Today I had a visit from D.C.I. Trevor Roe who since December has taken command of all matters to do with Ms Butler's allegations of fraud and my counter-allegations of harassment by her.

We sat in the conservatory as we're now officially in summer, and as I made him and myself a pot of Yorkshire Tea, he looked out of the patio doors and commented on the two main trees in the garden. I explained that they were rhus's, which was news to him.

This has resulted in the following e-mail exchange this afternoon:

BENNETT TO ROE:
From: ANTHONY BENNETT [mailto@btinternet.com]

Subject: The Rhus Tree

Dear Trevor,

After your reference to the two rhus trees in our garden, I discovered this link which is from Australia.

Apparently in Australia this tree is officially held to be one of the most noxious weeds on that continent, requiring active co-operation from citizens in destroying it, and if you read the article, there is a note that it must be, and I quote, \"fully and continuously suppressed and destroyed\":

I daresay the same could be said about crime.

Thanks Tony, that's interesting...make sure the grandchildren don't eat it?

Now, whilst our conversation was on the record, I would prefer not to disclose all that was said.

I will confine myself to two points.

First, when Trevor Roe called to see me on 17 December 2009, he admitted that at the time, it was his expectation that 'the whole thing would be over and done with by mid-January.

Second, he said that the main reason this has already taken 7 months with still no decision is because of action by the Crown Prosecution Service. My understanding is that the CPS Manager currently dealing with this matter is required to discuss what further action (if any) should be taken by the CPS and Police in Essex with CPS Headquarters. I was told that CPS Headquarters may have been involved in this matter from a very early stage and, on the record, was told that this is \"because the McCann case is considered 'politically sensitive'.\"

I expect to find out more about this in due course.

In the meantime, I cannot say any more but will just place on record that because of the referral of this matter to CPS Headquarters, it may be many more weeks before I know what action if any the Police and CPS will take.

I should just add one more thing. On the instructions of the Commissioner for Essex in the Independent Police Complaints Commission, the conduct of Essex Police in beginning an investigation into me, apparently with no credible basis for doing so, and continuing it for 7 months is currently under investigation and has been for several weeks.

For goodness sake. Can we not find this man something more productive to do than run around after you?

How about asking him to use his connections to get you an interview with Leicester police?

This would make much better use of his time.

On a lighter note - Detective Chief Inspector Roe drops round for an update again Empty Some questions to Essex Crown Prosecution Service

Post by Tony Bennett 11.06.10 0:38

Some on this board will be aware that the allegation against me of fraud within the Madeleine Foundation has not yet been resolved by Essex Police.

Just for the record, I supplied Essex Police back on 11 November (the day after they asked for them) with all the documents requested by them. In December, as soon as I was asked, I gave the police permission to search the Madeleine Foundation accounts; by contrast Debbie Butler delayed doing so. Earlier this year I was asked to supply samples of my handwriting and did so. As yet I have not been charged with any offence nor have I been interviewed under caution. By contrast, Debbie Butler was asked to attend Harlow Police Station for interview earlier this year, an occasion she also used to take and broadcast photos of the front of my house.

Yesterday Essex Police made the significant disclosures that the main reason for delay was inaction by the Crown Prosection Service and they also disclosed that there exists within 'CPS Central' i.e. CPS Headquarters a special unit dedicated to deal with all criminal issues which relate in any shape or form to the case of Madeleine McCann.

In the light of those disclosures, I have today written to the Senior CPS lawyer covering Harlow, Olivia Gooding, and asked her the following questions:

QUOTE

My questions relate to an allegation made against me of fraud by a Ms Debbie Butler of Maidstone, Kent, and which Essex Police began to investigate somewhere between 4 and 9 November 2009.

Seven months have elapsed since then.

Up to now, I had assumed that the police had been solely responsible for the delays in deciding whether or not to charge me with a criminal offence. I now understand that delays within the CPS have also contributed to a considerable degree.

I am not dealing in this letter with matters concerning my allegations relating to a campaign of harassment against me by Ms Butler, I am enquiring solely about the CPS's role in the matter of her allegations against me and also the role of the special unit relating to the McCanns at CPS Central which D.C.I Roe informed me about.

These are my specific questions:

1. On what date did Essex Police (or any other police force) first contact your department, either for advice, or for other purposes?

2. On what dates has there been contact between Essex CPS and officers from Essex Police regarding the allegation against me, whether by letter, telephone, e-mail or otherwise.

3. On what dates have you or your CPS lawyers or other staff from Essex CPS met with officers of Essex Police regarding the allegations against me?

4. Have you or other staff from the CPS at any time to date been in contact with CPS Central/HQ or any other specialist unit within the CPS to discuss the allegations against me?

5. Is it correct that D.C.I. Trevor Roe cannot proceed with a decision as to whether or not to charge me with a criminal offence because he is still awaiting further advice from yourselves at Essex CPS and/or CPS Central on matters relating to the allegations against me? (I should add for the record that D.C.I. Roe had been told by you by telephone earlier this week that you were still unable to advise him further on this matter because you needed to consult with a special unit within CPS Central that advised the CPS and police on all matters relating to the case of missing Madeleine McCann).

Post by Tony Bennett 04.03.11 21:38

Today I received a draft report from the Independent Police Complaints Commission regarding my complaint about the way Essex Police handled Debbie Butler's allegations against me, and related matters.

I am not at liberty to disclose the contents.

The final report will be out in about 6-8 weeks from now. I am not sure if the IPCC will make it public.

I now have the opportunity to make comments on the draft. Some points have come out well, but there's quite a bit I'm not too happy with and I'll be making quite a few comments.

It runs to 155 paragraphs covering 23 pages.
