" will have to do".

You think you've heard it all over the years and nothing more could be written that could surprise - but this Tracey Kandohla surpasses all else. This woman is a downright liability, her technique is not even helpful to her friend's cause. It's apparent to me that she works in league with Clarence 'spin-doctor' Mitchell - he who can't speak of the McCanns without constant reference to the royal 'we'. If any evidence is required to prove he is behind so many of the 'source close to the McCanns', it is the royal 'we'.
By example this Daily Mail twaddle [snipped]..
A source close to the family said: 'This news is devastating, not just for Kate and Gerry but for Madeleine wherever she is.
'It's not good news. We just don't know what to do but we need to sit down with our lawyer and discuss it.
'We've gone to the pinnacle of the Portuguese legal system and we've lost. We now have to pay a sizeable amount in costs.'

A classic case of the 'we myself I' syndrome. Clearly someone/s is still dishing out the dosh. Somehow, despite Tracey's touching words, I don't think this Supreme Court decision is going to bankrupt chez Rothley. Which is more than you can say for Goncalo Amaral's position after the McCann teams vindictive litigation.
Still, if the worse comes to the worse - they've got a tidy little sum 'floating' about in and out of the Limited Company to cover for emergency expenses.
