McCann V Bennett case likely to be adjourned
The hearing of McCann V Bennett of the 9th and 10th of May is likely to be adjourned.
During April, Tony became aware of guidance from the Minister for Justice to the Legal Services Commission about the need to grant legal aid to defendants faced with well funded libel claimants.
Tony was refused legal aid in December, but this decision appears to have been wrong. Tony has therefore re-applied, and asked Carter Ruck if they would agree to an adjournment.
Carter Ruck have notified Tony Today, May 3rd that they have agreed.
Mr. Justice Tugendhat is being invited to agree to the adjournment.
There will therefore probably be no hearing on 9th and 10th May.

That is great news. How unfair would it have been for Tony to take on Carter Ruck without any legal support at all. Let's hope the legal aid application is approved this time round.

I hope there will be a hearing but with Tony having a good legal team to take on C-R.
It is important the issues are discussed in open court where there is the admittedly small chance of media coverage.

I wish Tony all the best and it's important for his financial and physical wellbeing that he does what is right for him.
It certainly could be good if the case goes ahead especially with such outright lies as the taxi driver story being edited and stamped with Team McCann approval. Any chance to get those lies in the public eye would be welcomed but Tony needs to give himself top priority.

There have been persistent rumours of a bankroller with very deep pockets, approaching four billion I believe.
Tony should ask Kingsley Napley to act for him, lol.

I am very pleased that Tony will now have the benefit of legal representation and likewise I have everything crossed that he now has a chance to present his case with a view to the best possible outcome. :fingerscrossed

If they bowed out now, they'd lose less? Because they've been on a retainer from the mcCanns - they'd not lose a penny if they advised the McCanns that losing the case would be very bad publicity and TM would only have to pay the cancellation cost and anything over the retainer. That would be a lot less than paying full court costs and TB's costs, plus no publicity of any kind.

There's also the risk to the C-R reputation if they lose the case.
they get clients (usually rich ones) because they win cases - lose this one to an unknown ex social worker and there is damage to their professional reputation.
So I think they may be concerned about going to court. The letter re costs to date was clearly geared to an out of court settlement.

I'm very pleased for Tony too. I've been through a court case for the past 18 months, my solicitor charged £250 + VAT an hour, it's frightening how the costs mount up, just for sending me letters not saying very much, attending Court for mediation talks etc. plus Barrister's costs. It goes on and on. I was the defendent but the Judge threw the case out of court in my favour, but I now have a fight to get the money for costs out of the other party.

There has been a horrible build up to the court case 9/10 May with all the spin in the media going the McCanns` way. This is good news and all the best to TB who has had to keep his nerve throughout.
