My thread is basically the title of this topic!
IF: The Mccann's get arrested, charged and jailed... Will Tony get at least the money that Carter Ruck wanted to get of him?
and hopefully a public apology!

That's something that I'd wondered myself. We can only wait and see what develops I think.........

I hope he would but I don't think they are going to be arrested any time soon, so hope TB sits on his hands whilst all these headlines are coming out. [You must be registered and logged in to see this image.]

Re: IF: The Mccann's get arrested, charged and jailed... Will Tony get at least the money that CarterRuck wanted to get of him?
Short answer - NO.
TB is gagged for all time for an alleged breach of a promise he made to the High Court
The facts of what the court considers an insignificant matter, the disappearance and probably death of a 3 year old girl, do not concern the court.
They are interested only in how many angels can dance on the head of a pin.
Facts are nasty things.
People are not much better
Best to ignore them and indulge in the splendour and majesty of the LAW

Could he never, ever appeal against the decision, Human Rights and all that?

I think the agreement was so stitched up that if he ever raises it again he becomes immediately liable for 300,000 in costs. Just for starters.
I'll read the judgement again, but that was my initial interpretation.
And even more worrying is that he cannot come onto this site and explain, since to do so would risk his having to say "I am not allowed to state X They are DESPERATE to keep him silent.
Why ?
What did he say or write or think that was so dangerous ?

That is indeed a mystery (if I may be so bold as to use that word) Peter. The questions he raised were no different as far as I can see from those raised by many other people.

Being the eternal optimist, I wonder if e.g. Judge Tugendhat wouldn't invite him to ask the Court to relieve him from his undertakings ... As a person of law, he must have understood very well that TB was cleverly guided to a sidepath, where he couldn't win, as the "material truth" was not under question there.

I wondered where this thread disappeared to. I lost it!
It would be sincere shame that if the house of cards came crashing down this issue's with relation to the court and the gagging didn't automatically come down with it! could you imagine if the Mccann's were jailed and then Tony was still not allowed to speak in lieu of the 300,000 ?

That is truly ridiculous and wouldn't sound out of place in North Korea.

They tried gagging the IRA too, but the IRA got around it, and it became so ridiculous, they had to lift it. And before anyone suggests that I am condoning the IRA by stating this fact, I am saying now, that I neither condoned nor condemned them. I am merely stating what happened.PeterMac wrote:Short answer - NO.

You may be falling into the trap of thinking that "The Law" and "Justice" are synonyms !
Justice demands that the truth be told. "Fiat justitia ruat caelum" "Let justice be done though the heavens fall."
The Law says that the truth may not be told. "Fac tui juris per cecum" (I forbear to translate !)

When the truth is told, the law will mandate that Mr & Mrs are incarcerated, only then will TB get justice and vindication.

Tony Bennett will get justice. Patience is a virtue. Play the waiting game and everything's eventual.

But under the terms of the judgment {correct me if I am wrong} even if it were conclusively proved that everything TB said was true, even if the McCanns were found guilty of all sorts of things including perjury, even if all of that happened . . .
TB will still not be able, ever, to say that they may, just may, or might, possibly, in theory, just for arguments sake, hypothetically, or just for the sake of a purely academic argument, be allowed to refer to the thoughts of the Senior Detective in the case, nor of his successor, nor of the highly skilled and qualified Police advisor from England, nor of the Assistant Chief Constable (Crime) of Leicestershire, nor of anyone else in the entire world who has actually read the evidence.
It is called English Law. And we believe it is the best in the World. Perhaps because we pay a huge amount of money for it.

But I`m sure TB would then have a damned good case for repeal.

If Tony went to live in another country say America, would he still be gagged?

I think he would also have a damned good case for getting a lot of compensation from them.

If I were Tony.
If the McCanns are convicted, I'd have my photograph taken raising a glass of New Zealand white (or red or ...do they do sparkling?)
And it would be a real shame if others got hold of that photograph and sent it to the jailbirds.
I don't know about the legal ramifications of a conviction or whether the press would start a campaign but that one photo would be soooooo sweet.

Under the so called stupid English Law, the terms of judgement do meanTB is indeed gagged for life.
But if the infamous couple were incarcerated for multiple crimes, then there is good reason to appeal against the judgement because technically the judgement is rendered null and void by the Truth of the matter; and the Mccanns powerless to oppose to it. By then they would be the most hatred couple in the nation and perhaps the globe.
Once Mr & Mrs got their comeuppance then there is also reason for those innocent individuals they harmed to countersue them for compensation.
When that time comes, the it wont be a pretty picture for the couple in more than one way.

I believe he would Tiny as it has been set down in law. But I`m sure, given that he was right all along, Tony would eventually be able to Repeal his sentence.
