I think that may be an old quote from Duarte, there does not seem to be anything new from any "source" since the fabulous news.

Kate and Gerry McCann lose legal battle against ex-police chief's book about Maddie

MADELEINE McCann’s parents have lost their appeal to Portugal's highest court over ex-police chief Goncalo Amaral's book.

Kate and Gerry McCann have lost a legal battle over a book about Maddie
Gerry and Kate McCann have been involved in an eight-year fight over a book written by Amaral, who led the initial hunt when then-three-year-old Madeleine vanished from their Algarve holiday apartment in May 2007.

Amaral was ordered to pay Kate and Gerry £430,000 plus interest in damages after losing round one of their legal battle in April 2015 over his hurtful book 'The Truth of the Lie.'

Appeal judges reversed the initial ruling by a court in Lisbon in April last year, siding with the former police chief and overturning a ban on his book.

The decision sparked a fresh appeal by the McCanns to the country's highest law court, which was lodged last May but heard today.

The McCanns' Portuguese lawyer Isabel Duarte was "out of her office" and not immediately available this afternoon to comment.

The ruling in favour of the ex-police chief last year was said to have left the McCanns "seething”, according to a friend.

Gerry and Kate McCannGETTY

Amaral is understood to have earned £344,000 from his book before it was banned and a subsequent TV documentary.

The book was released just three days after Gerry and Kate were told their status as arguidos or formal suspects had been lifted on July 21 2008.

The McCanns told the Lisbon court staging the Amaral trial in the summer of 2014 they were left "devastated and crushed" by his allegations.

Kate, 48, from Rothley, Leics, said Madeleine's twin siblings Sean and Amelie, now 12, knew about Amaral's allegations.

The ex-police chief was removed as head of the investigation into Madeleine's May 3 2007 disappearance after criticising British detectives.

Portuguese prosecutors reopened their probe into Madeleine McCann's disappearance in May 2014, and are now working in close coordination with Scotland Yard's scaled-down Operation Grange probe into the youngster's fate.

Last year Kate and Gerry revealed they had told their twins "everything" about Madeleine's disappearance and said the youngsters still remember her and talk about her often.

Could well be. I'm far from an expert, but I thought the Human Rights Court was there to hear cases of where real Human Rights have been breached.

Madeleine McCann police officer will not have to pay compensation over book

17:04, UK, Tuesday 31 January 2017

Madeleine McCann, from Leicestershire, went missing in 2007

The lead officer in the Madeleine McCann case will not have to pay compensation to her parents over a book he wrote about her disappearance.

Portugal's Supreme Court has ruled that Kate and Gerry McCann cannot sue former Portuguese detective Goncalo Amaral for libel.

Last April Mr Amaral, who had claimed that Mr and Mrs McCann were involved in their daughter's disappearance, won an appeal against his libel conviction.

After that, lawyers for the McCanns took the case to Portugal's top court.

In 2015, Mr Amaral was ordered to pay 606,000 euros to the couple as their two-year libel trial came to an end.

Now, Portugal's Supreme Court has decided that the allegations are protected under laws covering freedom of expression, the AP news agency reported.

Judges have decided that Mr Amaral's claims were not abusive and remained "within acceptable limits in an open and democratic society".

In defence, Mr Amaral argued that claims in his book, The Truth of the Lie, originated from the police investigation into the little girl's disappearance.

That investigation was closed after detectives found no evidence of a crime.

Madeleine was three years old when she vanished while on a family holiday in Portugal in May 2007.

Her disappearance triggered one of the most high-profile missing persons investigations in British history.

Re: McCann's v Amaral Appeal

Post by sallypelt on 31.01.17 17:41

This is Google translation of an article from the Correio da Manha, today

Pais de Maddie perdem recurso contra Gonçalo Amaral

The Supreme Court confirmed Tuesday the decision of the Relation to revoke the payment of compensation of 500 thousand euros by the ex-inspector of the PJ Gonçalo Amaral to the parents of Madeleine McCann, who disappeared in 2007 in the Algarve.

On April 19, 2016, the Lisbon Court of Appeal revoked Gonçalo Amaral's decision to pay 500,000 euros to the McCann couple, parents of the missing child in the Algarve, for damages caused by the publication of the book entitled "Maddie: The Truth of the Lie ".

In the book, the former PJ inspector raised suspicions that the child's parents were involved in the abduction.

According to a source of the STJ, the decision of the Supreme Court confirms the grounds that led to the decision of the Relation to revoke the payment of the compensation decided by the first civil court.

The same source explained that the advisory judges of the Supreme Court of Justice understood that "in a situation of conflict between the right to honor and the right to freedom of expression, the criterion of balance of interests, acting in accordance with the principle of proportionality and specificity Of the case, points to the freedom of expression of the defendant (Gonçalo Amaral), a creditor of greater protection. "

The decision was taken by Roque Nogueira (rapporteur), Alexandre Reis and Pedro Lima Gonçalves, of the 1st Civil Court of the STJ.

The appeal was brought by Kate Marie Healy Mccann and Gerald Patrick Mccann, Madeleine Mccann's parents.

On April 19, 2016, the Court of Appeal of Lisbon recognized Gonçalo Amaral the constitutional right to express his opinion and revoked the decision that forced the former PJ inspector to pay one to the English couple.

With the decision then handed down, Relação also revoked the ban on the commercialization of the book written by Gonçalo Amaral, which appeared in the sentence of the first instance.

In January 2015, the Lisbon Civil Court (Court of Justice) condemned Gonçalo Amaral "to pay each one" of the elements of the couple Kate McCann and Gearald McCann, "the compensatory amount of 250,000.00 (two hundred and fifty thousand euros) , Plus interest for late payment, at the statutory rate of civil interest, from January 5, 2010 until full payment. "

In addition to this payment, the court also decreed the prohibition of the sale and new editions of the book, also prohibiting new editions of the DVD, as well as the copyright transaction of the book and DVD.

The court had already proven that the book of PJ Gonçalo Amaral's former inspector had caused damages to Madeleine McCann's parents.

The defense of the parents of the disappeared child alleged that the book was given as ready three days after the Republic of Portimão's attorney, Magalhães Menezes, had drafted the filing of the case against the couple McCann, with notification date of July 29 Of 2008.

For the preparation of the book, in which the former coordinator of the Department of Criminal Investigation of Portimão Gonçalo Amaral PJ defended the thesis that Madeleine's parents were involved in the disappearance and concealment of the corpse of the child, the lawyer of the British family, Isabel Duarte, argued that the author used unauthorized and prohibited procedural documents.

Madeleine McCann disappeared in May 2007, when she was four years old, in the tourist village of Aldeia da Luz, near Portimão, where the family was on vacation

The below is a comment to the article above:

From ROLF

4:00 pm

Implicitly, the Court is considering the Inspector's suspicions as very pertinent. Suspicions that they reap, and in what way ... because to me the cheating that the British invented is more than evident ... and they were very effective in getting rid of the body of the child, that yes ...

They are facing around £433,000 plus interest plus legal costs

Great news, sense and justice at last.  The McCanns lost because they used the media incessantly to put across their version of events but wanted no-one else to have a say. Their main method of defence has eventually backfired.

Looking forward to the new book!
