Re: FAO CARTER RUCK
What astonished me about this particular case is the Alice in Wonderland aspect of it.
That is legally OK if it was never going to be heard, and TB was simply going to accept liability (even if under duress and with his fingers crossed) but the judge in this case has now asked for some evidence to be adduced.
Which turns it into a strange and legally, as well as morally, indefensible situation.
One morally and probably legally correct thing to do would be to set aside the proceedings so far, and let the Plaintiff decide whether to start again.
I hope that TB or his spokesman gets to address the judge on this point.
Here we have TB forced to make an offer of money, and then to return for a hearing about costs, when the evidence was never heard."'Let the jury consider their verdict,' the King said, for about the twentieth time that day.
'No, no!' said the Queen. 'Sentence first - verdict afterwards.'
'Stuff and nonsense!' said Alice loudly. 'The idea of having the sentence first!'
'Hold your tongue!' said the Queen, turning purple.
'I won't!' said Alice."

Cannot recall where on this forum I posted some weeks ago, my thoughts that this whole damned saga is like falling down a rabbit hole into some parallel universe.
