DV  I hope to be with Terry Lubbock, father of Stuart Lubbock, at the Attorney-General's Office, 5-8 The Sanctuary, Westminster SW1P 3JS  this coming Tuesday (27th June) to hand in Terry's formal application to Jeremy Wright, Q.C., M.P., the current Attorney-General , for a fresh Inquest into the killing of Stuart at Michael Barrymore's home on 31 March 2001. 

Below is an Executive Summary of the reasons why, in the public interest, a new Inquest must be held.

A reminder that the original Inquest, conducted by Mrs Caroline Beasley-Murray, the Essex Coroner, reached an astonishing 'Open' verdict, despite overwhelming evidence that Stuart was killed as the result of a violent sexual assault by one or more persons at Michael Barrymore's party that night. No-one has yet been prosecuted in respect of this murder.   

I would like to thank Laura Hunter of the Attorney-General's Media Office for making special arrangements for Terry to hand in his request personally, probably around 12noon.  

Below are details I've put on Twitter this afternoon and will include in a media release later today.

Why Terry Lubbock is seeking a fresh Inquest into the death of Stuart Lubbock – Summary

Below is an Executive Summary of the reasons why Terry Lubbock will, this Tuesday, 27 June 2017, at 12noon approx., be attending the Attorney-General’s office, London, to seek permission from the Attorney-General to apply to the High Court for a fresh Inquest into the killing of his son Stuart Lubbock.

The original Inquest was defective in serious ways. The ‘Open’ verdict was contrary to overwhelming evidence that Stuart was killed by a violent sexual assault, and that those responsible covered up his death. At the start of the inquest, the Coroner’s Officer, P.C. Jones, made a false factual statement when he informed the inquest that, quote, “Stuart Lubbock was found in the pool at the premises”. What he should have said was that: “A number of witnesses claimed that he had been in the swimming pool that night”.  A proper assessment of the evidence tends to suggest that Stuart Lubbock was never in the swimming pool that night. Essex Police failed to analyse all the evidence in the case properly and consequently misinformed the Lady Coroner and the inquest.

Due to errors by both the police and the Lady Coroner, the four pathologists who gave opinions on the case were not told of the wholly contradictory and fabricated evidence of the witnesses who claimed that Stuart was in the swimming pool. As a result, and as explained in detail in this submission, they were not made aware of the probability that Stuart Lubbock was never in the swimming pool that night. Consequently, all their findings are flawed.  The Lady Coroner so arranged the inquest that the pathologists’ evidence first BEFORE there was a proper opportunity to test the contradictory evidence about how Stuart was found.

Since the inquest, the Criminal Injuries Compensation Authority REVERSED their previous decision not to award Terry Lubbock and his wife Criminal Injuries Compensation. In 2007, in response to my dossier of evidence they held that Stuart Lubbock WAS, on the balance pf probability, killed by a crime of violence. They then paid the maximum CICA payment possible to Terry Lubbock and his wife.

Since the inquest, Michael Parker [Barrymore], Jonathan Kenney and Justin Merritt have all been arrested (June 2007) and investigated on suspicion of murdering Stuart.   

Since the inquest, an Independent Police Complaints Commission, after receiving a dossier from me, published a report finding Essex Police guilty of misconduct, particularly over the exceptionally lax supervision of the crime scene, which included allowing Michael Barrymore’s Manager, Mike Brown, to record the evidentially all-important, indeed crucial, pool temperature.     

Since the inquest, new evidence has emerged about the events of the night Stuart Lubbock was killed, during the recent High Court trial of Michael Barryrmore’s civil claim against Essex Police.

A Stuart was never in the swimming pool that night
B He was killed by a violent sexual assault, probably between 4.30am and 5.00am that night
C Those who killed him decided to create a fake ‘drowning scenario’
D They contacted Michael Barrymore’s Manager at around 5am who, according to an informant, advised the killers: “Clean everything up and I’ll be right over”
E Immediately before Justin Merritt contacted the Ambulance Service at 5.46am, the killers of Stuart laid out his body in a pair of shorts at the poolside, and poured quantities of water over his dead body to fake a drowning.    

The Attorney-General (and the High Court of the Attorney-General gives permission) should consider whether a jury should be empanelled for any fresh inquest in view of the misconduct findings against Essex Police, which could be taken to suggest that the killers were helped by the police to minimise (a) the possibility of any of Stuart’s killers being prosecuted for killing him and (b) the possibility of a homicide verdict at the inquest.

Terry Lubbock claims new evidence has come forward after Mr Barrymore began a High Court bid to sue Essex Police for £2.4million for wrongful arrest in connection with the death of butcher Stuart Lubbock, 31, amid claims it destroyed his highly-paid TV career.
 
Mr Lubbock, who was heterosexual, died at the former Strike it Lucky star's home in Roydon, Essex, in 2001.
 
He had met Mr Barrymore, 65, that night at a bar in Harlow and gone back there afterwards
 
An inquest held in 2002 reached an open verdict over the suspicious death, which is still treated by police as an unsolved murder.
 
Mr Lubbock senior will hand a dossier to Attorney General Jeremy Wright QC next week seeking permission to apply to the High Court for a second inquest.
 
In a statement, former solicitor Anthony Bennett who represents Mr Lubbock, said: "The request is based on new evidence.
 
"The original Inquest was defective in serious ways. The ‘open’ verdict was contrary to overwhelming evidence that Stuart was killed by a violent sexual assault, and that those responsible covered up his death."
 
Mr Bennett said in a summary of the reasons for the request: "Since the inquest, new evidence has emerged about the events of the night Stuart Lubbock was killed, during the recent High Court trial of Michael Barrymore’s civil claim against Essex Police."
 
Other grounds being used are:
 
*Claims Mr Lubbock may never have been in the swimming pool, put pathologists were told he definitely was
 
*The Criminal Injuries Compensation Authority has since the inquest paid Mr Lubbock and his wife the maximum compensation it can, meaning it ruled he died from a violent act
 
*Since the inquest, Mr Barrymore, Jonathan Kenney and Justin Merritt, who were both also present on the night, were arrested and investigated on suspicion of murder, although no charges were brought
 
*An Independent Police Complaints Commission (IPCC) probe which reported after the inquest found a string of failings in Essex Police's handling of the investigation

Essex Police has accepted that there was a wrongful arrest, but only on a technical matter, in that the wrong police officer was sent.

It has offered a nominal compensation of £1, amid claims there were several grounds to arrest Mr Barrymore on suspicion of the rape and murder of Stuart Lubbock.

The High Court was told last month Essex Police received intelligence that the former game show host, who appeared on Celebrity Big Brother in 2006, paid off two witnesses not to give evidence against him over Mr Lubbock's death.

John Beggs QC, representing Essex Police, said: "There was potentially a very serious crime, the most serious of crimes in this case, namely murder, and we say it was reasonable to suspect it was preceded by another serious crime, namely rape.

"You don't need to know there was a murder, you have to suspect there was a murder. If you have a dead body of a healthy person, that is a reason to suspect murder."

I maintain this was a fake 'drowning'. Stuart was raped and murdered inside Barrymore's mansion, then cleaned up, his body dressed in a pair of swimming shorts, then laid out by the side of the pool, and quantities of pool water thrown over him just before the ambulance was called. He was never in the pool. A murder and a hoax that the perpetrators have got away with for 16 years, 2 months and 24 days - T.B.
