McCanns face five-year wait in libel trial


KATE and Gerry McCann’s battle to sue a disgraced ex-police chief for £1million in libel damages could drag on for another five years, a pal revealed yesterday.

News of the setback came after the parents of missing Madeleine gave evidence against Goncalo Amaral in a Lisbon court.

Kate told the trial how smears by their tormentor left her family “devastated, fearful and desperate”.

But Mr Amaral, who led the bungled hunt for Maddie, now claims he is broke.

A judge is set to call him back to court in September to order him and the publishers of his 2008 book The Truth Of The Lie to ­reveal how much was made from the best-seller and a 2009 TV documentary.

A source close to Kate and Gerry said: “They are ­exasperated by this. Civil proceedings against Mr Amaral have already been going on for five years and at this rate are likely to go on for another five years.

He is pleading poverty and there will be further hearings held for him to disclose his bank statements.”

Even if Kate, 46, and Gerry, 45, of Rothley, Leics, win the case, they will probably not see any money until 2018 or 2019.

Their lawyer Isabel ­Duarte said: “It has been proved in the civil file that Mr Amaral earned around 380,000 euros in one year from the book.”

Bound to say I did a 'double take' at the comment "He is pleading poverty".

The McCanns have:

1. Frozen his assets

2. Cut off his main source of income after 2008 by successfully banning his book, at least for a period

3. Embarked on costly libel proceedings which have forced him to use what little money he has to defend himself

4. Supported criminal proceedings brought by the murderess-of-her-own-child Leonor Cipriano by appointing (via Brian Kennedy and Metodo 3) the lying lawyer Marcos Aragao Correia

5. Probably triggered his divorce, causing him further expense, never mind the anguish.

Dr Kate McCann once said: "I want him to feel fear".

She and her husband have succeeded in making him experience poverty - and are now blaming him for 'pleading poverty'.

I am searching for the right word to describe this conduct

They were photographed and the photo handed to a press agency, who released it on 8 May, as the search for Madeleine continued. The McCanns held up these same pyjamas at two press conferences on 5 & 7June 2007. How could Madeleine have been abducted?"

I didn't hear that.

Another thing, when Kate told the judge she thinks Sean heard it on the bus why didn't the judge ask her to clarify?

There are a number of words that could be used, including avarice and greed but as for a more fitting word I don't know.

Going back to the article, I find it very telling of the main objectives of this trial against Snr Amaral

"Even if Kate, 46, and Gerry, 45, of Rothley, Leics, win the case, they will probably not see any money until 2018 or 2019"

If they did win, would it really matter that there were no funds available?  After all, this is all about clearing their names and getting the search for Madeleine back on track, isn't it? 

Why is there so little reference to the search, this article makes it sound like a get rich quick scheme. Surely not?

What could possibly be behind this bizarre article?  Surely Dr Amaral's entire assets are all seized and waiting for them pending their glorious victory in the libel court.  What could delay the handover?

Do they think they are going to lose and are trying to explain to their fans why they haven't received their prize - it is all Amaral's fault?

I think it's more about managing expectations. Even if the Judge finds in their favour, there is no way they are going to get £1.2 million or anything like it. They will say that Amaral somehow managed to hide his ill-gotten gains and convinced the Judge he didn't have any money, and that is why she only awarded them 20p. How unfair and doesn't it prove what a wicked man he is, etc. etc. ad infinitum...

It's not just your opinion, sadly! Whatever happens, it will be turned against the Portuguese somehow - it always is. Either the court system will be at fault (if they lose) or the Judge will be at fault (if they don't get enough money) or Amaral will be at fault (because everything is always his fault).   Even when they stayed silent about their tappas friends refusing to go back for a re-con ?   no-one challenged them ?  

 When Kate Mccann claimed she KNEW her child had been abducted but couldn't say why at the time because of the judiciary secret act -  as far as I'm aware, no-one has SINCE challenged her to give her reason for stating that ? 

 They have gone unchallenged for the last 7 years - I have never known a case whereby the last people to see a missing child has had their word accepted without challenge .......all my opinion only.

Eta, I forgot to mention they now say it's " Our hypothesis "

Would just like to ask if there is a poster who knows the legal system and could say whether the Mccann's lawyers Carter Ruck can stop others from stating what they they think happened to Madeleine Mccann now that her own mother has stated in court that the abduction is " Our hypothesis "   ?

The article alleges that The family have been left devastated fearful and desperate. Desperate for money maybe but the picture the Daily Star has used doesn't exactly back up those claims. More like another fine example of Duper's Delight there.

If they did win, would it really matter that there were no funds available?  After all, this is all about clearing their names and getting the search for Madeleine back on track, isn't it? 

Why is there so little reference to the search, this article makes it sound like a get rich quick scheme. Surely not?

It's interesting how the media make very little mention of the fact the TV company are being sued too. It's all about Amaral and his money, conveniently sidestepping the other party. IMO it is a grave mistake on behalf of Team McCann as they are looking ever more greedy and vindictive.

I have no doubt that the Mccanns would wriggle out of the Judge finding in favour of Amaral - they'd pin it down to yet another instance of how unjust and incompetent these sardine munching Portugese are. That said, it would not be easy especially with SY talking about Maddie's body.

If Amaral loses then he will fight on as best as his health and wealth (or rather lack thereof) and he would become, to some extent, a greater martyr than he already is and history is replete with tragic martyrs and the danger they can pose "establishment".

However, the best case scenario for them is simply to have this drag on indefinitely. They can then harp on about the crazy system, childcare, Amaral's sardine budget for years and years.

As the libel is not about the truth of Goncalo's book, but the damage to the McCanns' reputation, I wonder if this case will be in the bizarre situation five years down the line, where Gerry and Kate in their respective prisons, will be awarded financial compensation?

I think the McCanns lost the exclusive right to claim 'abduction' during their legal proceedings against Tony.  When their lawyer was asked what proof there was of abduction, she only had the word of the McCanns.

It seems to me that the word 'abduction' has been dropped from the narrative, even the MSM seem reluctant to use it now.
