They seem very cavalier in asserting this. Goncalo Amaral said nothing of the sort. I hope he sues the Independent.

Is there 'no-one', in position, at these 'news offices' that could have told Emma 'you cannot, and will not, state that GA 'claimed' that the McCan'ts 'killed' Madeleine'?

The 'libel' falls directly to E Henderson.

Whether the 'Indy' chooses to 'support' her, should she be 'sued', is a matter for them.

Maybe, maybe, 'they' want to be 'sued' and have various 'facts', about the 'case', exposed in a open court room?

Now 'that' could be 'explosive'!

Journalist (used loosely) Emma Henderson "If Ms and Mr McCann lose the latest battle, they could face a large pay-out to Mr Amaral, which would drain the public donations in the Find Maddie Fund which currently stands at £750,000. The loss would also hinder their on-going search for their daughter who they believe may still be alive."

Is she going for the sympathy vote of the donors here ? What a load of tosh !!!!

They haven't searched for Maddie since SY started their reinvestigation.    If SY with all their resources and staffing levels have been unable to come up with anything new then what are the odds that hiring a couple more PIs will do the trick?

IMO any money in the Fund should go towards repaying the taxpayer and any legal costs should be covered out of their own pockets.

Rocky A will win I believe, as I cannot understand how THREE appeal court judges who unanimously found in his favour will have left room for any point of law objection.

I'll 'answer' my 'own' question, if i may.

McCanns Appeal To The Supreme Court (re 'book ban' appeal overturned by 'appellate' court) 10 November 2010.

The McCanns travel to Lisbon as their lawyer, Isabel Duarte, announces that the couple have appealed to the Supreme Court of Justice over the Appellate Court decision to overtrun the ban on Gonçalo Amaral's book: "Maddie, The Truth of the Lie".

However, on 18 March 2011, the Supreme Court rejects the appeal and authorises the sale of Gonçalo Amaral's book about Madeleine McCann. The former PJ co-ordinator describes it as a "victory for democracy".

So, it 'looks like' the SC didn't (rejects) even 'entertain' the McCan'ts 'appeal' and their 'appeal' was NEVER 'heard' in a full session of the SCoJ.

If you accidentally or negligently overdose your child and they die that's killing.

If it's intentional, that would be murder.

The journalist has wriggle room.

That seems to be a common practice in Great Britain; they even talk about a "Calpol generation." In recent years, the possible presence of an antihistamine with sedative effects in Calpol has aroused great controversy. Recently, the same laboratory put Calpol Night on the market, whose ingredients clearly list that it contains an antihistamine.

The mother admits having taken some to Portugal. She insists though that there is no calming effect, its being composed solely of paracetamol, and that she did not give any of it to her daughter during the holiday. At the time of her disappearance, Madeleine was sleeping in the same room as the twins. The latter, in spite of the noise, the mother's screaming and the comings and goings, did not wake up, as if they had been given sedatives. Would there not be a link between that difficulty in falling asleep and Madeleine's tragic end?

He refers to both sedatives and calpol and it seems he's equating the two.

Anyway, that matters not.

He is saying that the parents may have accidentally overdosed Madeleine.

That's an accidental killing.

Journalist get out of jail free card.

He has never claimed "they killed".

Even if it is argued that he said sedatives MIGHT have been involved, he could only then say she MIGHT have died as a result.   So not a categorical statement as suggested by that headline at all imo.

For 'libel'.. it was!

She's still in 'trouble' though, this time........ from the McCan'ts!

She mentions 'Madeleine's death'

Nobody is going to 'donate' to their private limited company 'fund' to 'search/hunt' for a 'dead' Madeleine!

Didn't they 'sue' GA for 'hampering/harming/hindering' the 'search' for a LIVE Madeleine, by his 'suggesting', after the PJ's conclusion, to their investigation, that Madeleine was 'dead' albeit, accidentally?
