No. That is why they enlisted the help of Carter-Ruck. If you trawl through their own website you will find that they very rarely get as far as court. Their undoubted skill is to keep the facts from emerging at any stage. They are masters a dealing with procedural points, and racking up costs so that the respondent caves in. I doubt it very much. They wanted to put the fear of God up Tony to back off right from the start and to settle out of court. They have overwhelmed him with paperwork which would be enough for anyone to throw their hands up in the air and surrender. Not Tony.
It is Tony who has now done all the work to go all the way to a libel trial. It would be a shame for all that evidence to not see the light of day in a Court and for Tony to be free of his undertakings.
I agree with that uffercoffy. All the McC's can take into a libel court is their lies which will be trashed.
And for what its worth I think that If Tony gives up before getting to the libel trial then his reputation will never be repaired but it will strengthen the McCs and they will also be quids in again if TB has to pay their costs.

But will the press print it? Most people have never heard of TB, the McCanns are a household name. Is a libel trial one with a jury? In that case they will claim that too much is in the public domain to ensure a fair hearing and so on.
There are very good reasons why the Hacked Off campaign is trying to censor (imo) the press even further. Perhaps the coverage of TB's court case is a pointer. I wouldn't say that was fairly reported.
Interesting point is how would a libel trial take place is there is a super injunction on the accused? This is just a theoretical question you understand.
