Detectives believed they had enough evidence for Mrs McCann to be charged with homicide
Is anyone else fed up with hearing from the pros that the case was shelved due to lack of evidence and that the McCanns have been cleared of all suspicion - what really happened here?

A police file of evidence which allegedly proves that Kate McCann killed her daughter is expected to be handed to a public prosecutor in Portugal today.
Detectives believe they have now collected enough evidence for Mrs McCann to be charged with the homicide of Madeleine by failing to prevent her death. The charge is equivalent to manslaughter in British law. She would also face a charge of concealing a Madeleine’s body.
Officers were furious when a plan for Mrs McCann to be charged on Thursday last week was halted after her lawyer met with the Portugal’s Attorney General, it was claimed today.
A new file of evidence includes lengthy interviews with both Mrs McCann and her husband, Gerry, after they were made official suspects last week. It also includes details of forensic evidence collected in the McCann’s apartment and hire car and the results of surveillance by Portuguese and British police.
Jose Cunha de Magalhaes e Meneses, the public prosecutor based in Portimao, will have to decide what, if any, charges should be brought against Mr and Mrs McCann. The couple can remain as official suspects for up to eight months.
Chief Inspector Olegario Sousa, spokesman for the Portuguese police inquiry, said: “At the moment the inquiry is being prepared to be handed to the prosecutor in charge of the case. He will analyse it and after this he will make his decision.”
Asked when the papers would be handed over, he said: “Probably during today.”
Portuguese police decided to pass the file on to the prosecutor despite not having all the results from forensic tests being carried out by the Forensic Science Service in Birmingham.
Mr Sousa said: “The information is that we have received part of the forensic results, so we are waiting for the rest."
The McCanns' Portuguese lawyer, Carlos Pinto de Abreu, has said he has no idea how long it would take for the case to be concluded. It is understood the McCanns could have to wait months before learning whether they will be charged or cleared.
If charged, the couple could be remanded in “preventative custody” by a judge while they await trial.
The McCann’s had previously insisted they would return to Portugal if requested by police but their decision to consult a British expert in extradition law has led to speculation that they may fight an extradition order.
Michael Caplan, QC, has previously represented Chilean dictator General Pinochet in his battle to avoid extradition on charges of torture and human rights abuses.
However, the introduction of a European Arrest Warrant in 2004 will make it much harder for Mr and Mrs McCann to successfully challenge any extradition request.
Portuguese detectives appear to be working on the theory that Mrs McCann killed her daughter by accident and covered up the death by claiming she was abducted. Her husband’s alleged role is not clear, but sources said police believe he was an accessory to the killing and helped hide their daughter’s body.
Portuguese newspapers claimed today that Madelene was accidentally killed by an overdose of sedative, by drinking medication or after being slapped or pushed. Mrs McCann is the key suspect as British tourists claim she put Madeleine to bed while her husband played tennis or swam.
Portuguese police were yesterday reported to be preparing for a fresh series of searches in Praia da Luz. The sites included the villa where the McCanns had stayed and an area south of the Ocean Club resort where Madeleine disappeared 130 days ago,
Mr and Mrs McCann returned to their home in Rothley, Leicestershire, yesterday with their two-year-old twins, Sean and Amelie.
Philomena McCann, Madeleine's aunt, said today it was "unbelievable" that Kate and Gerry McCann had been named as "arguidos", or formal suspects, in her disappearance.
"The way the Portuguese have turned this investigation round, and they are no longer looking for a live child, they are assuming on spurious evidence, that Madeleine is now dead, well, we don't agree with that in any shape or form," she told BBC Breakfast.
"We want the investigation changed round to look for Madeleine alive, as we reckon she is."
Ms McCann said the couple would be "absolutely" co-operating with the Portuguese police and were prepared to return to Portugal to undergo further questioning.
After touching down at East Midlands Airport just after noon yesterday, Mr McCann, his voice breaking, insisted they played no part in her disappearance.
He said: "Whilst it is heartbreaking to return to the UK without Madeleine, it does not mean we are giving up our search.
"As parents we cannot give up on our daughter until we know what has happened."
The couple do not know if or when police will call them back to Portugal, although they will obey even if they fear they could be arrested, a family friend said.
"They are not running away. It is a change of place but they are very happy to help the police," the friend said.
The family's decision to return to Britain was in large part based on their desire to maintain a sense of normality for their two youngest children.
Mr McCann said: "We want the twins, as much as is reasonably possible, to live an ordinary life in their home country, and we want to consider the events of the last few days which have been so deeply disturbing."
It is very unlikely they will bring the twins back to Portugal with them if police need them for further interviews, a friend said.

I have, a few times, brought CM, our MMU and Media 'Secret Injunctions' into conversations - and have, the same amount of times, received a look which perceived me as stark staring bonkers (to be polite). [You must be registered and logged in to see this image.]

The thing they will pick up on is the fact the case was closed due to lack of evidence, so if there was evidence then (and correct me if i am wrong) GA was in charge of the investigation at the time.
So why were they not charged? I do not believe there was a cover up in Government as Gordon Brown had to many enemies and it could easily have slipped out about it, especially from un-named sources as such.
I still believe they had a hand in Madeleine dying, how i am not sure though

Amaral was taken off the case and it appears Brown was involved in that - give it time and it may all come out.

A leading Portuguese newspaper published his remarks, giving the Portuguese authorities an excuse to remove him from the enquiry. As Mr Amaral has set out in a second book, ‘The English Gag’, Prime Minister Gordon Brown was told of his being removed from his post before he was. Mr Amaral has provided evidence of British government interference in his enquiries in his two books on the case. As we have shown elsewhere, the British government heavily influenced this investigation from the outset, sending several top-level people out to Portugal in the first week alone, including staff from MI5. There was quite a bit of info in the press at the time regarding the McCann's using contacts to help them get off the hook, here's just a snippet of one such article. -
" THE parents of missing Madeleine McCann plan to appeal directly to Foreign Secretary David Miliband as pressure mounts on them as suspects behind her disappearance.
Kate and Gerry McCann, both 39, have been in touch with Mr Miliband since the start of their ordeal 131 days ago, and see the South Shields MP as their last option for support if they were charged with killing their daughter.
Speaking to the Gazette today, David Hughes, one of the McCann family's inner circle of advisers, said: "If the situation progresses much further, we'll make direct contact again with Mr Miliband to ask for his help and support."

He is a politician. Nothing matters to him except his seat and power. With both, go money.
Like solicitors and barristers. They are not paid to judge the issue, and therefore should remain professionally aloof. If you pay them, they will act for you. The actual people don't mean a toss to them either. A barrister's gown still has a string and a small pouch on the back, just under the collar. If you put money in it, and attract his attention by tugging the string he will act for you. A really good barister will never meet the client. He acts purely on the instruction of the solicitor. Win or lose he gets paid. Se does not, and arguable should not, give a toss about anything or anyody.
When this breaks down, and the lawyer becomes personally involved in the case and friends of the clients, we get the sort of nonsense we saw in Portugal.
When a politician takes up the cudgels personally on behalf of one person, we also see nonsense happening. The Home Secretary et al should never have met the McCs personally. A lower ranking civil servant, at best, should have done,so , prepared a brief and handed this upwards through the ranks. The Prime Minister should never speak to anyone personally over the phone, ( except obviously the England Cricket Captain !)

As I understand from reading other material - there was interference from the UK Government to ensure that, even though a case was prepared, it would end up "shelved". The final results from the FSS were "shown" to be inconclusive and therefore not enough evidence to convict. The case remains "shelved" until evidence is found/given to enable the case to go forward. I believe that the PJ are not interested in "neglect charges" and will not re-open the case on these grounds.

Absolutely agree. The FSS would have to give inconclusive results. They also had found "evidence" to convict N.Bento for murder in England ..."evidence" that never existed at all.

Absolutely agree. The FSS would have to give inconclusive results. They also had found "evidence" to convict N.Bento for murder in England ..."evidence" that never existed at all.
However, there were conclusive results at one point, which is why the McCanns were hauled in as prime suspects in Madeleine's mysterious disappearance. A further mystery lies in why the results were deemed to be inconclusive at a later date.
Amaral believes he has the answer to this mystery and other mysteries in this case, which is why has been writing about it. The McCanns do not want the answers to some of these mysteries getting into the public domain, hence their vehement protests and libel actions directed towards Amaral, The Madeleine Foundation and all over the internet
