AN ex-police chief who cruelly claimed Madeleine McCann’s parents covered up her death has made more than £350,000 from his book and a DVD.

Kate and Gerry, who have fought a lengthy legal battle to stop Amaral cashing in, are currently challenging him at the European Court of Human Rights in Strasbourg. A source close to them said: “If Goncalo Amaral continues to make these outrageous claims then he will find he has a tough fight on his hands.
“Kate and Gerry are not going to let him get away with what he said about them.”

They show he made 342,111 euros from book sales in 2008-2009 and another 40,000 euros from the DVD spin-off.
The book was translated into multiple languages, with more than 180,000 copies printed. There are fears Amaral plans a follow-up.
An injunction against the book, stopping further sales, was issued in 2009 when the McCanns began a libel action against Amaral, who led the initial Portuguese police inquiry intoMadeleine’s disappearance.

They won the case in 2015 but the ruling was overturned on appeal — a decision upheld by Portugal’s Supreme Court. Amaral was awarded compensation.

The lawyers say Amaral’s book “incriminated innocent citizens, accused of terrible crimes they never committed”. It goes on to say they are trying to “protect not only their reputation but that of the child as well”.
They also say Amaral’s book was “extravagant” and “damaged the good reputation” of the McCann family.
Amaral previously argued in his defence that the book’s allegations come from the police investigation.
He was removed as the investigation head in October 2007 and subsequently left the police to write his book.

is anything other than complete journalistic bullshit, the case isn’t even going to get past the front door, as it’s not what the ECHR is all about, so hopefully we may hear this week that the case has not passed the necessary criteria for acceptance and has been thrown out. (Of 50, 000 yearly applications to the ECHR, apparently only about 30, that’s 0.06% get through).

“Anyone who, when addressing a third party, accuses another, even if the accusation takes the form of a suspicion, or makes a statement that casts aspersions on the honour of another, even when repeating an accusation or statement, shall be liable on conviction to a maximum of six months’ imprisonment or 240 day-fines.”
By a judgment of 14 July 2010, the Lisbon Criminal Court convicted the applicant of aggravated defamation. According to the judgment, by making the impugned statements the applicant had wilfully defamed A.S. by making disparaging allegations in respect of him. The court further noted that the applicant’s article, and in particular the choice of the words “petty liar” and “poor wretch”, had been vindictive and a personal attack on A.S.
It has taken the ECHR over five years to determine that the fine was a violation of his human rights and decreed that Portugal pay €5000 for a damages award & €2500 costs.
Absolutely crazy. How much has that actually cost in terms of lavish premises costs, court time, salaries etc.
After Brexit, we will still be in this little club.

Whatever the whys or the wherefores of the ECHR are, this is what the Daily Mail was saying back in September 2017:
'The Court acknowledged the application in August and its admissibility is now being examined. Kate and Gerry will not be commenting on any aspect whatsoever as it remains entirely a matter for their Portuguese lawyers.'
It is understood that the result of the appeal will not be known for at least four years.

Oh yes, let's just ignore the established purpose of the ECHR, it's historic raison d'etre - if the Mail says, so be it! The Mail, the authority of all things known to mankind.

Should the McCanns legal representatives apply to the ECHR with a case against the Portuguese state, it could never be an appeal, that is not the purpose of the ECHR.
In law, an appeal is the process in which cases are reviewed, where parties request a formal change to an official decision. Appeals function both as a process for error correction as well as a process of clarifying and interpreting law.
It's abundantly clear that is not the function of the ECHR - so Daily Mail, wrong again !!!
The Mail stands for nothing but another erroneous media report relative to the case of missing Madeleine McCann. The media monitor made damn sure the press were well and truly protected against any defamatory action unless it resulted in a hefty financial pay-out to the McCanns, their friends and the Find Madeleine Co. Ltd.

Europe took another step toward sharia law last Thursday when it ruled that an individual’s right to free speech did not extend to "insulting" the Prophet Mohammed. The European Court of Human Rights (ECHR) upheld the conviction of an Austrian woman who was fined for relating scripturally based behavior of the prophet to pedophilia.
The Austrian woman, known only as E.S., said during two seminars in 2009 that the Prophet Mohammed’s marriage to six-year-old Aisha at a time when the prophet would have been in his 50s was akin to pedophilia. The Koran states that the marriage was not consummated until Aisha reached the age of nine.
E.S. reportedly told the seminar attendees, “Muhammad liked to do it with children,” and also stated, “A 56-year old and a six-year-old … what do we call it, if it’s not pedophilia?”
The defendant argued that her comments fell within her right to free expression and that religions must be able to allow some criticism of their teachings. She further stated that the comments were not meant to defame Mohammed but to ignite public debate.
E.S. was originally found guilty in a Vienna court in 2011 and ordered to pay a €480 ($547) fine. An Austrian appeals court upheld the original decision.
From the ECHR ruling: “By accusing Muhammad of pedophilia, [E.S.] had merely sought to defame him, without providing evidence that his primary sexual interest in Aisha had been her not yet having reached puberty or that his other wives or concubines had been similarly young. In particular, [E.S.] disregarded the fact that the marriage with Aisha had continued until the Prophet’s death, when she had already turned eighteen and had therefore passed the age of puberty.”

If they do their homework, or at least admit that Brexit has bugger all to do with anything, then and only then can they start to realise that the McCann campaign for anything and everything takes precedence over reality in it's rightful form .
Freedom of speech is such a tenuous subject. How can you say on the one hand that a member of the public can say whatever they like in the name of freedom of speech, be it wrong or be it right but on the other hand the press or some other voice are not allowed to say whatever they like be it wrong or be it right.
Sorry, whatever walk of life, censorship is an essential component of right and wrong. If not for censorship where would morality stand in our lives and the future of our children? Already we see boundaries pushed to the limit in the name of freedom of speech, comedy, lifestyles, entertainment, acceptable/unacceptable conduct - all in the name of freedom of speech.
Take for example the internet, social media .... 'I don't like/agree with what you say but I defend your right to say it'? Following that criteria one can say .... 'I fantasize about having sex with a minor' or 'I get a kick out of exposing myself in the local park'. So, by the common law of freedom of speech it's OK to say such things without fear of censure?
There has to be a line drawn between what is acceptable and what isn't. Freedom of speech is a utopic vision to allow an unrestrained uncensored world of perversion and make believe. The press are no exception.

Take for example the internet, social media .... 'I don't like/agree with what you say but I defend your right to say it'? Following that criteria one can say .... 'I fantasize about having sex with a minor' or 'I get a kick out of exposing myself in the local park'. So, by the common law of freedom of speech it's OK to say such things without fear of censure?
There has to be a line drawn between what is acceptable and what isn't. Freedom of speech is a utopic vision to allow an unrestrained uncensored world of perversion and make believe. The press are no exception.

Putting aside what can or cannot be done in the ECHR, my belief is that this "appeal" is nothing but a delaying tactic, and SOMEONE is running scared. It's no secret that Dr Amaral is going to publish a second book. This is what was in the press, in Feb 2017:

So, to recap, I believe this appeal is a delaying tactic, and it could take the best part of a decade to be heard, if it passes the smell test in getting to that stage. Also, despite all the threats by the Man in Pink and friends in high places, what can the McCanns do if Dr Amaral is about to launch the second helping of "what happened to Madeleine McCann?"

MADELEINE McCann’s parents have today slammed the ex-cop who made more than £350,000 after claiming they covered up her death, saying: “We just want to shut him up”.
Shameless police chief Goncalo Amaral claims Madeleine died in an accident and Kate and Gerry McCann were involved in a cover up.
Court papers reveal he made a small fortune from his book The Truth Of The Lie and a DVD spin-off about the toddler’s disappearance in Portugal more than 11 years ago.
Kate and Gerry are only taking legal action against Mr Amaral because they believe silencing him will help boost the search to find her.
A friend of the exasperated couple said the retired cop is “hampering the official search” and added Kate and Gerry “firmly” believe their daughter is still alive.
They told The Sun Online: “If people think Madeleine is dead it goes without saying they will stop searching for her.
“By continuing to spout these wicked lies, Mr Amaral is hampering the official police and public hunt for her. Money rolling in for him from books and DVD’s is almost irrelevant, it’s a side issue.
“Kate and Gerry firmly believe their daughter could still be out there and waiting to be found.
"It’s not about compensation and damages and who wins this amount or not, it is about the truth being accurately portrayed.
"Kate and Gerry don’t care about his money, he may be cashing in on their daughter’s disappearance and their misery, but they ultimate goal is to shut him up.
“If his book can no longer be sold, having once been briefly banned in the past, people can’t read his dreadful lies. If people think Madeleine is dead, as he suggests, why would any searches continue?”
Retired cop Mr Amaral - who bizarrely blames the McCann’s for wrecking his life by slandering him, undermining his work and disrupting his family – made £300,00 from book sales and £35,000 from his DVD.
It is believed he also made a further £20,000 from interviews with newspapers and TV stations.
The missing girl’s parents want his bestseller book – which they claim is full of spiteful, untrue and contains defamatory remarks - to be shelved.
Their friend said Mr Amaral has been “a thorn in the side of the McCanns” from the day three-year-old Maddie vanished during a family holiday in Praia da Luz in May 2007.
Heart doctor Gerry and ex GP turned medical worker Kate, both 50, from Rothley, Leics, want the public and supporters to know they still cling onto a glimmer of hope their daughter is alive.
A source close to them said: “If Goncalo Amaral continues to make these outrageous claims then he will find he has a tough fight on his hands.
“Kate and Gerry are not going to let him get away with what he said about them.”
But they face a huge wait for potential justice, with their pal remarking: “It could take up to eight years by which time Madeleine, if she is still out there, would be a young adult into her 20s.”
The ECHR stated today that the case has not yet been dealt with and there is “no fixed time for examining it.”
An ECHR spokesperson said: “The case McCann and Healy v Portugal is still under consideration and there is no fixed time for examining it. There is no date fixed date for any judgement or decision to be delivered.”
An injunction against the book, stopping further sales, was issued in 2009 when the McCanns began a libel action against Amaral, who led the initial Portuguese police inquiry into Madeleine’s disappearance.
They won the case in 2015 but the ruling was overturned on appeal — a decision upheld by Portugal’s Supreme Court. Amaral was awarded compensation.
The injunction on the book was also lifted, leading to thousands more sales and even more cash for Amaral.
The McCanns have gone to the ECHR in a final effort to avoid paying Amaral £750,000 in compensation.
They now face a potential eight-year wait in the European Court of Human Rights in Strasbourg to find out whether the book will be pulled.

Methinks there lies strong evidence that Ms Oyl reads CMoMM as she appears to be addressing particular points expressed over and over again hereon - albeit without much success but what can you expect when trying to fight a losing battle?

A source close to them said: “If Goncalo Amaral continues to make these outrageous claims then he will find he has a tough fight on his hands.

They show he made 342,111 euros from book sales in 2008-2009 and another 40,000 euros from the DVD spin-off.
The book was translated into multiple languages, with more than 180,000 copies printed. There are fears Amaral plans a follow-up.

The McCanns fear if they lose, Amaral’s payout will wipe away what is left in the fund set up to finance the continuing search for Madeleine.
Sources close to the family also fear Brexit may have an impact — with judges taking “vengeance” over Britain leaving the EU by ruling against them.
In their argument to the ECHR, the McCanns’ legal team describe the pain and emotional agony Kate and Gerry have gone though since Madeleine disappeared during a family holiday in Praia da Luz in May 2007.
They detail the anguish of the couple being absurdly made suspects by the Portuguese police followed by the pain of Amaral’s outlandish accusations.

The lawyers say Amaral’s book “incriminated innocent citizens, accused of terrible crimes they never committed”. It goes on to say they are trying to “protect not only their reputation but that of the child as well”.
They also say Amaral’s book was “extravagant” and “damaged the good reputation” of the McCann family.
Amaral previously argued in his defence that the book’s allegations come from the police investigation.
