Madeleine McCann's parents seek phone hacking probe role


The parents of missing Madeleine McCann want to participate in the judicial inquiry into the phone hacking scandal, a preliminary hearing has been told.

They are among alleged victims who want to be "core participants" in the first part of the Leveson Inquiry.

Core participant status means a person is deemed to be specially interested in the subject and may apply for public funding for legal representation.

The inquiry's first stage will examine relations between the press and public.

The investigation is one of a number of inquiries looking at the way the media operates in the UK.

The Commons Culture, Media and Sport Select Committee is conducting an inquiry into press standards.

Meanwhile, Prime Minister David Cameron has asked Cabinet Secretary Sir Gus O'Donnell to conduct a review of the media's relationship with Whitehall.

The prime minister has also asked former Parliamentary Commissioner for Standards Elizabeth Filkin to oversee a review of the media's relationship with the Metropolitan Police.

Tuesday's preliminary hearing was held to consider applications for core participant status.

'Notorious' cases

Lord Justice Leveson will decide who will get core participant status in the next few days and notify applicants in writing.

Barrister David Sherborne told the hearing that he represented a number of alleged victims of general media malpractice who wanted to be core participants, including Kate and Gerry McCann, whose daughter went missing aged three on holiday in Portugal in 2007, Mr Mosley and Chris Jefferies, the former landlord of alleged murder victim Jo Yeates.

Mr Sherborne said those seeking to take part in the inquiry had been involved in "notorious" cases.

Alleged victims of phone hacking who have applied for core participant status include politicians Chris Bryant, Tessa Jowell, Denis McShane, Lord Prescott and former police officer Brian Paddick.

News International, Guardian News and Media Group, Express Newspapers and the Metropolitan Police are among other applicants who are not in the category of alleged victims.

Associated Newspapers - publishers of the Daily Mail and Mail on Sunday - are also expected to apply in writing in the next few days.

Improper conduct probe

Lord Justice Leveson said the inquiry would examine the relationship between the press and the public, the press and the police and the press and politicians.

Outlining the planned format for the probe, he said he would initially look into the "culture, practice and ethics" of the press.

The judge said the second stage of the inquiry would consider the extent of any improper conduct.

He said he would hold a series of preliminary hearings before a main hearing.

Lord Justice Leveson said he wanted evidence from experts and members of the public.

The judge said he expected the inquiry to last for several months and aimed to produce a report within a year

The spokesman for Rothley couple Kate and Gerry McCann has confirmed he has talked to officers investigating phone hacking by journalists.

Clarence Mitchell has previously spoken of his fear that he may have been a victim of hacking attempts during the height of the case involving their missing daughter Madeleine McCann.

.He said he has been interviewed by officers from the hacking inquiry Operation Weeting, and is due to be interviewed a second time in the near future.

Mr Mitchell discovered "suspicious" activity on his account from February and July 2008 after asking Vodafone to examine his records late last year.

"It appears that a person or persons unknown attempted to seek information about my number in relation to the McCann case," he said.

He said another call was made to Vodafone in July 2008 from someone claiming to have received a text message warning that a third party had been trying to access their voicemail.

"When I was made aware of these circumstances late last year I informed the Metropolitan Police and detectives from Operation Weeting swiftly interviewed me."

Metropolitan police officers are investigating Mr Mitchell's phone situation and he said he is due to speak to them again in the near future.

He said the McCanns' records were also probed, but there was no evidence of suspicious activity.

Mr Mitchell has not pointed the finger at any organisation, but said he would be "naive" not to think attempts to get information from his phone were linked to journalists.

McCanns among host of high profile figures wanting a key role in hacking inquiry

The parents of Madeleine McCann and a host of celebrities and politicians want a key role in the hacking inquiry, the judge leading it was told yesterday.

Gerry and Kate McCann are among a list of high profile individuals, including former Formula One boss Max Mosley and Lord (John) Prescott who have applied to be “core participants” in the Leveson Inquiry.

More than a hundred others, including Sienna Miller, Hugh Grant, Steve Coogan and Paul Gascoigne are currently deciding whether to formally apply but want their evidence heard, their lawyers said.

Being a core participant will give them the right to be legally represented and potentially testify at the hearings.

And it emerged they could also be eligible to have their legal costs funded by the taxpayer, despite some earning millions of pounds a year.

The year-long inquiry, headed by Lord Justice Leveson, will look at the wider issue of press practices and ethics and its relationship with the public, police and politicians as well as the specific issue of alleged phone hacking.

The McCanns, along with Mr Mosley and Chris Jefferies, the former landlord of alleged murder victim Jo Yeates, have applied to be core participants because they were the victims of “notorious” cases, rather than phone hacking.

Alleged hacking victims who have also applied include Lord Prescott and MPs Chris Bryant and Tessa Jowell.

Chris Shipman, the son of mass murderer Harold, and lawyer Mark Lewis also want a key role.

Others who have applied or are considering applying include former News International chief executive Rebekah Brooks, former senior Metropolitan Police officer John Yates, News International, the Guardian newspaper, Express Newspapers, Association Newspapers and the Metropolitan Police.

Lord Justice Leveson will decide “within days” who is granted “core participant” status before deciding who is eligible for public funding.

Great idea wanting to be involved in the enquiry. Will divert them from all that searching they have been doing for four years and they will get to meet some big names, might be able to talk some of them into donating to their fund. As usual Madeleine seems to be secondary to other considerations.

Mr Sherborne said those seeking to take part in the inquiry had been involved in "notorious" cases.

Seems everybody jumping onto the gravy train were either hack victims or involved in "notorious" cases - and since CM said the mccanns were not hacked they can only belong to the latter category.

How they can qualify is a mystery since they actively sought the media and used the media ruthlessly for their agenda.

Inquiry officials appearing at the High Court, in London, yesterday published a list of names and organisations who will appear as witnesses.

They included former News International chief executive Rebekah Brooks, former senior Metropolitan Police officer John Yates, News International, the Guardian newspaper, Express Newspapers and the Metropolitan Police.

The McCanns have spoken and written about press intrusion and misrepresentation of their campaign to find Madeleine, who disappeared from her family's holiday flat in the Portuguese resort of Praia da Luz, in the Algarve, on May 3, 2007, as her parents dined out nearby with friends.

In March 2008, they accepted a payment and front page apologies from Express Newspapers.

To me it seems yet another attempt by the McCanns to deflect any blame from themselves the night of 3rd May 2007. They have already recovered "damages" amounting to £1000,000s from the Express previously so surely have no axe to grind with this case particularly as they must have been made aware that their phones were not hacked by any media by now (whether by UK police in 2008 is another story). Seems like typical McCann attempt to gain the limelight (again) in my opinion. It is not as though we don't have any previous examples of this being carried out by them. Is it?

If they are going to be able to cross-examine witnesses, does it also mean that they are open to being cross-examined themselves? If so, a competent barrister could make the same observation as quoted above, and tear them to shreds.

Madeleine McCann and Kate & Gerry's PRESS Intrusion
The Press are widely reporting that Kate and Gerry McCann are to participate in the LEVESON inquiry, possibly giving TESTIMONY, alongside several key victims of press intrusion, as the first witnesses in the judicial inquiry into the phone-hacking scandal.

Even though there is categorically NO suggestion or allegation that their 'phones were hacked.

In the interests of fairness and accuracy, it is important to question why, exactly, the McCanns are "Key victims of press intrusion", as described by the Guardian.

Clearly this can't be the SAME Kate and Gerry McCann who contacted the Media BEFORE, or at the VERY LATEST at the SAME TIME as they contacted the Police regarding their "Missing" daughter.

Nor can it surely be the same McCanns who gleefully enrolled the services of Justine McGuiness and Sheree Dodd
(“press officer responsible to act as media liaison officer for the McCann family”)

or the infamous Spin-Meister Clarence Mitchell, who has penned a MILLION column inches in publicity for his 'Clients' regularly briefing EVERY newspaper Editor,
(“Mitchell still has the key phone numbers and e-mail addresses of people in power and will continue to use them. He has attended top-level briefings at No 10 every weekday for the past two years. The McCanns.... want to get messages to the very top that they are innocent.”)

And obviously NOT the same McCanns who set up a MULTI Million Pound MEDIA driven/reliant INDUSTRY/FUND/WEBSITE, masquerading as a CHARITY, within DAYS of Madeleine going missing.

And, presumably NOT the self-same McCanns who accepted a £750,000 fee in newspaper serialisation rights for Kate's book, an "honest and truthful account" entitled 'Madeleine'.

Along with the OTHER graciously accepted fees for such "intrusive" appearances on OPRAH and other television programs.

And, categorically NOT, surely, the same Kate McCann who somehow managed to 'intrude' onto EVERY front page of the Press when the parents of Claudia Lawrence, a missing 35 year old British woman, who was last seen in March of 2009, held a special service, a "candle-lit vigil" for THEIR daughter; whose picture, (where it appeared at ALL), was a mere FRACTION of the size of the lady of the moment.


Whether Lord Justice Leveson gets round to pointing out these 'anomalies' to the Golden Couple at the hearing remains to be seen.

Who watches the watchmen? That’s what the Leveson inquiry into press ethics, which began on Monday morning, hopes to determine. Prompted by the revelations that reporters had used private investigators to illegally hack into the voicemails of celebrities, politicians, and the families of victims of crimes, Lord Justice Leveson is conducting the hearings to examine the “culture, practice and ethics of the media”; witnesses will include alleged victims of phone hacking, such as the families of Madeleine McCann and Milly Dowler.

Leveson opened the inquiry Monday monring by stating that his aim is to establish “who guards the guardians”: “I fully consider freedom of expression and freedom of the press to be fundamental to democracy, fundamental to our way of life. But that right must be expressed with the rights of others in mind,” he said.

However, the inquiry itself has already come under fire from critics who claim that the panel is too narrow and not current enough, containing no one with experience in today’s news industry, James Kirkup at The Telegraph reported. “The danger is that newspapers are held to an impossible standard, a rose-tinted and unreliable memory of a bygone trade. Others suspect David Cameron and other politicians of hoping to use Leveson as a way to curb a troublesome Press: some MPs privately regard the inquiry as journalists’ just deserts for exposing their expenses.”

There’s also concern that the hearings won’t be robust enough and that its outcome will simply be a curtailment of press freedom. But has the UK press spun out of control?

Some notes:

1. Leveson is deeply tainted by his close relationships with the elite, the government, the Murdoch Press and the Met Police etc.

2. Cameron forced the Met to spend £3.5 million reviewing Madeleine's disappearence 'to support the family'; the government has helped to maintain the McCanns' celebrity status

3. On top of that, tens of thousands of pounds of taxpayers' money is now being spent on allowing the McCanns to air their point of view on press freedom (they've already netted £550 grand from the libel courts and had a whole session of the Select Committee on Press Standards devoted to their views)

4. PREDICTION: Leveson and the government will use public sympathy for the parents of Milly Dowler and Madeleine McCann to place new restrictions on press, media and internet freedoms.

And I have had a letter from the Home Office regarding the review in these terms:

"In view of the passage of time since Madeleine disappeared, in May, the Home Secretary with the Prime Minister's support, asked the Commissioner for the Metropolitan Police Service (MPS) to bring its particular expertise and know-how to the case which might help provide a fresh perspective and suggest lines of inquiry which might be usefully be pursued. in the light of the request, the Metropolitan Police Commissioner took the operational decision to review the evidence relating to the this case. That work is underway and is part of the UK's continuing contribution for the search for Madeleine."

"While Madeleine remains missing we will continue to do what we can in the search for her."

This is just 2 quotes - but that and the fact that in respect to my asking for:

"...results of the review and associated costs are published. Under the Freedom of Information Act 2000 the public has a general right of access to all types of recorded information held by public authorities. It also sets out exemptions from that right and places a number of obligations on public authorities. The Act applies to the vast majority of public authorities in the United Kingdom, including the MPS. Therefore...is free to submit a request to the MPS for information relating to this case"

...does this look like a review, or just a "review (aka whitewash)"?

I've been watching the Sky News Leveson Inquiry for the past few hours with Hugh Grant giving evidence, I was on his side until he mentioned the McCanns and how innocent they are but have been harassed by the media for the past 4 years. What?????? I nearly exploded with rage!!!! To mention them in the same vein as the Dowlers, the 7/7 bombing victims and the families of the soldiers who were killed in Afghanistan is outrageous!

The McCanns have loved the press when they were pushing for everyone to contribute to their "dodgy" Fund, talk about double standards. They make me sick, sick, sick, sick!!!

Oh no you know what this means, they will all be out in support of gerry and kate on wednesday. I doubt Hugh Grant has ever read any of the police statements or analysed the facts, and is just going on hearsay to support his own agenda

In April 2011 Grant published an article in the New Statesman entitled "The Bugger, Bugged"[128] about a conversation following a chance encounter with Paul McMullan, former journalist and paparazzo for News of the World. In unguarded comments which were secretly taped by Grant, McMullan alleged that editors at the Daily Mail and News of the World, particularly Andy Coulson, had ordered journalists to engage in illegal phone tapping and had done so with the full knowledge of senior British politicians. McMullan also said that every British Prime Minister from Margaret Thatcher onwards had cultivated a close relationship with Rupert Murdoch and his senior executives. He stressed the friendship between David Cameron and Rebekah Brooks (née Wade), agreeing when asked that both of them must have been aware of illegal phone tapping, and asserting that Cameron's inaction could be explained by self-interest:


"Cameron is very much in debt to Rebekah Wade for helping him not quite win the election ... So that was my submission to parliament – that Cameron's either a liar or an idiot."[128]
When asked by Grant whether Cameron had encouraged the Metropolitan Police to "drag their feet" on investigating illegal phone tapping by Murdoch's journalists, McMullan agreed that this had happened, but also stated that the police themselves had taken bribes from tabloid journalists, so had a motive to comply:


"20 per cent of the Met has taken backhanders from tabloid hacks. So why would they want to open up that can of worms?... And what's wrong with that, anyway? It doesn't hurt anyone particularly."[128]
Grant's article attracted considerable interest, due to both the revelatory content of the taped conversation, and the novelty of Grant himself "turning the tables" on a tabloid journalist.[129]

Whilst the allegations regarding the News of the World continued to receive coverage in the broadsheets and similar media (Grant appeared for example on BBC Radio 4) it was only with the revelation that the voicemail of the then missing and subsequently murdered Millie Dowler had been hacked, and evidence in her murder enquiry had been deleted, that the coverage turned from media interest to widespread public (and eventually political) outrage. Grant became something of a spokesman against Murdoch's News Corporation, culminating in a bravura performance on BBC television's Question Time in July 2011.[130].
