I'm fed up of hearing GM's press conference. We have that on SKY. Why is he not twittering about the case. He's missing all the vital testimony of the forensic expert. Very annoying

Forensic expert is long gone and didn't say much that was reported. I think we are going to have to wait for more detailed translations of what went on.

It seems odd that Gerry went back to the UK for work commitments and left Kate to it.

Hasn't it been said that she's to give evidence? Looks like he might have dropped her in it.

It'd have to be a pretty impressive work commitment to keep you away from a case like that.

I don't think he's dropping her in it. It's not a trial against them.

Well he's known about this hearing for a month, since last one cancelled. I think he thought it would probably never to come this and Goncalo would capitulate, or the hearing would be short and sweet, and they would come out the winners. I don't think he reckoned on any of this happening. As his outburst this morning showed. He then had to do a press conference, probably advised by his PR team to try to redeem himself.

As for leaving Kate, this seems incomprehensible. She is going to have to face all the journalists and media alone, although I don't think she will be saying much. I wonder if she will now go on the stand, as she and GM were supposed to, to be questioned by the Judge and Goncalo's lawyer.

Dr Gerald McCann interviewed by SKY TV NEWS 13 January 2010

G McCann:

“Obviously as you all know to-… the trial over the last, er, two days and continuing tomorrow is really about Amaral’s book and DVD and how we feel that relates to the ongoing search for Madeleine. I’d like to remind everyone that it’s the book that is on trial and not Kate and I.

“Right from Day One after Madeleine was taken, Kate and I fully understood the need for us to be investigated and we consider that a matter of course and you may remember that we spent all day on the 4th of May at the police station in Portimao and I subsequently spent a lot of time there. We stayed in Portugal during this period right through to September in an effort to aid the investigation.

“We also understood that every thesis had to be considered and we felt strongly that we had been eliminated from the investigation.

“For those who you have been…followed this case, when things, er, turned sour for us in August of 2007, we didn’t disappear, we stayed , we waited until we had our arguido interviews even though that we did wish to return home - because we felt that was the right thing to do.. We did wish for a reconstruction to be done very early on as would be the norm, er, and certainly within in the United Kingdom - and we were prepared to come back to participate in the reconstruction, in fact we would have been obliged as arguidos to come back and participate and it wasn’t our decision not to do it, although I have to say I don’t think it would have helped very much in the search for Madeleine.

“Over the last two days, I think you’ve heard a lot about Mr Amaral’s thesis that Madeleine is dead and I hope you’ve also heard that there is absolutely no evidence to support that thesis. A thesis without evidence is meaningless and that is what we are challenging.

“We strongly believe and in fact as a direct result of the searches which were actually directed at finding a missing body in and around Praia da Luz and the surrounding terrain - the fact that this thesis which has been tried to be proved quite firmly, has not found any harm to Madeleine is actually in many ways reassuring, and gives us more evidence that Madeleine is probably actually alive.

“And I hope everyone remembers that there is a little girl missing who still needs to be found, and we will keep going until Madeleine is found and also until whoever has taken her is brought to justice. And in response to the question earlier on, that is why we carry on, and we have other children who miss Madeleine dearly and we will be able to look them in the eye and say that we have done everything to help that search.

Journalist:

“How emotionally…[interrupted]

G McCann:

“I have to return to England today, I have work commitments that I couldn’t cancel at short notice. I will be leaving, Kate will be staying on and, um, I will take a few questions”.

Journalist:

“How emotionally draining has the last few days been? Do you feel that it has actually given maybe the Portuguese police and even, er, the media an opportunity to re… to well, to bring some old theories back to, er, back to the surface?”

G McCann:

“I think what’s been important is that things are being debated in a rational way in a court of law and that is the place where it should happened and that is where evidence is judged and can be done so within a legal framework”.

“From our point of view what’s happened in the last two days is I suppose in many ways expected - these are Goncalo Amaral’s witnesses. I think it is particularly disappointing that certain police officers within Portimao, who considered us as possibly involved in Madeleine’s disappearance, have not been able to change their minds, despite a lack of evidence, and it is these officers who have, are…who we are dependent on for pursuing the investigation within Portugal”.

Well, during a CIVIL trial, the following can't leave until the court rises:

judge
witnesses giving evidence
solicitors
stenographer
court usher.

Other people can drift in and out - McCanns (plaintiffs), Amaral (defendant), press, public etc.

It is not like Amaral is a criminal in a dock. It's not a criminal trial.

I Don't Know that the McCanns Ever intended On Giving Evidence -- I think their Lawyer Said that Only After Amaral's Lawyer spoke of It.

Remember this is Not the Full Trial yet.

The 'feed' from the court has been disappointing in terms of content - far too sketchy.

We needed to know the content of the evidence; the journalist has fallen well short IMO

I completely agree. He seems more interested in how the judge is looking than in actually reporting what's being said.

A sad waste of an exciting technology. imho.

It's a pity there aren't many posters about the last few days to join in the discussion.

So we continue to wait, but I can't help feeling the McCanns have read this one all wrong, been badly advised, and even if they win, they have done immense damage to themselves. I think we could see that today by Kate's demenour outside the courthouse, when she left to return home. Not a happy woman. If they lose, they could be facing massive court costs, and probably Mr. Amaral sueing them for loss of earnings while the book was banned.

As you may know, I dislike intensely the idea of anybody, particularly a person in privileged position writing a book which apportions guilt pre conviction, so we probably have different hopes about the outcome.

But I'll fully accept the judges decision whichever way it falls.

I don't think either of the parties went in to this thinking it would be easy - they would have known before it got as far as the courts what would happen and how much press interest there would be.

Surely though the book was based on the case files, which we are all entitled to see. I dislike being told what I can and can't read. The Mccanns themselves have put the spotlight on many, suggesting guilt; Murat and the dying cancer victim to name but two. They just can't handle it when the finger is pointed at them, the two people most likely by a very wide margin, to have been involved.

I don't know if anyone has mentioned this or not; but one of the witness's, from the TV company was asked if he knew that the programme was aired on Madeleines birthday. Apparently it was not. The programme as I understand it was aired in April and Madeleine's birthday is in May. Either my info is incorrect or the McCanns lawyer was either mistaken or pulling a fast one.
