Great day for Snr Amaral, well done sir, may the rest of your life be a long and happy one. In a world where governments and authorities are full of corruption you stand tall as a man of principals.

Re: McCann's v Amaral Appeal
At last a result after years and years of battling. I'm a bit speechless that this day has finally arrived and it's a positive result for Goncalo Amaral, who throughout this ordeal has endured the worst form of intimidation from a PR machine that feeds the UK Press.
It's not a result for Madeleine but perhaps it's the beginning of something great.
God Bless all the good people who are involved in this case. Today was a good day.

Re: McCann's v Amaral Appeal
Well done Gonçalo, and well done the Portuguese judiciary. What a relief this vindication of an honest man must be.
Most of the British media are reporting the result with a pro-McCann slant. With, strangely enough, the exception of the Sun, which asks and then answers the question "(W)hat are the claims in Goncalo Amaral's book?", even if they answer with a single sentence:
"In the book, it is claimed that Maddie had died in their holiday flat and her parents faked her abduction to cover up the tragedy."
So it is not libellous to say about them that all their performance about leaving no stone unturned, for 10 years, has been a LIE, and that their soliciting of donations has been a FRAUD.
I hope someone who donated to the Fund in good faith sues it for the return of their money. That money could have been donated to efforts to find children who really have disappeared. Some parents have REALLY suffered what the McCanns have lyingly pretended to have suffered, persuading a large number of decent people to part with their money in the process. The court has confirmed that it is not libellous to say this now.

I haven't finished reading this blog but here is a snippet from the first paragraph
"On return from Portugal, after being made suspects, arguidos, they hired a PR spokesman, Clarence Mitchell."
Good grief, if you can't get the fact that Clarence Mitchell arrived well before arguido status then what the bloody hell are you saying with any (if any) accuracy on a blog?
I despair.

This pic was not taken today outside the court today.

It was just a meeting between 3 judges reviewing paperwork.

I remind you that they “demanded” the archiving of the process, in 2008, when they were arguidos, merely to defend their image. They are not interested in the reopening of the process or of the investigation, where all hypotheses remain open, from a voluntary disappearance up to homicide, like the Public Ministry mentions in the archiving dispatch. They are only interested in the defence of their image."

Madeleine McCann's parents, Kate and Gerry, HAVE NEVER REQUESTED the re-opening of the investigation into their daughter's disappearance.
Neither the McCanns nor their lawyers have asked for the re-opening of the case, was confirmed by the office of the Chief Prosecutor of the Republic, putting an end to speculation.
Despite its being three years since the little British girl was reported missing, her parents have at NO TIME taken the necessary steps for the Portuguese authorities - those who hold jurisdiction - to carry on with the case
10 May 2011
"To ask for the process to be reopened, all it would take is a letter to the Prosecutor, as it has already happened in so many other cases. It costs them nothing, just the stamp on the letter."
(The case had been archived and they could have asked to have it kept open, but didn't!")

Re: McCann's v Amaral Appeal
Well the court has said it's not libellous to express the opinion that they faked the abduction. And if they faked the abduction, then they're lying when they say otherwise and they are committing fraud when they solicit donations on that basis.aquila wrote:Whoa there, no court has said that...Do you really think someone who donated a bit of their pension or their pocket money would sue?haroldd2 wrote:Well done Gonçalo, and well done the Portuguese judiciary. Yes, I do think someone who has donated might sue. Why not? Power to their elbow if they do. Many believed the McCanns and sympathised with them for decent, human, wholly honourable reasons, and as their reputation falls I think some donors - thousands of donors - will get annoyed.

I should be very interested to learn where you get this information from - were you in the court rooms?haroldd2 wrote:

The court has confirmed that it is not libellous to say this now.
From my understanding this particular stage of the court proceedings, or the former hearings as I recall, have never been about libel per se since their initial acrimony. The issue here is Mr Amaral's right to express his opinion, the very fact that his opinion was in accord with the official Portuguese investigation made the McCanns position untenable. In the absence of any solid claim against Mr Amaral in the first instance, the McCanns and their legal representation have been struggling to maintain the impetus of their malice against the case coordinator through the law courts. Thus, their case has gradually evolved and at the same time weakened - ending in today's decision by the Supreme Court.
Beware of what you say. Rejoice in the knowledge that today Goncalo Amaral has been vindicated and can now start to re-build his life - leave the rest to time.

Of all the ways in which I could have guessed the Mccanns would try to defect away from Amaral's victory, I confess I never would have guessed this!
Such desperation to promote an innocent image, she's hiding herself behind genuine parents in a bid to melt in among the crowd. I really hope nothing comes of this. I'm surprised that the BBC still hasn't covered the story, but anyway warmest congratulations Sr Amaral

Re: McCann's v Amaral Appeal
I have looked and looked, and searched again and again, but the main BBC News website appears to have carried NOTHING about Amaral's historic victory in the Portuguese Supreme Court.
Not only do we have fake news on the mainstream media news but there is also important news we are not told about, in oher words, we get selective news.
There was a tiny mention of the result on BBC Radio 4's news bulletins this morning.

Re: McCann's v Amaral Appeal
It’s always been the same with the BBC. It’s not so much about what the BBC says; it’s about what it DOESN’T say. You can guarantee, if it had been about Sharon Matthews, it would be shoved in our faces every minute of the day. Moreover, at the moment, the BBC is tearing Donald Trump to pieces, and showing all the protests that are apparently going on throughout the UK. Strange how the LEFT gets so much exposure, isn’t it?Tony Bennett wrote:I have looked and looked, and searched again and again, but the main BBC News website appears to have carried NOTHING about Amaral's historic victory in the Portuguese Supreme Court.

Re: McCann's v Amaral Appeal
Is it at all possible that they can take this to the ECHR? I truly hope this is the end of it. From what I've read it seems like you can't apply to the European Court to overturn a decision already made by a member state, unless that decision didn't abide by EU law. But I might have misunderstood that. Regardless, I hope Brexit will make the European Court very very unsympathetic to them, being over litigious Brits!

Re: McCann's v Amaral Appeal
The European Court of Human Rights is part of the Council of Europe, a distinct body from the European Union.
The ECtHR entertains claims that rights enshrined by the European Convention on Human Rights have been breached: things like the right to life, right to a fair hearing, freedom of expression, that sort of thing.
Of note for such a claim must be Article 17, which provides that no one may use the rights guaranteed by the Convention to seek the abolition or limitation of rights guaranteed in the Convention, an allegation Gonçalo Amaral will surely consider against Kate and Bro. Gerry McCann?

I noticed that the story was the main news item on Yahoo news for a while last night. I also noticed that most of the comments were very critical of the McCanns, but they were getting deleted almost as soon as they appeared. Fascinating. I've never seen that before. I've seen really nasty, even potentially libellous comments about all kinds of public figures and they've been allowed to stay for hours - but if you criticise the McCanns, it's removed straight away.
