Beyond reasonable doubt v on the balance of probabilities. Same evidence may be presented by both parties, but the test is having to be proven by the preponderance of evidence.

There is something wrong with the Legal process,as stated above?

Perhaps it is the "Stigma" attached to Rape cases on behalf of both innocent parties claims?

Where the Law was changed on Anonymity,which should be reversed if that is the case?

What you are seeing in today's " Modern World " is the process of so called "clever Politicians" on the implementation of Laws in a Court process,be it Civil or Crown Court!

The clever Politicians then have Police Commanders,CPS/DPP decide which are then Civil matters or Crown Court Jurisprudence,eg balance of Probabilities to Beyond Reasonable doubt,51% to 49%?

Perhaps it was this process that had let down the "Accuser",that the Crown Justice system had failed her,its a Civil matter now?

It all comes down to a matter of " Costs ",if you can afford to proceed with a Civil claim you can make a claim?

Whereas a Crown Court is funded by the state on these cases,the defendant has to meet their legal fees,with costs awarded after the Trail,For or Against! 

Too often now the Police are so quick to state,"Its a civil matter mantra",when in full knowledge they know different or the CPS/DPP guidelines state differently?

It would seem the Judge in the "Civil Case" implemented the case correctly and the Crown Court failings are now blatantly on show to the public how they are failing innocent parties in Court Hearings!

Or is this what happens in society,when you just keep cutting back on Public spending,you have an utter shambles being created by the "Clever Politicians" who instigated these changes in the first Place,but now hide behind Parliaments rules & Regulations when found out!
