Goncalo Amaral was ordered to pay £357,000 in libel damages to Kate and Gerry McCann after claiming that they covered up their daughter's death.
But now he has been told the court of appeal will hear his case.
Mr Amaral headed the initial investigation into the disappearance of Madeleine, then aged three, in Portugal in 2007.
The latest twist means the McCanns, of Rothley, Leics, may have to return to Portugal to give evidence again.
A source close to the couple said last night: "Kate and Gerry are exasperated by this".
"It just drags on and on and causes them even more anguish."
Last night it was revealed Scotland Yard had made a new request to the Portuguese authorities for further cooperation in the case.

So so glad Mr Amaral will have another day in court, hope he can ask the right questions this time and looking forward to the Mcs making the same idiotic statements they did the first time round !!! Tough cookies, Kate and Gerry. You initiated the legal action. Did you expect Goncalo Amaral to accept the verdict, and everything else you have thrown at him? Your anguish is misplaced, you should consider the effects of your continuous litigation and oppression of free speech on your two children.

Are any of our Portuguese friends able to confirm that this is not the case?
We have previously heard that if the appeal was accepted (which it now has been), it would be held in closed session with a couple of judges going through the transcripts of the previous trial and looking at the grounds for appeal, before making their judgement.
The Mc’s have already had their ‘day in Court’ and seemingly get no say in the matter.

Co-operation must be a scary word ,why do the parents always have tantrums when it comes to the search for THEIR child, so they have to go back to Portugal to give evidence, so what? don't they want to help the police with the inquiry???? they are ridiculous even the dogs think so , I hope the trip back , trips them up.
It must be a very scary fragile little world the McCann's live in, they want certain people to feel fear but isn't it really them who feel and fear the most ! c'mon McCann's what have you got to loose.....

'disappeared' as a 'consequence' of DIRECT 'diliberate actions / conscious decisions' taken/made (self/publicly admitted) by the McCanns themselves, and ONLY the McCanns, themselves.
It really IS their 'fault', 100%, that Madeleine is 'missing'.

THE mum of missing tot Ben Needham has blasted the £11million police hunt for Madeleine McCann.

Investigators have spent the whopping amount (£11million) searching for Maddie, who disappeared in Portugal aged three in 2007.
But Kerry Needham, whose son Ben vanished 24 years ago in Greece, says IT IS UNFAIR the huge sum has been splurged – while just £800,000 has been spent on trying to find her missing lad.

"My heart goes out to the McCanns – having a child go missing is an indescribable pain," said Kerry, 43.
"There is no closure and you miss them every day. But I don’t understand why the investigation has received so much – £11m is unprecedented.
"It seems unfair when other missing children aren’t getting as much attention."
Little Ben vanished in 1991 outside a farmhouse his grandparents were renovating on the island of Kos, while his mum was at work.
His family searched the area for the toddler, aged 20 months, but he was never found.

Kerry says she has pleaded with the Government for more help in finding her boy.
She said: "I’ve come up against so much resistance from the Home Office when I've asked for help finding Ben.

"It seems the police have done all they can - which isn’t the case with Ben.
"There is still hope for Ben. Even this year, police have uncovered information that has led to new lines of inquiry."

Mrs Needham, has not asked the fragrant Rebekah Brooks to serialize a book on her behalf and pursued David Cameron, to overrule his Home Secretary in funding, "Operation Grange" Remit to find an abductor, come out, come out where ever you are, we may have been rumbled?

GA has said the McCann's are being protected but by who and especially why ? was Madeleine herself the reason for all this cover up was there something remarkable about her or was she just a normal child.

They always are, when they cannot get away with it or get their ways.
It's very typical of them to be furious, frustrated, exasperated or for Kate's blood to boil.
Every adjective that can describe their fear and anger will be spouted for the press.
Me thinks they are exasperated because the accepted appeal causes them real fear that history may be repeated.

The Mc Cann parents are regularly 'buoyed' - a few occasions over the years when they have been buoyed (sorry dont know why I did this silly research).

Yes, Kate & Gerry and their family members are fond of using the phrase 'they are buoyed' by development, or rather development they perceived, always making something out of reported SY movement or activity when there is really nothing to it.
