Someone on the Jill Havern forum asked if evidence given in open Court can be published without fear of libel. Good question. During the January 2010 book banning trial in Lisbon, the proceedings were reported live on the net - Sky News I believe and via twitter. We were basically given live streaming of what was going on in the Court. It was hugely damaging to TM (Team McCann) and there are several short videos of a very angry Gerry outside the Court, and he flew back to Rothley, leaving Kate, halfway through! Goncalo Amaral had many good witnesses, and evidence came out, that it was in fact the British police who advised them to investigate the parents.

Six years on, an angry ex detective has been quietly building his case with ever growing public support, while the parents have been making enemies in very high places. The press that had served them so well in the past, hold grudges, as do Home Secretaries. Their need (or greed) for that £1.2m from the honourable gentleman has taken them past the point of no return.

In my book Cry and You Cry Alone, I have given an indepth account of my 3 day trial against the Catholic Church, and the trauma of one and half days in the witness box. I wrote my book immediately after the trial, knowing that everything I had said was proved to be true, and my publishers knew it too, as they had full access to all the Court documents. I had no fear getting into that witness box, and I have a gut feeling Dr. Amaral is now feeling the same, because the truth destroys the lie every time.

Yes indeed court proceedings are open to the public, and I have a feeling it will be standing room only.

Thanks for the reply, Jean. I forgot about the Parliamentary Privilege. The only anti-McC MP I can think of is George Galloway. I wonder if he has ever said anything on the subject in Pariament. And has anything ever been said on the subject in the House of Lords?

My question would be, why did you say the windows had been jemmied? why didnt you answer 48 questions, and why did you refuse a lie detector? Now i know that is 3questions but hey,, there are at 103 i could ask.

The McCanns never actually said "in public or to the police" that the shutters had been jemmied. They certainly did phone their relatives and friends in the UK and say this as 4 different people were on TV on the morning of 4th May saying that the shutters had been jemmied, the window forced and Madeleine taken.
The McCanns have always imparted information in this way so they cannot be personally blamed, it would be classed as hearsay possibly in a court of law. It doesn't appear in their statements either.
But many of the public remember the TV statements and take them as gospel. That's how the McCanns work.

I always think the lie detector question is a bit irrelevant because we don't use them in either the UK or Portugal, so to me that would seem a bit like play acting, or pretending you are in an American crime drama.

But as to why they immediately told their families that the shutters had been jemmied and that Madeleine had been abducted by peadophiles is beyond me.

Just adding - maybe they told their families about the jemmied shutters before the 'abduction' and before there was chance to break them. Once the story was out, it was too late to retract it.
