The source conveniently omitted that bit of information didn't he? All the easier to retro-fit/deny/blame when necessary. "Police interfered with the judicial process by advising us not to attend" ? "We lost the case because we didn't attend" etc etc. But then they've never followed any police advice before - why start now?

I think it was all a load of baloney jm, from an unidentified source. At best a throwaway remark about the media circus around the Lisbon court. I can't realistically imagine any police, SY or PJ, advising anyone about anything in a civil Libel case.

Let us hope it IS a media circus. Let us hope that all the world's press are there, reporting honestly and in detail what happens.
Let us hope that the details of the statements made and the arguments put forward are given, so that everyone can understand the issues and the evidence on which they are based, without prejudice.

Let us hope the British press are represented and do their duty to the truth.

It's not the Police advising them. It's their source who claiming so ........and we know the source is infamous for lying with as many teeth in his mouth.......

I am sure the family members wont be attending in person but by video link. Didn't they postpone the hearing once because video link witnesses was filed by ID at the 11th hour?

Why doesn't a "spokesman" from the Yard deny giving out such information then?
The police obviously know it's a lie (if indeed it is) and should come out and say so. They weren't backward in saying that the McCanns and their mates are not suspects.
Statements like this should be challenged imo.

On an optimistic note, their fear of media frenzy shows they expect the outcome to be contradictory to Redwood's proclamation.

Think about it - if they are SO confident it would be unlike them not to be there to gloat "see, told you so" ?

Since when they avoid the media when they can manipulate it, but a negative to them Court verdict is not something they can spin.

Let's just say I am HOPEFUL.

It's an asinine lawsuit, to be clear, and officials are even encouraging the McCanns to avoid showing up in court -- avoid showing up in a trial that they have initiated. Goncalo Amaral famously made claims that Maddie McCann died in apartment 5A and along with other experts he made sure to produce enough evidence to back his claims up -- but Kate and Gerry didn't stay in Portugal and have notoriously been uncooperative with very basic elements in the investigation.
Amaral is confident that he will be victorious in this lawsuit -- and hopefully he is. The evidence against Kate and Gerry McCann would be enough to lock them up in many other scenarios, but for some reason they are being coddled in the UK as the media pumps out sappy and borderline false reports to sway the public into believing this couple is innocent of wrongdoing. It's shameful and will only add to the time that will pass without Maddie's remains being located.

Ms Hoffman should not be using the word " murder" in relation to anything GA has claimed re involvement of the parents in Maddie's disappearance imo.

Good read indeed. It seems he's confident Amaral will be victorious.

He promised to go away if writings no longer support its purpose.
So, his continuation proves he's faith Justice will be restored to the party deserving it, and melted out to another deserving party.

All well that ends well eventually.

No one doubts they'll definitely try to claw back some face. Their pink pet is retained for a good reason.
God forbids when they lost. Cries of travesty of justice, an anomaly of law, and the Portuguese legal systems will be branded as corrupt
The faithful press will remind people of another round of their fresh agony; and how they were hard done by a heartless ex-cop and a corrupt system of a third world country.
Nothing will be mentioned of Kate clutching of rosaries with resolve to destroy the man, to make him feel pain, and failing miserably in the face of evidence evaluated and accessed by Judges in no less than three Courts of Law cumulating in the total victory for the cop.

Their initiate victory in having the book ban will be regurgitated while all the other facts of the other party's victory will be obliterated...but amidst all that, there just might be a wee chance that the title of the book in question will get mentioned.

Don't forget that Express newspapers were done for libel, Carter Rucked, by the McCanns for £550,000. They may still be cautious, but eventually they will be in a position to claim it back... I hope.

I hope Tony will be too. Or, at least, in a position to sue the McCanns just as Amaral most likely will. Although, I suppose, if the McC's have got any money left over after all these court hearings they will just spend what's left so their victims can't have it.

Didn't they ring fence a large sum in the last audited accounts? Was this not money that must be used in the search and can't be touched for anything else?
I read that this was so it can not be used to pay damages to Goncalo Amaral for instance. Keeping one step ahead at all times and of course there would be a public outcry if the McCanns were forced to sell their house to pay damages, court fees not to mention the Express - in the future of course.

I definitely do not like the term "ring fencing". That has been a term, used in the past, to make people believe that their is a form of security, that is not really there. I have been a victim of it myself.

With regard to libel payout's, can anyone tell me if these are subject to taxation in the UK? I don't understand how it works.

I read somewhere a long time ago in these threads a view that asserted that in Portuguese libel law the onus was on the plaintiff to prove libel or defamation rather than the defendant to disprove it. Can someone with legal knowledge or connections please check this claim - it would be rather important a distinction at this point in time.

AFAIK it's ONLY in the U.K. that the defendant has to proof their innocence. In all or most other countries the plaintiff has to deliver proof of libel.
