Detroit— The 8-year-old sister of Bianca Jones told prosecutors Tuesday about the "hard stick" her father kept in his closet to discipline his children.
The girl then recalled an occasion last year when that tool was used on her 2-year-old sister, Bianca, after the toddler refused to speak.
"One day she wouldn't talk when my dad was asking her questions," the girl said. "She got a whopping."
The child on Tuesday also told Wayne County Assistant Prosecutor Qiana Lillard about a separate time when her father, D'Andre Lane, hit her with the same stick and stuffed a pair of her wet underwear under her tongue after she wet the bed. The incident, she said, tore the underside of her tongue and prevented her from eating because "it burned."
The shocking testimony came during Lane's preliminary examination in Detroit's 36th District Court on charges of felony murder and first-degree child abuse in Bianca's death. The hearing will resume April 27 before Judge Ruth C. Carter.
Bianca was last seen Dec. 2. Her body has not been found.
Lane, 32, has claimed his daughter was in the back seat of his 2004 Mercury Grand Marquis on the morning of Dec. 2 when he was forced out at gunpoint by carjackers at Brush and Carter streets. The car was recovered shortly after, but Bianca was gone.
Lane has maintained he had nothing to do with his daughter's disappearance, but prosecutors say they have "considerable evidence" linking the Detroit father to the abuse and murder of Bianca.
Wayne State University Law School Professor Peter Henning said child witnesses aren't seen often in murder cases, but that it's not uncommon in cases when the death allegedly stems from abuse.
"This is the type of case where you'd be more likely to see a child witness, especially when you don't have a body," he said. "To go on a theory of abuse, prosecutors are going to need other witnesses to the abuse. Unfortunately, that's where the child comes in. They have to build a circumstantial case and the best witness is the child."
Lane's daughter testified Tuesday that she last saw Bianca awake the night before the child disappeared.
That morning, she said, her father carried a silent Bianca to the car covered with an animal-print blanket. He strapped Bianca in next to her and the toddler did not move or make a sound, the girl said.
Lane's daughter testified that she had met her sister only four to five days before she went missing, but the two shared a bedroom, and Bianca had always snored.
Forensic canine expert Martin Grime, who is under contract with the FBI, said Tuesday that he brought in a victim recovery dog two days after Bianca went missing. The dog was able to pick up a cadaver scent inside Lane's car and the girls' bedroom in Lane's home as well as on the blanket Bianca had been covered with and her car seat.
Grime confirmed for defense attorney Victoria Shackelford that the dogs detect only the generic scent of human decomposition. The dogs, he said, cannot determine identity, age, race, gender or the rate of decomposition.
Lane is jailed on a $3 million bond.

A cadaver dog with what handlers call near-perfect accuracy passed 30 cars in an impound lot before alerting on a silver Mercury Grand Marquis driven by a Detroit father charged with killing his 2-year-old daughter.
But defense attorneys for D'Andre Lane, 32, questioned whether the dog's response was authentic because the body of Lane's daughter, Bianca Jones, has not been found.
Prosecutors said Lane, who is on trial in Wayne County County Circuit Court, killed Bianca after a potty-training accident and tried to cover it up by calling police on Dec. 2 to report she was taken in a carjacking.
Police found Lane's car running several blocks away from the alleged carjacking site, but the toddler was missing. Prosecutors say the child is presumed dead.
Dog handler and FBI contractor Martin Grime testified during Lane's trial Wednesday that he and his two English springer spaniels -- Morse and Keela -- flew from England to Washington, D.C., then drove to Detroit on Dec. 4 to search for Bianca.
Local investigators took Grime and Morse, who is trained to detect decomposing human remains, to an enclosed garage at the Detroit Police Department's impound lot. Inside, he released Morse, leading him through a maze of 31 parked cars, including Lane's silver Mercury.
"He went underneath Mr. Lane's car then came out and barked ... like woof-woof-woof-woof-woof-woof-woof," Grime said, adding that he wasn't told that the silver Mercury was Lane's until after the search was complete.
"What was the response what you opened the door and the trunk, sir?" Assistant Prosecutor Carin Goldfarb asked.
"There was a positive response -- the dog barked continuously," he said, adding that the dog didn't bark at any other cars.
He said they then went to a Detroit Police Department evidence room, where investigators wrapped Bianca's car seat in brown paper and hid it in an office within a number of rooms.
Grime said there was no response during the first search, when the car seat was sealed inside the brown paper. He then asked officers to put a slit in the paper and move the car seat to another room.
"The second time, when the dog got close to the package, he put his nose in the package and gave a positive response," Grime said.
Investigators then set up a search in another warehouse using Bianca's blanket that had been in the car seat. Grime said the dog barked when it came across a brown paper bag on the floor with the blanket inside.
"Were you aware of where any of these items were going to be when Morse signaled on them?" Goldfarb asked.
"No," Grime said, adding that he can't force the dog to bark continuously and he never saw the actual car seat or blanket.
Grime said he then took Morse to Lane's house, where Morse sat and barked in Bianca's bedroom, close to the opening of a door-less closet.
"Have the results you've come up with ever been contradicted?" Judge Vonda Evans asked. He said no.
But Lane's attorney, Terry Johnson, raised questions about the dog's ability to detect decomposition during his cross-examination.
"You have no way of telling what Morse responded to at any location?" Johnson asked Grime.
"He gave us a positive response," Morse said. "The corroboration would normally be to find a cadaver or bone or blood that you can see."
"The dog did not give a positive response to the clothing worn by Mr. Lane, correct?" Johnson asked.

Will we have comparisons with this case in the same way we have had with April Jones, I wonder. Missing abducted child, similar to Madeleine has been continuously printed over the past week or so. Now will we have cadaver dogs alert, similar to Madeleine. I won't hold my breath but I will live in hope.

D'Andre Lane Guilty In Murder Of Missing 2-Year-Old Daughter Bianca Jones, Says Jury
DETROIT -- A Detroit father who prosecutors say faked a carjacking to cover up the slaying of his 2-year-old daughter was found guilty Friday of first-degree murder and child abuse.
D'Andre Lane sat silent as the Wayne County Circuit Court jury foreman read the verdicts on both charges. Lane, 32, faces life in prison when sentenced on Nov. 16.
"This has been a very long and very emotional case for everyone involved," Judge Vonda Evans told the court.
Lane told police that his daughter, Bianca Jones, was in the back seat of his car in Detroit's North End neighborhood on Dec. 2 when the vehicle was taken at gunpoint. The car was found less than an hour later, but the girl was no longer inside.
Bianca's body has never been found.
"Nothing is gonna bring her back," said assistant prosecutor Qiana Lillard. "We're just gonna respect the jury's decision, and we're glad they did the right thing."
Prosecutors argued during the trial that Lane beat his daughter to death using a stick wrapped in a towel, disposed of her body, then faked the carjacking to cover up the murder.
Lane, who has fathered seven children with seven women, admitted to officers during questioning that he had spanked the child for wetting herself. Another assistant prosecutor, Carin Goldfarb, told jurors that Lane believed toddlers who have accidents "should be physically punished."
Police and dozens of volunteers scoured city neighborhoods, poking through mounds of trash and in vacant homes and garages calling out Bianca's name. But the searches dwindled after several days and eventually authorities gave up.
The handler of a cadaver-sniffing dog testified at Lane's trial that the dog detected the smell of a body in his car and in Bianca's bedroom.
Defense attorney Terry Johnson said during the trial that prosecutors had uncovered no physical evidence, that Lane had been distraught at his daughter's disappearance and that he had cooperated with police.
"He was as surprised as we were by the verdict, based upon what we believe is a lack of evidence," Johnson said. "We're obviously disappointed. The jury put forth a verdict, and we have to respect that. Mr. Lane still maintains his innocence in this."
An appeals attorney will review the case, he added.

DETROIT -- A Detroit father who prosecutors say faked a carjacking to cover up the slaying of his 2-year-old daughter was found guilty Friday of first-degree murder and child abuse.
D'Andre Lane sat silent as the Wayne County Circuit Court jury foreman read the verdicts on both charges. Lane, 32, faces life in prison when sentenced on Nov. 16.
"This has been a very long and very emotional case for everyone involved," Judge Vonda Evans told the court.
Lane told police that his daughter, Bianca Jones, was in the back seat of his car in Detroit's North End neighborhood on Dec. 2 when the vehicle was taken at gunpoint. The car was found less than an hour later, but the girl was no longer inside.
Bianca's body has never been found.
"Nothing is gonna bring her back," said assistant prosecutor Qiana Lillard. "We're just gonna respect the jury's decision, and we're glad they did the right thing."
Prosecutors argued during the trial that Lane beat his daughter to death using a stick wrapped in a towel, disposed of her body, then faked the carjacking to cover up the murder.
Lane, who has fathered seven children with seven women, admitted to officers during questioning that he had spanked the child for wetting herself. Another assistant prosecutor, Carin Goldfarb, told jurors that Lane believed toddlers who have accidents "should be physically punished."
Police and dozens of volunteers scoured city neighborhoods, poking through mounds of trash and in vacant homes and garages calling out Bianca's name. But the searches dwindled after several days and eventually authorities gave up.
The handler of a cadaver-sniffing dog testified at Lane's trial that the dog detected the smell of a body in his car and in Bianca's bedroom.
Defense attorney Terry Johnson said during the trial that prosecutors had uncovered no physical evidence, that Lane had been distraught at his daughter's disappearance and that he had cooperated with police.
"He was as surprised as we were by the verdict, based upon what we believe is a lack of evidence," Johnson said. "We're obviously disappointed. The jury put forth a verdict, and we have to respect that. Mr. Lane still maintains his innocence in this."
An appeals attorney will review the case, he added.

Gosh, that's amazing. What a triumph for these very, very clever dogs. What would be the point of Police spending thousands of £s training these fantastic doggies if they're findings are dismissed, there would be no point in using them at all. What about all the other doggies trained all over the World for finding dead bodies and people still alive under ruins in earthquakes, sniffer dogs for finding drugs, cash, guns, explosives etc.
They do such tremedous work, and always with their tails wagging. They obviously love the work they do.

The remarks got even more heated when Lane began addressing Evans by her first name, repeatedly calling her "Vonda" and saying "you're a liar" as he was being escorted from the courtroom.
Lane's attorney, Terry L. Johnson, said his client lashed out because he's "upset" and "emotional."
"It was out of character…he was just sentenced to life in prison," Johnson told reporters after the hearing.
Johnson, moments earlier, had urged the judge to grant Lane a new trial, saying there was no evidence to support the conviction, which was a "trial by media," he said.
Lane's defense team at the trial contended that prosecution couldn't prove the father of seven children from seven different women abused or killed Bianca since her body hasn't been found.
Lane has claimed Bianca was in the back seat of his 2004 Mercury Grand Marquis that December morning when he was approached by armed carjackers near Brush Street and Grand River. The car was recovered shortly after, but the girl was not inside. Lane did not call 911.
Bianca's mother, Banika Jones, also addressed the court Monday, saying she was "cheated" by the justice system.
"They never looked for my daughter," she claimed. "They never really cared, they only wanted evidence and a conviction and to close out the case without solving it.
"I want the court to know they made a mistake, and I intend to correct it."
But Wayne County Assistant Prosecutor Carin Goldfarb said the people responsible for caring for Bianca failed and that the jury returned a "correct" verdict.
At trial, Lane's housemates testified that the child had been disciplined with a hard stick wrapped in duct tape in the overnight hours prior to her disappearance.
Lane, in a five-hour videotaped interview with police, admitted he disciplined the child with the stick and said Bianca hadn't slept well after she fell out of bed and hit her head around 1 a.m. He claimed he then used the stick to keep her up.
A contentious piece of evidence in the circumstantial case was testimony from forensic canine expert Martin Grime whose cadaver-sniffing dog allegedly hit on human decomposition in Lane's car and Mitchell Street home two days after Bianca went missing.
Johnson attacked the relatively new scientific method, noting Grime admitted there's no methodology to confirm the response — barking — is accurate when nothing is recovered
Jurors deliberated for more than seven hours before reaching a verdict in the monthlong trial.
Johnson said Monday that an appeals attorney is expected to review Lane's case.

I have no law background, so forgive my ignorance if this is a silly question, but...
Is it absolutely, categorically imperative that further, supporting evidence is required to convict (in the UK and/or Portugal) when cadaver dogs have identified human cadaver?
I ask this, as it just seems that other countries are able to convict without supporting evidence or indeed finding a body.
Is it not in the interests of SY and the Government to introduce an amendment of sorts (sorry for the laypersons terms!) that could allow for Eddie and Keela's evidence to be heard on behalf of a prosecution?
All very simple I know, but there really has to be a 'sea change' at some point........ doesn't there??
