Finn - I agree with you about feeling so low over the last couple of days. Goodness only knows how Tony must feel.
Chatelaine - I'm Tony's age and sadly think of Gerry and the Pacemakers version! Saw Lesley Garrett singing it in Carousel a couple of years ago - and sobbed in the stalls. Great stuff.
JackieL - can only think the fawning, bowing and scraping by 'celebs' is because they haven't much knowledge of the case. Most are so shallow and only believe the pinkpr spin in the press and doubt if any have read the bewk. They just think it's parents with a tragic loss. Which it is and more.
Hope Tony can recharge and not read the bile written by morons.

With regard to the obsequious performances given by 'celebs', well, I comfort myself that when the truth is finally revealed, they will suffer the deepest humiliation and feelings of shame at having been so publically hoodwinked on national television.

I will ask a question and hopefully someone with a legal mind can help. Could Tony Bennett appeal against the courts decision, or is it binding?

I'm no legal eagle, but I'd say: No. He cannot appeal. But he can try and have his undertakings lifted or changed IMO. I also have the feeling that the judge might be open to that. After all, he sentenced Tony on only 13 breaches out of the hundreds, which the claimants brought forward ... Also many other phrasings in his sentence [I've posted them elsewhere here a couple of days ago] clearly indicate IMO that he has serious doubts about the veracity of the McCs.

The Contempt of Courts Act, 1971
19. Appeals -
(1) An appeal shall lie as of right from any order to decision of High Court in the exercise of its jurisdiction to punish for contempt-
(a) Where the order or decision is that of a single judge, to a Bench of not less than two Judges of the Court.
(b) Where the order or decision is that of a Bench, to the Supreme Court.
Provided that where the order or decision is that of the Court of the Judicial Commissioner in any Union territory, such appeal shall lie to the Supreme Court.
(2) Pending any appeal. The appellate court may order that-
(a) The execution of the punishment or order appealed against be suspended
(b) If the appellant is in confinement, he be released on bail, and
(c) The appeal be heard notwithstanding that the appellant has not purged his contempt.
(3) Where any person aggrieved by any order against which an appeal may be filed satisfied the High Court that he intends to prefer an appeal, the High Court may also exercise all or any of the powers conferred by sub section (2).
(4) An appeal under sub section (1) shall be filed-
(a) In the case of an appeal to a Bench of the High Court, within thirty days.
(b) In the case of an appeal to the Supreme Court, within sixty days, from the date of the order appealed against.
COMMENTS
(a) When thee High Court acquits the contemner, no appeal lies; Subhash Chandra v.B.R. Kakkar, (1992) 2 Punj Lr 46 (P & H).
(ii) If the order of committal for contempt of court is made -
(b) By a single Judge of the High Court, an appeal lies to a Division Bench thereof; or
(c) By a Division Bench of the High Court, an appeal lies to the Supreme Court, As of a statutory right; Mohammad Idris v.R.J. Babuji, (1984) 2 Crimes 880 (SC).
(iii) It is not each and every order passed during the contempt proceedings that is appealable; S.P. Wahi v.Surendra Singh, 1983 Cr LJ 1426.
(iv) An Appeal does not automatically operate as a stay of the order appealed against; Hans Raj v.State of Himachal Pradesh, 1985 Cr LJ 1030.

Costs money to appeal I imagine.
Has Tony looked at contacting Liberty. He has human rights and a link was posted today to a case very similar to TBs, i.e. ECHR ruled that two people should have received legal aid and not had to represent themselves. Sorry can't remember what thread it was on.
Liberty are very good fighters for breaches of human rights. Might be worth a try.
I cannot get over the unfairness of Tony's plight.

Does that first sentence mean a judge has to direct that an appeal can be made, or does Tony Bennett have to appeal himself?

It must have looked good on the young couple's CVs that they defeated McDonalds.

I think this was the 11th hour turnabout in what they hoped would happen, wanting to appear compassionate for PR reasons. They must think the public who heard that are stupid, as it is only the court which could have decided TB's fate.

I think it's jolly nice of them 'letting the court decide' - a really generous gesture not only to Tony but the Judge as well, Judge must have been over the moon that the McCanns are letting him - o yes, do his job?
I hope his Lordship is duly grateful - years of study and experience rewarded by this trust in his abilities.
Every time I think I've heard it all, TM comes out of left field with another one. I'll have to spell it out: Once you take a case to court, it is out of your hands to decide on the outcome, that is the basic principle of the due course of law.
Honest, ask one of your lawyers, they should know.

Chatelaine - thanks very much for that video. Football is emotional (armchair Villa supporter so I should know) especially that song.
Off topic but watching that - sorry for delay in responding, had to find earphones as OH rolls eyes if I'm on forums - got me thinking about the other footie club in Liverpool. Everton have treated the docs on various occasions in the 'royal box' and a few years ago were quite rude to people who have informed them of many true stories about their honoured guests.
It also reminds me of that dreadful murder involving an Everton fan: Rhys Jones the 11 year old boy who was shot in 2007. At the time whenever his parents were on the news I wept for their pain. Their sadness and devastation was plain to see. So so sad, those poor parents and Rhys' brother were absolutely gutted. They never wanted the limelight and because their lad was in the wrong place at the wrong time they were thrust into the media.
Whatever decision Tony makes about carrying on I hope he knows that there are many people on his side and when the time is right we can help in some small way.

With you all they way Tony, although the court outcome was to partially be expected I still have a good feeling for you.
