A MAN has today been charged with the manslaughter of Lee Balkwell who was found dead trapped under the drum of a cement mixer 11 years ago.

Simon Bromley, 44, Mr Balkwell's boss at the time, is also charged with breaching the Health and Safety at Work Act.

Mr Balkwell, 33, was found dead wedged under the drum and chasis of the vehicle at around 1am on July 18 2002 at Baldwin's Farm, Dennises Lane, South Ockendon.

The offences are alleged to have occurred while Mr Balkwell and Bromley were drilling drying cement out of the mixer at Baldwin’s Farm.

He is charged with unlawfully killing Lee Balkwell on July 18 2002.

The second charge is that he failed to ensure Mr Balkwell's health and safety between July 16 and July 19 2002, while he worked with the Hymix concrete mixer.

Bromley is due to appear before Basildon Magistrates Court on January 27.

SOUTH OCKENDON: MAN CHARGED over the Death of Lee Balkwell; 18/07/2002

The Crown Prosecution Service, East of England has authorised the Kent and Essex Serious Crime Directorate to charge Simon Bromley, 44, with the manslaughter of Lee Balkwell, 33, who died when trapped between the drum and chassis of a cement mixer in Upminster, Essex, on July 18, 2002.

Nick Staite, Special Casework Lawyer in the East of England Complex Casework Unit, said: "Simon Bromley has been charged with one count of manslaughter and one offence under the Health and Safety at Work Act. The offences are alleged to have occurred while Mr Balkwell was working at Baldwin’s Farm, Denisses Lane, Upminster.

"Details of the charges are:

• Simon Bromley, on 18 July 2002, unlawfully killed Lee Balkwell.

Contrary to Common Law

• Simon Bromley, between July 16, 2002 and July 19, 2002, being an employer within the meaning of the Health and Safety at Work etc. Act 1974 (‘the Act’), failed to discharge the duty imposed on him by section 2(1) of the Act, in that he failed to ensure, so far as was reasonably practicable, the health and safety at work of his employee, Lee Balkwell, in relation to the risks arising from the gunning out of the inside of a Hymix concrete mixer

Contrary to s.33(1)(a) Health and Safety at Work etc. Act 1974

"This decision was taken in accordance with the Code for Crown Prosecutors. I am satisfied there is sufficient evidence and it is in the public interest for this case to be brought to court.”

Simon Bromley will appear before Basildon Magistrates Court in January.

Mr Staite said: "Simon Bromley now stands charged with a criminal offence and has the right to a fair trial. It is extremely important that nothing should be reported which could prejudice this trial.”


Mr Les Balkwell who has tirelessly campaigned for a full investigation into the handling by Essex Police over his son Lee's death said today: "I am very shocked at the news and I cannot fully take it in. I have always fought hard throughout the last nearly eleven years for the truth about how Lee died.

I don't believe I would have had the strength to keep going without the support of my family and a few journalists who have helped me. I hope finally that my wife and I will get justice for Lee leading to closure on the death of Lee."

A man has been charged with the manslaughter of Lee Balkwell who was found crushed in the mechanisms of a cement mixer more than 11 years ago.

They were photographed and the photo handed to a press agency, who released it on 8 May, as the search for Madeleine continued. The McCanns held up these same pyjamas at two press conferences on 5 & 7June 2007. How could Madeleine have been abducted?"

Lee Balkwell died in July 2002 after suffering from multiple injuries

A 44-year-old has been charged with manslaughter over the death of a man found on a concrete mixer at a farm in Essex more than 10 years ago.

The body of Lee Balkwell, 33, was found trapped between the drum and chassis of a mixer lorry near Upminster in 2002.

Simon Bromley, 44, of Upminster, has also been charged with an offence under the Health and Safety at Work Act.

He is due to appear before Basildon magistrates on 27 January.

Essex Police initially said Mr Balkwell's death was the result of an industrial accident, but an inquest ruled that he had been unlawfully killed.

Mr Balkwell died while working at Baldwin's Farm on Denisses Lane, Upminster, between 16 July and 19 July 2002.

The health and safety charge states Mr Bromley, being an employer, "failed to discharge his duty in that he failed to ensure the health and safety at work of employee Mr Balkwell, in relation to to the risks arising from the gunning out of the inside of a Hymix concrete mixer".

I sincerely hope 2014 brings some kind of closure for Les Balkwell, after all these years.

Even to an untrained eye, the post mortem photograph of Lee taken at the crime scene, shows beyond any doubt that what was claimed simply did not happen. It is so plain to see, that the fact this was not treated as murder from the outset is evidence of one of the greatest police scandals imaginable.

A  correct assessment, I am sure - but unfortunately meaning that Les and his family probably won't see 'closure' in 2014. If there is a cover-up (I have to choose my words carefully) then it goes all the way to the very top - and may even include the IPCC. A former senior officer from Essex Police who had managerial responsibility for both the initial investigation and the first, ineffective, review into Le's death, was promoted in 2005 to the IPCC, where he now has a senior role, including assisting in the IPCC investigation into the death on 21.7.2007 of Jean Charles de Menezes.

Senior underworld figures operating in west and south Essex are also very close both to the family who own the farm where Lee Balkwell was killed and to senior police officers in the area.

I can't give names or details though, apart from those named in the three IPCC reports so far in this case (2004, 2009 and 2012) and which are available on the IPCC website.
