Entertainer Michael Barrymore wants £2.5million in damages after suing police who arrested him following the discovery of a body in his swimming pool - but senior officers say he should get just £1.

Barrymore, 64, took legal action against Essex Police as a result of being held and questioned following the incident. He was never charged.
A judge is expected to make decisions after a High Court trial in London scheduled to be staged during the summer of 2017.
Detail of what Barrymore wants and what police say he should get emerged at a preliminary court hearing in London today.
Lawyers representing Barrymore and Essex Police gave a judge an outline of rival claims at Wednesday's hearing.

Terry, 71, who is in poor health and lives in a care home funded with his £235 a week pension, said: “I’ve never had any money over the death of my son and Barrymore shouldn’t be getting anything.

Barrymore, 64, faces financial ruin if the judgment goes against him because it is likely he will be forced to pay costs estimated at more than £1million.
At the preliminary High Court hearing the judge Master Roger Eastman said the ruling “could substantially restrict damages from two-and-a-half million down to nominal damages”.
Referring to Barrymore by his birth name Michael Parker, Master Eastman confirmed the star is set to give evidence.
Barrymore’s case is supported by four other witnesses while Essex police have 17 lined up for the five-day hearing.

leading barristers.
Court papers reveal police admit that, due to a technicality, the officer who collared Barrymore should not have done so.
Documents show the detective supposed to make the arrest did not arrive in time.

Instead, a PC on surveillance duties was ordered to hold Barrymore.
Police admit this means they were in the wrong but they still argue there were reasonable grounds to suspect him because of Stuart’s injuries and the comedian’s behaviour

John Beggs QC, for Essex police, states in an amended defence filed at the High Court in October: “There was an abundance of evidence of the commission of serious criminal offences against Mr Lubbock and the claimant was the prime suspect.”
Terry, who has campaigned for years for justice for his son Stuart, said he hoped the trial might finally help to reveal what happened to the factory supervisor.

...still insists that Stuart Lubbock's body 'was found floating in Michael Barrymore's swimming pool'.
It wasn't, as I believe I fully demonstrated in my book* on the case: "NOT AWIGHT: Getting Away With Murder" (2007).
Stuart's father and I are now close to making an application to the Senior Coroner for Essex for a second inquest - the first inquest reached an 'open' verdict despite overwhelming evidence that Stuart died from a horrendous serious sexual attack perpetrated by two or three homosexuals.

[EDITED TO ADD] I spoke to Terry Lubbock tonight. Over the weekend, Terry contemplated attending the trial of Michael Barrymore vs Essex Police. A carer (he now lives in a care home in Harlow) was going to take him to the High Court but the arrangement fell through at the last minute. Terry was determined to attend, however, and hired a taxi to take him to Court 13 at the High Court (cost: £70 each way).
He has told me that on seeing him, Barrymore was all 'pally pally' with him, as he has tried to be in the past. 'Hallo Terry how are you?' etc. etc. Terry told me: "I was having none of it though". According to Terry, Barrymore's barrister was on his feet most of the day arguing that there was no proof that Stuart Lubbock was injured at Michale Barrymore's premises. Details of the injuries were read out in court. Terry was upset. The Essex Police barrister did not have much to say today.
Essex Police admit to a technical breach of police regulations in that, because it was necessary to arrest three people simultaneously, Barrymore's arrest was effected by an officer one rank below that which is supposed to be used in cases of arrest for suspected murder. For this technical breach, Essex Police have offered him £1 in compensation.
Barrymore is claiming £250,000 damages for 'wrongful arrest'.
The trial is due to last 5 days.
Terry said he won't be attending the rest of the trial. He says he just wanted Michael Barrymore and those supporting him to know that he is still around, determined to seek justice, and will never give up.

The hearing, which begins at London's High Court on Monday, is a result of Barrymore being arrested and questioned after a man's body was discovered in a swimming pool at his home in Roydon.
He claims that his arrest and detention on suspicion of rape and murder, which received widespread publicity, had a devastating effect on his career and earnings.

Last year, his counsel Lorna Skinner said that it had never been established that Mr Lubbock was either raped or murdered.
She told a judge that Essex Police were arguing that Barrymore should receive "nominal" damages.
It has been reported that he is seeking £2.5 million damages.

Michael Barrymore paid off two witnesses not to give evidence against him after the death of a man found in his swimming pool, a court heard.
The 65-year-old entertainer is suing Essex Police for £2.5 million over his arrest on suspicion of the rape and murder of Stuart Lubbock who was found dead at his mansion in 2001.
But the force, which has accepted liability on a technicality, claims that the former Strike It Lucky host should only receive nominal damages of £1.
Police had "reasonable grounds" to arrest Mr Barrymore in connection with Mr Lubbock's death, the High Court was told on Thursday.
An extract from a police intelligence report read to the hearing by a barrister representing the force alleged that: "Two people had been paid off by Michael Barrymore to not give evidence against him."
Mr Barrymore, Jonathan Kenney and Justin Merritt were all present when Mr Lubbock died at the TV star's home in Roydon, Essex.
Post-mortem tests found Mr Lubbock had suffered severe internal injuries and toxicology revealed ecstasy, cocaine and alcohol in his bloodstream.
Essex and Thurrock Coroner Caroline Beasley-Murray recorded an open verdict into the 31-year-old butcher's death at an inquest in 2002.
Mr Barrymore – along with Mr Kenney and Mr Merritt – was later held on suspicion of rape and murder in 2007. None of them were charged.
Essex Police has accepted liability and that the arrest was unlawful. But the force claims their liability was on a technicality as they sent the wrong officer to make the arrest.
The force claims officers did have "reasonable grounds" to suspect Mr Barrymore of murder and rape, and to believe the arrest was necessary for an effective investigation.
They argue he should only be entitled to a nominal damages of just £1.
Today, the High Court heard the closing submission of John Beggs QC, representing Essex Police.
He said: "There was potentially a very serious crime, the most serious of crimes in this case, namely murder, and we say it was reasonable to suspect it was preceded by another serious crime, namely rape."
He added: "You don't need to know there was a murder, you have to suspect there was a murder. If you have a dead body of a healthy person, that is a reason to suspect murder."
He told the court that there still was not explanation as to what happened Mr Lubbock.
Mr Beggs QC said: "With this claimant, he has never given a cogent explanation as how a young man was so seriously injured in a confined space with so few people present."
The Essex Police representative said police had to act when new witnesses came forward offering more information into the death.
The court was also taken through evidence from the 2002 inquest from a series of experts who said it was possible Mr Lubbock was dead before he entered the swimming pool.
Mr Beggs added: "This was not a mansion as the media have claimed. It was a moderate cottage, with narrow physical confines.
"There were very few people at the property. It was no bigger than a dinner party of nine people, not 160. If there had been 160 persons present and 140 had no idea what went on that might not be very suspicious.
"But we have eight survivors, and at no point, not one can offer a single explanation."
The court also heard shortly after Mr Lubbock's body was discovered Mr Barrymore left the property over fears the press would turn up.
However, Mr Beggs said: "After he has been found, others were seen trying to help him, giving him CPR. The claimant was seen rummaging through drawers and he is observed carrying something under his arm.
"His counsel says he was just carrying a jumper. The simple position is the police never discovered, they can't know, what he removed."
He left his own home before the police arrived at his home which Mr Beggs said was a "suspicious thing to do".

Michael Barrymore paid off two witnesses not to give evidence against him after the death of a man found in his swimming pool, a court heard.
The 65-year-old entertainer is suing Essex Police for £2.5 million over his arrest on suspicion of the rape and murder of Stuart Lubbock who was found dead at his mansion in 2001.
But the force, which has accepted liability on a technicality, claims that the former Strike It Lucky host should only receive nominal damages of £1.
Police had "reasonable grounds" to arrest Mr Barrymore in connection with Mr Lubbock's death, the High Court was told on Thursday.
An extract from a police intelligence report read to the hearing by a barrister representing the force alleged that: "Two people had been paid off by Michael Barrymore to not give evidence against him."
Mr Barrymore, Jonathan Kenney and Justin Merritt were all present when Mr Lubbock died at the TV star's home in Roydon, Essex.
Post-mortem tests found Mr Lubbock had suffered severe internal injuries and toxicology revealed ecstasy, cocaine and alcohol in his bloodstream.
Essex and Thurrock Coroner Caroline Beasley-Murray recorded an open verdict into the 31-year-old butcher's death at an inquest in 2002.
Mr Barrymore – along with Mr Kenney and Mr Merritt – was later held on suspicion of rape and murder in 2007. None of them were charged.
Essex Police has accepted liability and that the arrest was unlawful. But the force claims their liability was on a technicality as they sent the wrong officer to make the arrest.
The force claims officers did have "reasonable grounds" to suspect Mr Barrymore of murder and rape, and to believe the arrest was necessary for an effective investigation.
They argue he should only be entitled to a nominal damages of just £1.
Today, the High Court heard the closing submission of John Beggs QC, representing Essex Police.
He said: "There was potentially a very serious crime, the most serious of crimes in this case, namely murder, and we say it was reasonable to suspect it was preceded by another serious crime, namely rape."
He added: "You don't need to know there was a murder, you have to suspect there was a murder. If you have a dead body of a healthy person, that is a reason to suspect murder."
He told the court that there still was not explanation as to what happened Mr Lubbock.
Mr Beggs QC said: "With this claimant, he has never given a cogent explanation as how a young man was so seriously injured in a confined space with so few people present."
The Essex Police representative said police had to act when new witnesses came forward offering more information into the death.
The court was also taken through evidence from the 2002 inquest from a series of experts who said it was possible Mr Lubbock was dead before he entered the swimming pool.
Mr Beggs added: "This was not a mansion as the media have claimed. It was a moderate cottage, with narrow physical confines.
"There were very few people at the property. It was no bigger than a dinner party of nine people, not 160. If there had been 160 persons present and 140 had no idea what went on that might not be very suspicious.
"But we have eight survivors, and at no point, not one can offer a single explanation."
The court also heard shortly after Mr Lubbock's body was discovered Mr Barrymore left the property over fears the press would turn up.
However, Mr Beggs said: "After he has been found, others were seen trying to help him, giving him CPR. The claimant was seen rummaging through drawers and he is observed carrying something under his arm.
"His counsel says he was just carrying a jumper. The simple position is the police never discovered, they can't know, what he removed."
He left his own home before the police arrived at his home which Mr Beggs said was a "suspicious thing to do".

The thing about Barrymore's comedic presence was that it was painful. We had nothing much going on at prime time viewing and we hoped to be entertained. The strange thing about Barrymore was that whilst watching him and hoping to be entertained he wasn't actually funny.
Being the UK telly audience of the past we laughed off his embarrassing performances because we were being introduced to some kind of new age entertainment.
Strike it Lucky was more favourable to Barrymore than his audience who struggled with his behaviour but in that televisual generation we welcomed something a bit different.
Looking back on things his behaviour was half-pissed and drug fuelled IMO. It wasn't normal but we sucked it up in the hope of being entertained - we'd survived Nana Mouskouri and Cilla Black Saturday night must see, neither of which made us feel uncomfortable but bored and deflated from hoping to be entertained.
Jimmy Saville on TOTP always made many of us feel uncomfortable - and we were only watching. We accepted it because it was being produced on television on Prime Time!
Barrymore is a fool to challenge this escapade and unless the people who manipulated his deviance will now stand up on his behalf and say he's innocent then he has no chance.
A young man, a beautiful young man died and his father can't rest until he knows the truth.

To be fair, Barrymore was a talented and hugely energetic performer. His career really blossomed when he 'came out', which went down well with the showbiz world. Never mind the humiliation his poor wife must have felt. Even the morally bankrupt entertainment industry can't forgive mysterious deaths at parties, thankfully. He should be grateful he isn't in prison, never mind suing and I hope that the truth comes out. Going to court may be a huge own goal by Michael Barrymore. RIP Stuart Lubbock.

I agree with Cmaryholms post but for the part where he was talented. A truly vile character imo and they did attempt to get him back into tv by allowing him onto Celeb Big Brother when he apparently had a melt down and George Galloway said to Barrymore along the lines of poor me, poor me - pour me another drink. He had his measure.

I watched the Larry Grayson epic documentary last night and Barrymore was featured. What struck me as an individual was that for the relatively short amount of time Grayson was on our screens in the 70's, as a child myself at the time none of my family could bear to listen to relentless smutty innuendo. Barrymore wasn't presented as a homosexual - far from it.

Aquila.....I totally agree re “smutty innuendo”. There were an awful lot of “light entertainment” programmes aired in the 70s that just wouldn’t/couldn’t be shown today on the basis of sexist, racist or homophobic content. Think Love Thy Neighbour, Till Death Us Do Part, On The Buses etc.
The freedom of the Sixties has emboldened the writers/producers and these corduroy-wearing hippies foisted their opinions on the masses through the medium of TV. Without doubt the increase in exposure of various forms of sexual liberation gave rise to greater acceptance of same.
Through it came political correctness, the rise of “minority” groups and the government of the days willingness to appease one & all.

whatever amount of compensation Mr Barrymore receives,let us hope that any serving Relative of Mr Stuart Lubbock bring in a Civil claim against Mr Barrymore for the part he had in trying to Cover Up,Stuart's Death?

Terry Lubbock 'phoned me last night to tell me that the final phase of Michael Barrymore's claim for compensation from Essex Police - for being 'wrongfully arrested' - is to be heard at the High Court Tuesday 20 November and Wednesday 21 November.
A police Family Liaison Officer called round to see him and told him they would like him to be there - and will transport him there and back. He is not a witness but it may be useful for Essex Police to have him in court in a case certain issues arise.
A REMINDER that according to the balance of five pathology reports, Stuart Lubbock was undoubtedly raped with a large object and died as a result - but the Inquest recorded an open verdict because the pathologists could not agree on the precise cause of death. Suggested reasons included:
* serious sexual assault
* asphyxiation
* heart attack and
* drowning.
It is my case that Stuart was never in the swimming pool, as claimed, but was brutally raped and asphyxiated in the process - and that Michael Barrymore and the five other homosexuals who were there that night planned a cunning hoax, aided and abetted by Barrymore's Manager, Mike Brown, who was at the scene before the ambulance service was called. I believe a drowning was faked by stuffing water down his throat just before the ambulance arrived.
I am sorry to be so graphic. I am 100% satisfied that, at the very least, Michael Barrymore knows exactly what happened on that drug-fuelled, alcohol-addled night of terror.
Michael Barrymore should at least have been jailed for the obviously bogus story he told about how he discovered Stuart (actual quote) "floating at the bottom of the pool, face upwards". This contradicted other witnesses, who also contradicted each other.
He doesn't deserve one penny compensation.
He has asked the court to award him £2.5 million.
He was allowed to bring this case after a gap of 14 years, nobody really knows why but the judge who allowed this.
If Barrymore gets 1p. compensation out of this, it will be one more injustice on top of all the other ones in this case.

Exactly so. And he was 'facing upwards'. Barrymore later wrote a book, titled 'Awight Now'*, in which he stated that he had stared into Stuart's eyes. Six feet below at the bottom of the pool.Ladyinred wrote:... "floating at the bottom of the pool"?

His then lover, drag queen Jonathan Kenney, who stars in the homosexual clubs of Lancashire, claimed that he was the first to find Stuart and that he was floating face down at the surface.
None of their stories matched.
He was never in the pool and was never pulled out of it.

Hi Mr Antony Bennett,Mr Terry Lubbock and the compensation being brought by Michael Barrymore against Essex Police Force and a liason Officer to assist you in attending the Court process November 2018?
If Essex Police have offered only £1.00 in Compensation,then Essex Police Force know they have not followed the correct procedures and Compensation is payable to the afflicted/effected party!
The Essex Police Force have failed in their duties to both Mr Terry,Stuart Lubbock and his Family in the way they "Investigated" Stuart Lubbock's Death?
Perhaps if the Essex Police Force had used as much,time,effort into the "Criminal analysis" into Stuarts Death and how hard they have "Fought Against Terry Lubbock", Tooth and Nail in having the case Re-opened into the actual Death,how many years tooing and Frowing from IPCC,on Essex Police Force whose own Commander in Chief promised to meet Mr Terry Lubbock in September 2018,then very quickly made a "Batman Manoeuvre" down the Batpole to the awaiting squad car to speed him to his Home,now happily retired?
Now they want Mr Lubbock Senior to attend Court in case Mr Terry Lubbock to be a very use full "Tool in order to assist" an Essex Police Force try to manipulate its way out of paying the amount of compensation to be set by the Court?
I am stating this as to why should Mr Terry Lubbock have to re-live,suffer the "Evidence" the Police acted on in Stuart Lubbock's Death,to be now possibly be used to reduce the compensation likely to be paid to Mr Barrymore?
Whatever amount Mr Michael Barrymore receives,perhaps Mr Terry Lubbock could take out a "Civil claim" on behalf of his lost Son,Stuart,that if or what amount claimed in the civil case Mr Lubbock Senior could use as he wishes.
The best of Good Luck on any future actions taken against Mr Michael Barrymore on behalf of your dearly beloved Son, Stuart, Father Mr Terry Lubbock.
The Police and Government Authorities have failed you,do not let them use you or your "Good Family Name" to now fight their battles in Court,why put yourself through this ordeal,hit "Barrymore" where it will hurt him most in a "Civil Claim"l
