The Evidence required to charge someone with Rape in Germany was changed recently, and any Sexual Assault while the Victim is in a helpless State can be viewed as Raping them.
DM was Tied up, and Defenceless at the time. That may have been alone ‘just cause’ under the new rules.

German lawmakers unanimously passed legislation for "improving the protection of sexual self-determination" that makes it easier for victims of sexual assault to file criminal complaints.
The law closes "blatant loopholes" in Germany's rape laws by widening the definition of rape to include sexual activity that goes against the "discernible will" of the victim, Justice Minister Heiko Maas said on Thursday.
If "a defenseless state is used to commit sexual attacks, the culprits can be punished for that accordingly in the future," Maas said before the vote.
"When perpetrators cannot be punished, it is a second bitter humiliation for the victims," Maas said.
Previous legislation stipulated that rape could only be punishable if the victim showed physical signs of resisting the assailant.
"It is crucial that we finally embed the principle of 'no means no' in criminal law and make every nonconsensual sexual act a punishable offense," Social Democratic Party lawmaker Eva Högl said ahead of the parliamentary vote.
In March, German Chancellor Angela Merkel's cabinet approved the measure following hundreds of reports of sexual violence committed by men of apparent foreign backgrounds on New Year's Eve in Cologne.
Under the new legislation, individuals involved in a group carrying out acts of sexual violence are liable to face criminal charges, even if they did not commit the acts themselves.
According to Germany's DPA news agency, some 8,000 rapes are reported annually. However, only 8 percent of court trials concerning rape result in a convictions, said Germany's justice minister.

Earlier this year Busching claimed that Brueckner had confessed to abducting the British girl from her parents’ holiday flat in Praia da Luz in the Algarve region in May 2007, when she was three. Busching claimed that when they were discussing Madeleine’s disappearance, Brueckner told him that “she didn’t scream”.
So in press speak when someone says something like "she didn't scream" (subject to variations according to source), is interpreted as a confession?
Even if Brueckner did say something like that, for which there is no proof, so what - it's hardly a confession is it? Why would anyone say such a thing without context - it means nothing as a stand alone sentence.
The press and mainstream/social media pick up irrelevancies and churn them out ad-infinitum without ever bothering to check the facts and perhaps, heaven forbid, think for themselves.
That aside, anyone who believes for one second the likes of Busching and the other clown, Manfred Seyferth, are assisting the police with a criminal investigation, then I despair.

It is not the Madeleine McCann case, that was archived by the Portuguese judiciary in the summer of 2008 and remains there pending new EVIDENCE to pursue.

“He was paid a huge sum to repeat his statement in a German newspaper and now he’s pulling the plug.
“It just goes to show you what type of people you are dealing with — and their credibility as witnesses.”
Helge B’s move could be the final blow in the stalling bid to bring Christian B to court for the suspected abduction and murder of three-year-old Madeleine in Portugal in 2007.
It will be another setback for her parents Gerry and Kate, both 55, of Rothley, Leics.
German Helge B, 48, was a criminal pal of drifter Christian B when they lived on the Algarve around the time of Madeleine’s disappearance from her holiday apartment in Praia da Luz.
He told cops he was chilled by Christian B’s alleged dark confession when the pair met at a music festival in Spain a short time after the tot vanished.
As the pair discussed the case over beers, Christian B was said to have coolly confided: “She didn’t scream.”
The convicted rapist and child sex attacker clearly implied he had taken Madeleine, Helge B told cops.
McCann probe prosecutor Hans Christian Wolters said he was unaware of Helge B's suspected change of heart — but insisted his statement would still carry weight.
He said: “Anyone who has said something must be measured by it. Witnesses are subject to the duty of truth — they have to testify. You can’t just choose something like that.”
Helge B's threats to back out came as it was revealed Christian B has written begging letters to pals asking them to back him if he goes on trial.
He faces new charges of rape and child sex offences unconnected to the McCann case.
In one letter, the sex offender moaned that prosecutors were making him out to be “a monster”.
An ex pal said: “I know of two people on the Algarve who got the messages. It really freaked them out.”
Christian B is currently in jail in Germany for the 2005 rape of a 72-year-old American woman in Praia da Luz.
Detectives claim to have “concrete evidence” that Madeleine is dead but have yet to produce further material which could lead to a charge.
Christian B’s lawyer, Friedrich Fulscher declined to comment last night.

This weekend the prison will host the Oldenburg Festival, which features the Japanese film From Dawn Till Noon On The Sea.
The plot focuses on a schoolgirl who was kidnapped for 49 days, while other films at the festival include topics of murder and children dying.
Inmates are allowed to watch the films alongside members of the public and they are reportedly shown inside the jail for prisoners as well.
The films are shown in communal areas inside the prison.
It comes amid reports the case against suspect Christian B. is close to collapse.
Ex-pal Helge B - who has become a major part of the German-led case - could soon back out and refuse to support his claims Christian B. is guilty, in court.

So the sum total of evidence so far is a phone ping, a rumour Brueckner was in the area at the time of disappearance and now three words .... 'she didn't scream'?
I don't think that would even get past the court usher.
Did he say 'she didn't scream'; did he say 'she didn't scream?'; did he say 'got some ice cream?'
Did he say anything at all? Can a known felon be relied upon to be truthful - even if possessing an impressive memory?
Utter nonsense.

it will up maybe tomorrow in the uk paper and news outlets, but bild has the news in german, that der hans won the dispute about where cb has to stand trial in germany, so that will be first for the 5 cases braunschweig.

Brueckner was named as the key suspect in the disappearance and murder of Madeleine last year, who vanished from her family's holiday apartment in the Algarve resort of Praia da Luz in May 2007 - just a few days before her fourth birthday. But he has still not been charged regarding her abduction and he denies his involvement.
