Ward of Court
IIRC, Maddie was made a Ward of Court very soon after the facts.
I have never understood, why it was not the Court, her legal guardian, who represented her during all those endless lawsuits.
Anyone in the know?
Also, again IIRC, after having gone missing, isn't there an official decision to be made, to declare the missing person officially dead?
That shoud be happening around now, May 2013.
Any word on that?
Such a Court order, if and when made public, would of course put an immediate end to any contributions into the Limited Private Equity.
So why is it so silent, around these matters of public interest?

I looked up and posted on 3As a long time ago, that once a child is made Ward of Court, no files or medical info .etc. can be made public until 30 years after that child has reached the age of 18.
Haven't checked again, but that is my memory of it.
I thought about the declaring a person dead after 7 years in another thread. You are right I think Portia about the end to the Fund if this should happen.
PeterM posted that a member of the family could request that this be done. We shall have to wait and see if any of them do, but not sure if they could if Maddie is still a Ward of Court.
All a waiting game.

Re: Ward of Court
I don't think the seven years thing would apply in the case of a missing child.
I wouldn't want to apply if it were my child who were missing
And, supposing they all ready know where she is, how would they ever explain why they would want her declared dead?

Re: Ward of Court
Just think of the publicity.
If Madeleine's legal guardians have her declared dead, brave Kate and brave Gerry will vow never to give up, donations to the fund, that photo of Kate looking pensive cos she's glued her fingers to her chin ...blah blah blah.
I can't see any reason for a missing child to be declared dead but it would be a good marketing ploy.

Re: Ward of Court
Correct me if I'm wrong, but I'v always thought / understood that a child is made a Ward of Court to assure, that s/he, if found, can be brought back to the rightful parent, as in "parental" abduction after e.g. a painful divorce ...

Re: Ward of Court
This info on the Family Law site just seems to refer to children from a broken family.
Q12: What does 'Ward of court' mean in the context of children?
A12: When a child is made a ward of Court all matters affecting the ward's up-bringing become the responsibility of the Court. The Court determines matters such as the child's residence, education, maintenance, holidays, etc. A third party can seek custody of a child against a parent, or seek to obtain protection for a child against the actions of a parent, by bringing wardship proceedings.
But I believe the McCanns solicitors set in motion the Ward of Court a couple of weeks after Maddie went missing - don`t know why - maybe because a Court can extract more info than a parent could.
Later they extended the Order to get information from Leicester Police about all the people that had phoned in with information, AFAIAA.
I remember Jailhouse Lawyer once saying that he was trying to apply for a death certificate in order to bring about an Inquest - but I don`t think he got anywhere with it.

That context applies only if it is a known factor the child is snatched by a partner. But in this case the audacious pair brazenly made use of the Court to oblige Police to hand over info that they wanted (which otherwise would not be divulged to them) except they did not quite get their wish fulfilled.
The mccanns will made use of anybody and any authority if it suits their agenda. The Pope was used. They even used the twins.
It's all just a big game to them.

Re: Ward of Court
Being a ward of court maybe explains why medical notes etc. were refused.

Re: Ward of Court
It was a Summons that was applied for on the 14th May 2007, just 11 days after Maddie went missing. I find this difficult to understand - is this because the McCanns are frustrated at not being given information by UK police, Foreign Office etc?
They were still in Luz yet their solicitors were applying to the High Court in UK for an Order to obtain information and this Order could be served on anyone they wished to get information from, including Leicester Police. Leicester Police had the order varied.
Maddie was made a Ward of Court on 2nd April 2008.
