In the matter of Smethurst v. Bennett regarding allegations that he claimed I made against him on this forum, I have (as reported previously) already paid the agreed damages of £2,500, which by mutual consent were paid by me directly to the Find Madeleine Fund.

Nearly 5 months later, Edward Smethurst has now submitted his formal claim for costs in the matter.

Part of his claim for costs is for one hour's work done by Carter-Ruck on 8 August 2011, during the week I was away on holiday.

The claim is for:

Considering incoming e-mail from client with further details. Thereafter perusing the Jill Havern website, noting that it is now accessible only to registered members. Registering (anonymously) for the same, and undertaking various searches of and perusals of their website. Noting that the thread complained of had already apparently been taken down by the site administrator and reading commentary thereon. Locating other threads which contain the same/similar allegations.

UNQUOTE

(Smethurst issued his LIbel Claim (i.e. writ) the very same day).

Thus an employee of Carter-Ruck can read every thread on here that is open to all members.

By the way, Mr Smethurst's claim against me on his Bill of Costs for obtaining the agreed damages payment totals £52,713.26.

I have until 3 September to lodge a challenge to the amount.

We can only hope so but there are many times when I feel that this is one of those cases where everyone except the guilty is punished.

Lord Archer got away with his crime for a long time but in the end was done by a former close ally.

Is that a factual statement as to accessing the website at the time.
As I have previously read articles here on-line when not registered.
What "cyber-trail" did the poster leave.
Did they actually post any comments or ask questions of a leading nature.

As it goes, I believe that to be an INACCURATE statement by Carter-Ruck, since most of this forum has always been open for any member of the public anywhere in the world to view. I think this is a complete misunderstanding - IMO it is being confused with action the forum-owner took (on I believe 5 August 2011) to remove certain threads re Smethurst to the Admin section, where only the forum-owner and a handful of other people could view the threads in question

Are they (still) on it?

Had you spotted them (in time?

Which action was taken to limit damages to the members of this Forum? People tend to proffer personal information, having communicated freely with avatars they have known for a while.

There were 4 members who registered on 8 August 2011. None of them sent any private messages nor made any posts on the forum.

Although we've been aware of Carter Ruck lurking on the forum for many months, we didn't know they'd registered to have a snoop on behalf of their wealthy clients.

way. The true motive for registering, was in fact that he or she
thought that it would allow far greater access to the site. But were
incorrect. Maybe a genuine mistake or maybe trying to "justify" prying
on Forums. But not willing to admit so.

This rather begs the question of how these clients could possibly claim being offended, not being aware of any offenses themselves.
Do stoolpigeons count for anything under British law? Or does pigeoning and using the results afterwards equal entrapment?

Many thanks, justathought. Can I just say that I do not consider as gospel everything said by Carter-Ruck. Even they, very occasionally no doubt, may get something wrong.

The matter of the inaccurate statement should be addressed.
CR should either correct there mistake prior to the trial or you should ensure the authenticity of the statement is questioned.
The way that CR have currently portrayed matters, could be interpreted by a trial Judge the wrong way. The need to register being that the Forum not being in the public domain. And being a "hot bed" of irresponsible and vindictive individuals, trying to discredit and persecute the MCCanns. When the opposite is true.

I now see that C R would have been very careful as to entering "anti" MCCann sites such as this. So they would not have risked entering into debate with anyone. They would have just acted a bit like a sniffer dog trying to gain information.

Not like they're the enemy or anything. They are solicitors. They solicit for others for money when instructed to do so. They probably personally agree with 99% of what they read here. So what.

Bring it on! there is no silencing those, like us, who will continue to question, to read, to form opinions which we will pass on to our friends & colleagues. What i meant was that a Sniffer dog looks for alerts and clues. So the secret is to look where the sniffer dog has been searching for incriminating evidence. Like ironically following the trial that a Sniffer dog has left.

A good question. She/he is right though - it won't go away just because they bully some people and bankrupt others. We all has something to lose - the question is will we put it on the line when it comes to it. I suspect none of us really know the answer to that question until we find ourselves in a similar position to Tony.
