Documented Evidence - Page 17 Empty Who rented 5A after the McCann's

After Madeleine was reported missing, Apartment 5A stood empty for a month. In early June 2007, a family rented the apartment for a week. Then, a second family rented Apartment 5A for a fortnight (probably until about the end of June 2007). Thereafter, the apartment become a permanent crime scene until 2008. Does anyone know the names and particulars of these two family's? Lastly, were they from the UK? This information may be of huge importance. Thanks.

- At the Ocean Club, apartment 5A had been booked for the nights of 28 April through 4 May (vacating on 5th); the family stayed in apartment 4G from 4 May through 2 July (vacating on 3rd)
- Apartment 5A was subsequently let between 12 and 19 June (to friends of the owner); 28 June to 12 July (to three people with Irish names); 12 to 19 July (to an English couple) and 19 to 26 July (to a family with Southern Asian names).

Examination initiated on 06 May 2007


The report on the collection of blood vestiges carried out on 06 May 2007, from the wall, next to the main entrance of Quinta dos Figos, situated on Rua 1 de Maio, in Praia da Luz, in Lagos, is requested.

Observations and Analyses Made

A team from the Crime Scene section of the Scientific Police Laboratory, composed of the undersigned officers, after a request made by the Portimao DIC of the Policia Judiciaria, went to Rua 1 de Maio, in Praia da Luz, in Lagos, where we were requested to proceed to collect various stains, supposedly haematic that were on the wall and the ground in that street. This collection was within the area of investigation into the disappearance of an English girl.

Upon the team's arrival at the scene it was reported to us by the inspectors present that the supposed blood stains were found on a wall and on the ground close to the wall, next to main entrance of Quinta dos Figos

From the observation made of the wall and its proximities various stains were detected with a brownish red colour which suggested that they could be of haematic origin. These were submitted to tests to detect peroxide existing in the blood using the Kastle-Mayer test, in both cases the reactions were positive.

The stain referred to as vestige no. 3 was further submitted for testing to determine whether the blood was of animal origin, but reacted positively as being human blood.

The blood stains mentioned previously were separated by zones and referenced as vestige no. 1 those being the stains found on the gravel ground, vestiges no. 2 being the blood stains that were found on top of the wall and vestige no. 3 as being the stains that were found on the ground in the area where there cobblestones.

The collection of the vestiges indicated as vestiges nos. 1, 2 and 3 was begun using slightly moistened swabs, in accordance with the procedures of the Scientific Police Laboratory's Biology Area.

Conclusion:

Upon the request of the Portimao DIC present at the site, collection was made of 3 swabs containing blood vestiges, referred to in this report as vestiges nos. 1,2 and 3, which were delivered to the Biology Area, by means of delivery guide no. 189/2007 - CR/L, copy of which is annexed, in order to be preserved for further/eventual forensic examinations.

The test for the determination of animal species carried out on vestige 3 was placed in an evidence bag series A no. 022917 and delivered to the Portimao DIC.

Letter to the National Forensics Institute (INML) from Goncalo Amaral


17th August 2007

The present inquiry is in relation to the investigation of the disappearance of Madeleine McCann on 3rd May from P da L.

The English authorities in possession of elements collected from the family home in Leicestershire, which are being examined in an unidentified laboratory, traced the girl's DNA profile, in annex to this document.

As it is necessary to the investigation we request the following:

1. Whether in the tests done by the INML Madeleine's profile was established?

2. In the case of a positive answer to point 1, that it should be determined whether the girl is the daughter of the parents identified ? Gerald Patrick McCann and Kate Healy.

3. Information about whether the profile obtained by the INML corresponds to the profile traced in the English laboratory, on the request of the British authorities.

4. If there are differences between the English and Portuguese profiles that a report should be drawn up for this inquiry.

5. In the follow-up of point 4, we request to be informed whether in the English profile the girl is the daughter of the McCann couple.

6. Other information that might be of use to the investigation.

Reply to Queries

- We inform you that none of the samples received by this institute were designated as supposedly belonging to the missing girl and we therefore, cannot reply to this query.


- Samples were studied - hair and a piece of cloth - nuclear DNA profiles only being obtained from 4 samples, which upon comparison with the DNA profiles of Kate and Gerry, could not belong to the girl.

- The samples were then studied using mitochondrial DNA analysis, the same was done for the other samples, giving the results in accordance with our report of 9th July No. 2007/000226 LX-BC.

- As requested in point 5, it was determined that the profile obtained by the British lab could belong to a son/daughter of the McCanns.

- The comparison of the profiles obtained in autossomic STR from Kate and Gerry McCann with the profile obtained was carried out.

OFICIO No. 13453 /I /2007 dated 15/05/2007, that says to proceed to deliver the bucal swabs recovered from Matthew David Oldfield, Jane Michelle Tanner, Gerald Patrick Mccann, Kate Marie Healy, with delivery note no. 170C/2007-CR/L and relevant official documents from the Departamento de Investigacao Criminal de Portimao da Policia Judiciaria.

OFICIO No. 001803 dated 17/05/07, that says "to remit bucal swabs recovered from individuals, asking for comparisons of DNA profiles with those from biological traces recovered from various locations, as part of the present legal documents", accompanied by relevant official documents from the Departamento de lnvestigacao Criminal de Portimao da Polícia Judiciaria.

Fragment of cloth, mauve/violet in colour with square motifs, circular in form about 10cm in diameter. A small fluorescent spot is observed under a Crime-light.

- Autosomic STRs: D3S1358, HUMTH01, D21S11, D18S51, Penta E, D5S818, D13S317, D7S820, D16S539, CSFlPO, Penta D, HUMVWA31/A, D8S1179, TPOX, HUMFIBRA/FGA, and Amelogene using the primers and the conditions of amplification suggested in kit PowerPlex(tm)16 System (Promega).

5-Mitochondrial DNA study

The following methodology was used in the Mitochondrial DNA study:

PCR Amplification:

PCR Amplification of the human mtDNA regions HVI and HVII, using specified primers and amplification conditions in accordance with Vigilant et al., 1989 [4] e Wilson et al., 1995 [5], Alvarez-lglesias et al., [6].

Direct sequenciation of the HVI e HVll segments by capilar electrophoresis in "ABI PRISM 3100 ou 3130 Genetic Analyser" (Applied Biosystems) automated sequenciator with fluorescent detection using the following kits:

- "BigDye(R) Terminator vl.1 Cycle Sequencing" (Applied Biosystems)
- "BigDye(R) Terminator v1.3 Cycle Sequencing" (Applied Biosystems)
- "dRhodamine Terminator Cycle Sequencing Ready Reaction" (Applied Biosystems)

The programme "SeqScape(R) Software Version 2.0" (Applied Biosystems) was used for comparison of the sequences obtained from the analysed samples with the CRS (Cambridge Reference Sequence).


RESULTS


1- Morphology analysis of the hairs

All hairs received for analysis were subjected to macro- and microscopic characterisation, with the majority of those having the root being in a telogenic phase.

- Envelope no. 6 - "recovered from the floor of the lounge" 26 hairs with root; 4 hairs only stem; l hair non-human.

- Envelope no. 7 - "recovered from the entrance hall at the front door of the apartment" 44 hairs with root; 8 hairs only stem; 6 hairs non-human.

Relating to the Volkswagen 44-77-KD

Relating to the Residencia Casa Liliana - Praia da Luz-Lagos:

- were obtained from: hair root CEnv 7-51 recovered in the apartment (entrance hall-Env.7), hair root PVT07 recovered in the vehicle (floor in front of rear seat Env.4), hair root C742-05 recovered in the vehicle (floor in front of the front seat-Env. 3) and the small spot on the piece of cloth (recovered from the bedspread of the bed next to the window in the children's bedroom Env.5).

CONCLUSIONS


1st- The macro- and microscopic analysis of 257 hairs revealed 245 human and 12 non-human.

2nd- With respect to autosomic STRs the genetic profiles of the following analysed samples matched with the reference sample indicated:

- hair root CEnv 7-51 recovered in the apartment (entrance hall-Env.7) matched with Gerald McCann, father of the victim.

- hair root PVT07 recovered in the vehicle (floor in front of rear seat Env.4) match with Robert James Queriol Eveleigh Murat.

3rd- With respect to autosomic STRs the female genetic profile identified from hair root C742-05 recovered in the vehicle (floor in front of the front seat- Env 3) did not match any profile from the reference samples.

4th- With respect to autosomic STRs the male genetic profile identified from the spot on the cloth fragment (bedspread of the bed next to window in the children's bedroom- Env 5) did not match any profile from the reference samples.

5th- In the samples from apartment 5-A, several mitochondrial DNA profiles were found:

- Profile identified by letter "C", present in 53 samples, was identical to that of Kate Healy, mother of the victim, meaning those samples were from her or from someone having the same maternal bloodline.

- Profile identified by letter "N", present in 24 samples, was identical to that of Gerald McCann, father of the victim, meaning those samples were from him or from someone having the same maternal bloodline.

- Profile identified by letter "G", present in 1 samples, was identical to that of Matthew David Oldfield, meaning that sample was from him or from someone having the same maternal bloodline.

- Profile identified by letter "I", present in 1 samples, was identical to that of David Anthony Payne, meaning that sample was from him or from someone having the same maternal bloodline.

- Profile identified by letter "O", present in 2 samples, was identical to that of Russell James O'Brien, meaning those samples were from him or from someone having the same maternal bloodline.

- Profile identified by letter "L", present in the spot on the bedspread of the bed next to the window and in seven hairs, meaning that all these samples came from the same person or from someone having the same maternal bloodline, did not match any of the reference samples.

- Profiles identified by letters "B", "D", "F", "J" and "Q" are different from the above, and from each other, and are distinct from reference samples.

6th- In the samples analysed from Residencia Liliana and the vehicle, several mitochondrial DNA profiles were found:

- Profile identified by letter "M", present in 48 samples (35 from Residencia Liliana and 13 from the vehicle), was identical to that of Robert James Queriol Eveleigh Murat meaning those samples were from him or from someone having the same maternal bloodline.

- Profile identified by letter "K", present in 14 samples (1 from Residencia Liliana and 13 from the vehicle), meaning that all these samples came from the same person or from someone having the same maternal bloodline, did not match any of the reference samples.

- One of the 13 samples from the vehicle in letter "K" - hair root C742-05 (floor in front of the front seat - Env 3) showed a female DNA genetic profile.

7th- The remaining 28 samples analysed, of which 17 were recovered from the apartment, showed mitochondrial DNA from different from each other, and distinct from those above.

8th- Of the 245 hairs analysed, no results were obtained from 52.

The present inquiry deals with the investigation into the disappearance of the British girl, Madeleine McCann, a fact that occurred on 3rd May 2007 in Praia da Luz, Lagos.

During the course of the investigation diverse material/articles and objects susceptible to containing biological vestiges have been collected.

At the beginning of this month of August a curtain was collected from the living room of the apartment including a portion from the same pair of curtains, materials that were sent to England with other articles/objects for subjection to examination.

With the aim of preserving and maintaining the CHAIN and CUSTODY of evidence during the lack of conclusion from the examinations that are being carried out in England, the remaining inferior part of the curtain was collected.

Place: Apartment 5 A, Ocean Club Resort, Praia da Luz

Accordingly we request that the piece collected and delivered to the Police Scientific Laboratory be PRESERVED for the eventual carrying out of complementary examinations.

As you will know, Sir, on this day at 11h30, there appeared before the undersigned and (lady) Inspector Patricia Duarte, a British citizen called Diane Webster, holder of UK passport XXXXXXX, in order to hear her witness statement.

In the course of an informal approach that proceeded that work, it was determined that she was not conversant in Portuguese, written or spoken, and the service of an English-speaking interpreter was therefore called for.

In this function appeared a British citizen, Robert J.Q.E. Murat (duly identified in the files from previous work), official resident of Casa Liliana, Rua Ramalhete, Praia da Luz, Lagos.

The work [the DW interview] being concluded, and during an informal conversation that the undersigned began with that interpreter (as would be characteristic in this type of situation), Robert Murat displayed an unusual curiosity about the investigation that was developing around the disappearance of the minor Madeleine McCann that occurred on 3 May 2007.

As an example, it will be proper to point out that he has insistently and repeatedly questioned me about the identity of possible suspects, about the strategy outlined by the lead coordinator of the investigation and the work that might possibly have been considered for the coming days.
Before [faced with] such an attitude, that was so unusual and absolutely inappropriate that I immediately became highly suspicious, I always countered [ducked the questions], insistently requesting that person to be aware of the contractual duties pertaining to the role which he has assumed in this investigation, pointing out that it was presently the inquiry phase, and, naturally, covered by judicial secrecy.

The above mentioned suspicions were made even stronger when I realized that Robert Murat was trying, in a persistent and dissimulated manner, to look at the various procedural documents that compose the present enquiry while I was consulting them in preparation for the Dianne Webster interview.

Finally, and in the sense of reiterating the suspicious attitude shown by Robert Murat, I venture still to state that, beyond having manifested an enormous knowledge about the dynamics inherent in the functioning of the "Ocean Club Garden" (in which the events under investigation had taken place) and of the routines followed by the McCann family and their companions during their respective stays in in Praia da Luz, he has tried persistently to influence the conduct of the present investigation, suggesting various analyses the agreement with which [i.e. had they agreed to follow those suggested lines of inquiry] could be intended to impute the consummation of the present illegal act [the missing child] to foreign third parties [i.e. to put the blame on, or to attribute the blame to, outside foreigners].

The above being exposed [laid bare] - and without intending in any way to place in question the competence of the above individual, nor the slightest imputation that that [my suspicions] was what he wanted to be [actually intended to do] - I have to bring the above incidents to your attention, in order for you to determine what may be appropriate.11 May 2007

External Diligence 12 May 2007 in Lagos

- From the items collected and conveyed in the case file documents pertaining to RJQE Murat, we determine that he makes use of a vehicle "VW Transporter", green, licence plate 44-77-KD.

- After finding the vehicle we mounted surveillance at Rua Agostinho ... Luz where the vehicle was parked.

- At 12h40 the observed person was seen leaving the house, getting into the vehicle and going to the town centre, stopping at Rua 1 de Maio, where he engages in conversation with various people, in our view, in a casual manner, like someone explaining something.

- At 13h05 the target goes to a roadside bench sited in Rua 1 de Maio, Luz. In this place he speaks with an elderly woman who was there in order to gather information about the disappearance of the child. This bench, it was clearly said in the media, is being attended by a lady who is in Portugal for several years, and who was there to receive information about Madeleine from people who had some reluctance to communicate it to the authorities. This woman is the mother of the observed person and identifies herself as JA Murat.

- Soon after the observed person goes to the pastelaria "Dom Doce" where he bought food that he took to the lady, his mother, very soon after, peeping into a vehicle that was also parked there, a Peugeot 206, licence RI-96-03.

- At 13h11 the target gets into his vehicle and leaves in the direction of Lagos. About 13h22 he parks the vehicle in Rua Adelina ... Lagos and goes inside number 8.

At 15h09 the observed person leaves in the car and proceeds to Rua Joao Moniz Nogueira, Lagos, parks the vehicle and enters lot B.
Some minutes later, 15h35, the target gets back into the vehicle and proceeds in the direction of the town of Luz.

- At 15h54 the observed person parks the vehicle near to "Casa Liliana" a little further along from where it was during the night, going then inside the Villa.

- At 16h41 he gets back into the vehicle and drives off to the centre of town, stopping next to the above-mentioned "Dom Doce".
Six minutes later, 16h47, he goes to an ATM of Caixa Credito Agricola situated at no. 2-4, Travessa 1 de Maio. He begins a conversation with someone, both speaking in English.

- At 17h01 the observed person and the above-mentioned lady load the bench and other equipment into the VW.

At 17h06 the target walks to Rua 1 de Maio, going down, coming to meet an individual about 180cm tall, thin, wearing glasses and an orange T-shirt.

At 17h09 he enters the premises of the car rental agency "Auto Vermietung - auto rent III" in the Largo da Igreja [church square], Luz.
About 17h16 the observed person leaves the rent-a-car and gets into a vehicle, Hyundai Getz, blue, licence 60-AX-86, going to Rua 1 de Maio where he stops next to the pastelaria "Dom Doce", entering this place accompanied by the bench lady.

At 17h48 the observed person goes in the Hyundai and stops in Rua Direita where he goes to "Batista" supermarket.

At 17h58 he leaves "Batista" proceeding to the EN125 and later to the A22, Portimao direction [direction: from West to East].

At 18h26 he parks the vehicle in the car park next to the Portimonense stadium in Portimao and, now on foot, at 18h31 enters the premises of the police.

At 20h52 he leaves the police station, goes to the vehicle and proceeds to Lagos.

At 21h16 he stops next to number 8 Rua Adelina ... Lagos and collects a woman who was waiting there for him. Then he proceeds in the direction of Praia da Luz and Burgau.

At 21h37 he goes along the detour of Praia da Cabana Velha, turns round and enters the Restaurant "D. Dinis".

At 23h35 the observed person, together with the woman, leaves the restaurant returning to Praia da Luz in the vehicle, there going ahead of him the other vehicle already referred to, the Peugeot, licence RI-96-03, which was transporting the elderly lady who was on the bench.

At 23h45 the target in his vehicle and the Peugeot RI-96-03 arrive at Rua Agostino ... Luz, opening the gates to Casa Liliana and parking the Peugeot inside. The target and his companion then go, in the Hyundai, to the centre of Praia da Luz.

At 00h47 the observed person releases [drops off] the woman who accompanied him next to number 8 Rua Adelina ... Lagos, heading shortly after to Luz.

At 00h55 the observed person parked the vehicle next to the gate of Casa Liliana, entering the house.

Sir:

Relating to the present investigation related to the disappearance which occurred on the 03 of May of 2007, in the temporal hiatus between 21H05 and 22H00, of a child which turned four years of age last Saturday, identified as Madeleine McCann, and who was staying in apartment 5-A, block 5, of the establishment 'Luz Ocean Club,' herein referred to as LOC.

Conforming to the results of the initial participation, the minor's parents, Gerald McCann and Kate Healy, were enjoying holidays in our country, together with a group of citizens, also British, for a total of nine adults and eight children. They arrived on the 28th of April, having booked their return for the 05th of May. On the day in which the facts are reported, the parents, as was usual, went to dinner, together with the rest of the group, to a restaurant in the interior of the resort, known as 'Tapas', whose distance is around 50 metres from the apartment where Madeleine lay sleeping, and her twins siblings of two years of age. As was habitual, around 21H05 the father, Gerald, went to see the children, having entered through the sliding door at the back of the above referenced apartment, which always remained unlocked so as to facilitate the access to/from the restaurant and the pool. After checking, although briefly, he verified that this three children were in perfect conditions, sleeping profoundly, although the door to their room was more open than was normal. Upon returning, he established a conversation with a friend, with whom he played tennis that afternoon, at the same time that one of the elements of the group, Jane Tanner, when she was walking up lateral artery of the apartment, she saw the back of an individual with a child in his arms, not being able to ascertain if it was little Madeleine. Because she did not have knowledge of the disappearance, given that the alarm was raised an hour later, although finding it strange, she did not comment on what she had seen. Around 21H30/21H35, another element of the group, Matt, went to check on Madeleine's apartment among others, not having entered the children's bedroom, yet related, laconically, that there was light in the room. He also entered via the sliding door, which was, as already mentioned, always unlocked. He states that everything was well, although he had not seen the missing child. Around 22H00, when the mother, Kate, went to go check on the children, she saw the door to the children's room completely open, the window also open and the curtains drawn to the side, which did not correspond with how they left everything closed. She verified that Madeleine could not be found. She searched for her daughter instantly in the interior of the apartment, confirming that she was not there. Immediately, she advised the rest of the elements of the group she was dining with, and they extended the searches with auxiliaries of the LOC, and contacted the local authorities who would alert this police.

Immediately, diligences were begun to localise the child, on the day of the occurrence and on subsequent days, using impressive means in a insistent and repeated way.

We followed all leads, viable and non-viable, using search-dogs and other means of search and detection. Even with this titanic force, it was not possible, in the investigation, to localise the missing child.

Of the many elements collected, and pointing out, that at this moment in the investigation, the occurrence of an unusual situation, relative to an individual identified as Robert James Queriol Eveleigh Murat.

This individual, voluntarily, went to the GNR post alleging that he was an interpreter of the English language, and could be useful in helping to realise diligences. He was directed to the elements of this police which were at the locale. Right on this day and on the following days, he helped in various diligences realised by this police, namely in the inquires of the British functionaries of the LOC.

At this point in time we noted immediately a strange comportment, especially with the press/media, alleging that he did not want to be photographed, or to make allusions to this presence.

We stress that at this time, we were contacted by various journalists, who alleged that they had noticed his strange comportment, and that he showed himself to be extremely curious. When they tired to capture his picture, he repudiated this vehemently, alleging that he was father to a little girl, the same age as Madeleine and was in the middle of a divorce.

Confronted with this incoherent comportment, Robert Murat, showed much nervousness and offered to stop providing services, if that was our desire.

For the investigative strategy, in order to better control and collect relevant elements, we opted to continue to use his services. Also via communication with the Leicester police authorities, the locale where the McCann family lives in the U.K., we were informed that an English reporter had suspicions regarding Robert, for the reason of his evasive comportment when she tried to take his picture and from a telephone call, which he said was to his daughter, making it in a loud voice, as if he wanted to demonstrate something.

The target resides in Vila da Luz, and while this is not binding, that the route of the observed suspect by the testimony of Jane, went in the direction of his home. He has knowledge of the area where the facts occurred, enabling him to circulate among, to sway [influence] and to educate (figuratively speaking) the natives and people that are there on their holidays.

It is also stressed that some of the routes taken by foot by Madeleine and her family, went through the locale where he lives. It is further added that reported in the present investigation is anonymous information, alerting us to the eventuality of the abductor being found in a residence of the locale in proximity to block 5, and the same accesses various sites of a sexual nature, trading, inclusively, encrypted communications.

Thus, suspicions fall on the target and for this reason sir, I am requesting that you suggest to the Magistrate to issue search warrants for his below referenced homes, given that only with such legal instruments is it possible to progress the investigation:

1. RUA AMALHETE, CASA LILIANA, LUZ, LAGOS, residence of the observed person and his mother, JA Murat, given that they live together.

Conclusion 13-05-2007


From the process files (pages 995 – 998) results the founded suspicion that the suspect Robert Murat could be the author of the abduction being investigated.

A search of the residences used by the suspect was required, this diligence being essential for acquiring evidence.

As this diligence is essential for the acquisition of evidence and in ordering the search warrant as promoted by the magistrate of the Public Ministry as being covered by the provisions of Art 174 n° 2 of the CPP which determines the granting of these warrants as laid down in articles 174 n° 2 and 3, 177 n° 1 and 269 n° 1a) from the CPP:

I determine that search of the premises should be made, carried out by the PJ within the scope of the ongoing investigation, under suspicion of the practice of the crime of abduction at the residences of the suspect, Robert Murat.

- in Rua Ramalhete, Casa Liliana, Luz, Lagos, residence of the suspect and his mother Jennifer Murat, where they both live and the annexes:
- Rua Joaoa Moniz Nogueira, plot B3 in Lagos;
- Rua Adelina de Gloria Berger, plot 8 1 C in Lagos, residence of Michaela Walczuch.

I also order searches in the following sites:

- Rua Garret n°19 in Lagos.
- Rua Lima Leitao n°19, ground floor in Lagos.

As well as search warrants for the vehicles:


- VW Transporter, number plate 44-77-KD
- Peugeot 205 number plate RI-96-03
- Hiundai Getz number plate 60-AX-86

Proceed to issue the search warrants with the mention that, in the course of the authorised search the rules and limitations foreseen in articles n°176 and n°1 of 177 of the CPP should be observed.

Because it is useful for the purposes of the ongoing investigation, under the conditions of article 269 n°1c and 2, 187, 1 and 188 of the CPP, I determine the procedure of the interception and taping of telephone conversations or any other kind of communication made from or too the following numbers 91 918 84 41 (TMN number) 91 368 75 18, 91 746 23 08 and 91 988 19 59 (TMN number) during the period of 15 days.

Each respective operator should be requested to provide a detailed invoice in digital form, register of trace back and location of the mobile phones with the abovementioned numbers relating to the period from 25th April 2007 to the current date, as well as the interception of IMEIS where the numbers operate or are seen to operate.

This information should be sent directly to the PJ, guaranteeing confidentiality for the operator.

Resulting from the process files, given that in the inquiries already carried out there are indications that are consistent with the abovementioned suspect having been identified as the author of the abduction referred to in the process files.

This action is susceptible of including the practice of child trafficking.

The crime referred to is classed in article 1 n° 1 of Law n° 5/2002(a).


As it is obvious that the diligence in question has great interest for establishing the facts being investigated given their nature, authorisation is given to collect images and voice recordings by means of video relating to the movements of the suspect on national territory (n° 1 of article 6 of law 5/2002, 11th Jan).

I hereby authorise the collection of image and voice recordings by means of video relating to the suspect's movements for 30 days, whilst observing legal formalities.

The image and voice recordings should be submitted for judgement after ten days of collection and the requirements of art 188 n°1 of the CPP should be observed.

Reply 'The door to the bedroom, the twins bedroom and Madeleines bedroom, erm and I mean afterwards you know, he said he thought that was unusual because he thought the door would be shut, cos I mean we always shut Graces bedroom door, erm or at least if we did, I mean we always shut it but yeah I know some people would kind of probably just pull the door to, but he didnt expect it to be as wide open as it was, erm so he, well he said you know from kind of standing close to the doorway, he could see that the twins were in their cots and there was no sound, erm so he just assumed everything was alright, he didnt put his head round the door to see if Madeleine was in her bed, but he said he did wonder where she slept, erm poked his head, well you know kind of looked into Gerry and Kates room, just saw there was a double bed there, so you know, assumed they were all in together or, I mean I think he knew that they were all in together, erm but he didnt actually look to see whether Madeleine was there or not'.






He didn't put his head round the door to see if Madeleine was in bed, but he did wonder where she slept!!!

So he knew where Madeleine's bed was, and he knew she wasn't in it, otherwise why did he go and look in the main bedroom.

This seems a radical departure from normality.

I've heard and taken on board all the arguments put forward in the past that might explain why the McCanns in particular and ? other group members needed pay-as-you-go mobile phones.  You know, the kind of phone that can't be traced to ownership.

I remain unconvinced.

If you forgot to take the charger with you on holiday (both? All of you?), you can buy a charger, you can borrow a charger - feeble!  The group spent the week making telephone calls according to their respective stories and they managed to spend the night of 3rd/4th May 2007 and following days making telephone calls, mostly to the UK, many of which were deleted according to official reports.  Phoning, texting and taking photographs - apparently!

The enigmatic Matt Oldfield, or perhaps one could say the silent witness or mime artiste, he's never been the focus as regards the police investigation but he nonetheless plays a major part in the theatrics.

What bookcase?

An inconsequential point in itself but added to all the other minor points, it starts to look like a massive deception.  Can we believe a single word uttered by Messrs McCann without supporting evidence?

Matt Oldfield witness statement - 4th May 2007

At around 9.25pm, the interviewee went into his apartment and Madeleine's apartment to check on the children. He states that the door of the bedroom that was occupied by Madeleine and the twins, was open and that there was enough light in the bedroom for him to see the twins in their cots. That he couldn't see the bed occupied by Madeleine, but as it was all quiet, he deduced that she was sleeping. That the light was not from an artificial source inside the apartment, but perhaps something coming from outside through the bedroom window. That it seemed to him that the shutters of the Master' bedroom window were open without knowing if the window was also open.

The apartment has two bedrooms, a lounge, a small kitchen and a bathroom. The couple's bedroom has a window which is visible from the restaurant. The children's bedroom windows look out on the road outside the tourist complex. Then the interviewee went back to the restaurant.

He states that the bedroom has two windows. The twins occupy two cots placed in the middle of the room and Madeleine occupies a bed pushed against the wall, facing the wall which has the two windows that look out onto the outside of the complex. That the door through which he entered the apartment was closed but not locked. That he doesn't know if it is usual for Madeleine's parents to leave the door closed but not locked because that door is visible from the restaurant.

Matt Oldfield witness statement 10th May 2007

That he did not enter the bedroom where MBM and the twins were sleeping. He recalls that the bedroom door was half open, making an angle of 50 degrees. He does not know how far away he was from the bedroom door. He recalls having the perception that the window curtains - green in colour - were drawn closed but could not determine if the window was closed or open. Concerning the external blinds he clarifies that he did not see if it was closed or open. He recalls having thought that in that bedroom there was more brightness than there was in his daughter's room (where the external blinds were always fully closed), adding to have had the feeling that that light was coming from the outside - making the point that both were turned in the same direction.

Consequently, he admits the possibility of the light he was perceiving was owing to the blinds being raised, denying however that he was capable of assessing the height at which it may have been.

The question asked, he was sure that, at the time of his first being in the vicinity of MBM's bedroom, reported as 21h05 in the course of which he had approached the the window of that bedroom from the outside for the purpose of an auditory check, the blinds were, in his view, fully closed.

Consequently, he is convinced that at the time of the second check the blinds were more open than on the first check, given that he considers that the light inside the bedroom, undoubtedly coming from the outside, could not have been coming through it [the blinds] if they had been fully closed.

Matt Oldfield rogatory interview - April 2008

So I went back and did the check on five 'A', on Madeleine and the kids, erm, and went back through the patio entrance, so through the gate, through the patio doors, erm, there was, it was light enough to see through the apartment and there sort of a little table light on the right at the end of the sofa and when you walk into the room, you could see straight into it, because the door was open. Erm, I've spent a lot of time debating how far the door was open, from previous questioning, and, you know, it wasn't flat back against the wall, because that would have looked odd, it was just sort of halfway open, so it seemed slightly unusual that it should be so wide open, because you could see straight into the middle of the room from the angle that you approach it, because the, you've got sofas here and you've got a bookcase here and you have to come out, you've got sort of the wall of the bedroom and then it goes back where the bathroom is and then comes out again, so you've got to come out round this wall to sort of, not out round this wall, but you come in and the doorway is sort of recessed, so you can see pretty much straight into the room from the doorway back or certainly as soon as you get past that final wall. So it seemed odd to have that door open, it's certainly not something that, you know

So, aside from open/closed windows/doors/shutters/curtains swinging and fluttering - where is the elusive bookcase?

Folk generally pack a book or to for light reading whilst on holiday .... 'Harry Potter' - 'madeleine by KATE MCCANN' - 'Noddy Goes to Toy Town' - 'Germanman: My Part in His Downfall by J Clarke' - 'The Anatomy of Murder' - 'A Dummies Guide to Advanced Jigsaw Puzzles' - but does that warrant a bookcase in a comparatively small holiday apartment, generally occupied for one or two weeks?

Where is the bookcase anyway?

The Burglar-gone-wrong must have stolen the bookcase.  But obviously Madeleine was hiding or sleeping on a high shelf, and got inadvertently carried out at the same time, and then fell out into the deep trench as he went down the stairs and squeezed past Gerry and Jez on the pavement, and got jostled as Jane pushed past them all.

In total frustration, I contacted our local police to ask for help and advice but unfortunately they were not able to help us.

Sandy began to search for phone contacts on the computer and there were phone calls back and forth to Portugal and to the Embassy in Lisbon. I think Kate had called her aunt and uncle. I was left with the task of informing our family here. As my mother is quite vulnerable and fragile I decided to give her the news personally. That was one of the worst things I have ever had to do. We sat in her apartment feeling incredulous, wondering what to do next.


I feel the necessity of contacting the media and called the BBC, gave an interview to a reporter and afterwards there were more reporters and more interviews. Sandy stayed at home to coordinate things. We tried desperately to get plane tickets. It was not possible to get a flight from Glasgow, the only solution was to fly from Manchester.

We went to Manchester and stayed at a friends house before catching the first flight of the morning, on Saturday 5th May 2007.

We arrived in Portugal on Saturday morning, where a friend lent us a car to use and we went to Praia da Luz. My first impression was that everything was busy, but there was also a surreal sensation of passivity. Kates mother and father were already there.

4078 'Is there anything that you can think of, worthy of mention, up until the Wednesday night before we move onto the Thursday''
Reply 'Erm, no, my initial thought is there's nothing that's leapt out that I haven't mentioned before. Erm, I mean, there was no sort of strange people or anything unusual with the, with the flat. Some people had, I mean, gardeners came round to trim the gardens once or twice, or maybe just once a week, I mean, because we were there for three weeks, maybe they came round slightly more. Erm, somebody had workmen in maybe during, the shutter we broke, the shutter, erm, broke for, the outside shutter by the patio door broke for us on the first day, I think it went back up into its, so you couldn't actually drop it on the outside, the shutter by the patio, but we didn't drop that anyway, erm, until we got in at night, but I think it broke and it had to be, and I think they did come, yes, they did come and repair it. But apart from that there wasn't really anybody else (inaudible)'.




Pity there is no worksheet to say when the shutter was repaired.

A worksheet perhaps not but there is the maintenance worker's witness statement, I don't doubt the PJ thoroughly investigated the routine maintenance records.

. Questioned, the deponent states that in the scope of his functions and the day before the disappearance of the child, he only came into contact with the mother of the same, whose name he does not know;
. This happened on Tuesday, the first of May, in the sequence of a service that he had to carry out in the apartment where this family was staying, also known as Block G5, Letter A;
. This serviced was carried out between 10H00 and 11H00, together with his colleague who is named Mario, and consisted of the repair of a blind in the room of the parents of the minor;
. In this sequence, the deponent and his colleague also taught the mother of the child how to operate the washing machine;

. Questioned, the deponent states that days before the disappearance of the little girl, no one spoke to him strangely about the tourists, the children which accompanied them or other facilities of the resort. He also did not hear conversations of this nature with other persons;
. Regarding the presence of people or persons which presented with a strange conduct near the resort, in the past with special attention to the disappearance of the child, the deponent states that he noted nothing abnormal;
. States that only about four months ago he noticed the presence of three gypsies close to a resort warehouse, situated close to the Millenium Restaurant, who were taking existing firewood from there;
. The deponent knows that in that resort zone, as it is a zone of warehouse and also little traffic, it is frequented by individuals of gypsy origin looking for scrap;
. Various robberies have already occurred in this zone and the deponent is of the conviction that the authors of these crimes are individuals of gypsy ethnicity whose identification he does now know;
. Questioned, the deponent states that since the disappearance of the girl Madeleine, until today, he has heard no commentaries that could help clarify the motive for the disappearance, and as this, does not have more information that could help to this end;
.And nothing further was said. She has read the statement, finds it in conformity and signs it;
