I don't believe that a witness can turn up "out of the blue" in a court case whether in the UK or anywhere else, unless GM's name was on the list of witness statements and it hasn't been released until now.candyfloss wrote:Will the judge allow it at this late stage. Witnesses have to sign a witness statement in front of a solicitor/lawyer which has to be presented to the court overseeing that particular case at least 2 weeks before the court hearing, in the UK anyway, I can't see that Portugal is any different.
As someone mentioned sometime ago court cases have to be booked and timed on the number of witnesses that are going to be present and the timimgs have to be adhered to as there may be other court cases booked in to follow.

If Gerry doesn't appear it will be interesting to hear the excuses - he missed his flight because his car broke down on the way to the airport; there was a patient he had to attend to at his hospital at the last minute; they had a gas leak at home; the twins' nanny didn't turn up so he had to cook them dinner whilst Kate was doing her daily 50 mile run for any charity she can hook herself on to; the paperboy was ill so Gerry kindly offered to do his round for him, etc. etc.

The press does it because the fairy tales still sells papers and Kate in tears and Gerry leaping on a plane will take the focus of the libel case. An Eastenders plot to cover a simple truth: the truth of the lie. They all lied.

I'd be very surprised, 'hoping' to be there - hoping for an excuse not to be there more like. 'We couldn't give evidence at our own trial' will be Saturdays headlines.
If he does go it's a sure sign the trial isn't going well for them, time to send in the 'big boys'

If he is on GA's list I don't think the word " hope" to be there would be used.
He should have made sure, from the very beginning imo, that he was definitely on the list of witnesses.
If he hopes to be a witness I cannot see why Mrs. cannot hope to be one also. They are both seeking damages and hearsay from him on her behalf will not cut it.
Nah, he wont be there as a witness, possibly to sit on the bench and look sad and hurt and unable to work blah blah, but I seriously doubt his shoes will see the inside of the witness box.

WTF!!! How can you "hope to appear" at a libel trial for which you're the plaintiff? Either you've given a witness statement and appear or you choose not to. There's no "hope" about it!

Gosh, that would be an eye opener wouldn't it? I would've have booked a first class seat on any airline that got me from the UK to Portugal in time for the "opening session", and I would've booked a front row seat at the Court if allowed, but I doubt if GM will appear, he hasn't got the balls to confront GA and GA's lawyers. GM would be lost for words if he didn't have a pre-arranged script in front of him of the questions he was going to be asked.
