Gerry and Kate McCann, Maddie's parents, move to Lisbon today for meetings with the working teams, including the lawyer Isabel Duarte and communications agency headed by Claudia Nogueira. The presence of the McCanns in Portugal comes just days after the British couple have launched an online petition to pressure the Portuguese authorities and the United Kingdom for the revision process of the disappearance of Maddie, so they can gather new evidence to reopen the same by the prosecutor. In coming to Lisbon, Gerry and Kate McCann are taking the opportunity to give interviews to the media. At the end of the day, must return to town of Rothley, in northern England, where they live. Madeleine disappeared on the night of 3 May 2007 in Praia da Luz, Lagos, while their parents dined with friends at a restaurant.

Something is happening in the background.......not them asking for reopening that is for sure!

Why would they waste money to go all the way to Lisbon incurring more expenses meeting with lawyes and PR that had nothing to do with reopening --- simply doest mean sense.

They were scared shitless judging by this statement

....for the revision process of the disappearance of Maddie, so they can gather new evidence to reopen the same by the prosecutor

Revision process - dont know what that means. They wanted the PJ to revise the process to their favour?

to reopen the same by the prosecutor - does this mean they want the same prosecutor if case is reopened? Why? because that prosecutor was lenient to them?

None of their statement was coherently made.

They will need plenty luck to get out of this one ...after having bad mouthed HS then went all the way to Lisbon to ask for reopening ...err... excuse me I DONT think so!

Probably some sort of publicity stunt to make it appear that they are asking the PJ to re-open the case when, of course, that is the last thing they would request. I think the reality is that the McCanns are running scared, the support they thought they had is falling away and they are running around like headless chickens in the last chance saloon. exalt exalt

The deadline to file an appeal was the 3rd November, but their appeal was actually filed on the 5th. (I suspect that that was probably done deliberately so that the Courts would have no option but to reject it.) I can confirm that the appeal was rejected because it did not conform with some aspect of Portuguese law. Of course, Isabel Duarte omitted this little detail.

One would have thought they would have cut their losses by now.

What are they trying to hide, that they cannot make a clean breast with the media about?

If they are continuing to argue that Amaral has stated something that is libellous, they have far more resources than most to straighten or iron it out in the media.

What is their real problem?

It sounds as if the lawyer of the Mccanns is going to the International Courts, as is going to hold on to the books - if I am reading this correctly

Just goes to show the importance of the book to their Libel charges, because their libel was based on the book and the overturned is a hugh setback to their libel case.

That's why the counter appeal even despite Isabel Duarte having mouthed they stand absolutely no chance in the appeal, yet they counter appealed......desperate measure and clutching at straws.

Can anyone imagaine a Supreme Court wanting to accept their counter appeal just to counter 3 fellow colleagues unanimous decision. Wouldnt that make the system looks a joke if counter appeal was allowed in that situation?
Let's face it judges dont like to make decision only for fellow colleagues to come and overturn it, so decisions are taken bearing that in mind.....all grounds are covered to prevent that eventuality.

The first instance judge who allowed that ban was different....apparently what her decision was mistake in brech of Amaral right to freedom of expression. The three panel of judges were heavily critical of first instance judge decision and I read elsewhere PT legal professionals think Amaral has good legal ground and good chances to sue the state of PT when he wins the libel.

If the mccanns take appeal to international court (can only mean EU), I still cant see that being in their favour, because the three judges made it crystal clear the injunction breached the Portugal Constitution under Freedom of Expression. In short the judges were saying the mccanns right to freedom of expresssion was not curbed, equally Amaral was within his right to express his, be it an alternate vision.

Other fundamentations in the injunction were thoroughly covered point to point by the three judges in a way mildly critical of the mccanns......the mccanns stand absolutely no chance in the international appeal court. They shot themselves in the foot. On the privacy issue they forfeited that by their high profile media exposure including doing their own reconstruction etc.

They are saying Maddie is still alive.......but evidence proved otherwise.....so they would be hard pressed to convince an international court because I suspect police process files will be produced when it comes to that. Anyway the three panel of judges supported Amaral's right to make that thesis an an expert in that field, that was the whole point of his job.

No wonder the mccanns were desperate for money. Legal costs are mounting for them.
If none of the celebrities they approached donate I am sure we wont hear of it.

I wonder whatever happens to BK? Why didnt they just go to BK direct instead of begging the other celebrities? Could it be because they couldn't, BK will tell them where to stuff their begging bowl when it comes to money.

In the not too distant future, their case will be definitely be one of the most important issues in the minds of the public, but the public will certainly not be behind them.

One has concerns as to whether the McCanns legal advice is up to par for the enormity of their current undertakings. This is not to say that it is inadequate in its entirety, but that it is falling short of that which one would expect for such a case.

One has to ask if the McCanns themselves may end up a digging a ditch they may never be able to climb back out of

That day is drawing nearer and nearer, they know it, we know it and there is nothing they can do to stop it.

They have just had a taste of how things will go. Amaral won, they lost.

1. When are you going to pay my fees and court costs?

2. You now need to pay Amarals's fees and court costs.

3. Do you want me to continue with this libel action? If so, I need a down payment of xxxx euros please. 'And by the way, we might lose'.

4. What do you want to do about the unbanning of the book, now that I appear to have missed the deadline by 2 days and the court has rejected my appeal?

5. Shall I defy the court order and keep hold of Amaral's book?

Isabel Duarte had indeed refused to hand over the books?

I cant believe she did that knowing very well she broke the law.

What she did was a civil crime. She should be reported to the law society.

It is widely known that the McCann couple was in Lisbon today, in a meeting with their legal representative, the Hon. Madam Lawyer Isabel Duarte, and, as far as I am able to tell, with the Director of public relations company “Lifting”.

The McCann couple has launched an online petition for a review of the process, allegedly, because they know that “there is important informations, to which they do not have access, that are in the possession of the British and Portuguese authorities” [read below].

Now, this question is vitiated by an immeasurable fallacy: how does one assure the importance of information to which one did not have access? As far as it is known, the information the authorities possess about the case is either in the process or in the possession of the Public Ministry, to whom several suggestions were given regarding investigational steps to matters that were not carried out.

On the other hand, the figure of the process review in our legal system has, necessarily, criteria, which are not met in the case in question.

Finally, I would like to leave a few words concerning the attitude of Hon. Madam Lawyer Isabel Duarte.

Indeed, the most excellent Madam Isabel Duarte has every right to present the appeals that she deems adequate, though of doubtful admissibility, and even, of appealing to the European Court of Human Rights. She has the right, I repeat!

However, she has the duty, even more due to the fact of her being a candidate to the Supreme Council of the Bar Association, to comply with a ruling from a superior court, as is the case of the Appellate Court.

The Illustrious barrister is not, therefore, above the Law. Actually, it would be better not to go beyond her role as a Lawyer, like when she attempted, at least three times that I have witnessed, to influence the contents of television programmes where the subject of discussion was the Maddie case, recalling the injunction and the consequences of its disrespect.

As to the appeal (which would only be allowed under uniformisation of jurisprudence), what is left is to remember that it does not have any suspensive effect on the Appellate Court’s decision.

Thus, unless something has happened to the books that she has been entrusted with, I do not see why she does not return them.

It is all rather odd I must admit. This visit was announced days ago, and normally at least Sky would be following their every footstep. They would certainly usually have been at the news conference the gave in Lisbon, and yet we have nothing at all, anywhere. Things seems to be changing. thinking Something definitely going on behind the scene somewhere. I keep thinking back to the two that resigned from the fund. Such long standing Directors suddenly resigning hmmmmmmmmm.
