Poppi Worthington: Father abused baby before her death, judge rules
               
A 13-month-old girl was sexually assaulted by her father shortly before her sudden death, a judge has found.
Poppi Worthington was found with serious injuries at her home in Barrow in December 2012.

Her father, Paul Worthington, 47, was arrested on suspicion of sexual assault but not charged with any offence.

He always denied any wrongdoing and issued a statement saying he did not accept the latest findings and had never hurt his daughter.

Fresh evidence would be required to launch a new criminal investigation.


Investigation: Key dates

High Court family judge Mr Justice Peter Jackson, sitting at Liverpool Crown Court, ruled that - on the balance of probabilities - Mr Worthington "perpetrated a penetrative ... assault on Poppi".

The death of the toddler had been shrouded in secrecy, with a 2014 fact-finding civil court judgement being kept private so as not to prejudice any criminal proceedings.

Last month, three medical experts gave evidence in open court stating they disagreed with the findings of Home Office pathologist Dr Alison Armour, who believed Poppi was the victim of "a penetrative sexual assault".

In his judgement, Mr Justice Jackson said he could not accept Mr Worthington's evidence relating to the collapse of Poppi at the family home and was "not impressed" with his account of the events leading up to her death.

On 12 December 2012, Poppi awoke screaming at around 05:45 GMT, according to her father, and an ambulance was called.

On admission to hospital and at post-mortem the youngster was found to have an earlier fracture of her right lower leg and other suspected acute injuries.

'Truthful account'


A statement released by Mr Worthington's lawyers said: "Mr Worthington does not accept the findings of the court.
 
"He is saddened that after having been given a plausible alternative medical opinion by the well-respected Dr Cary that called into question key findings made in March 2014, and also having three medical experts ... all stating that evidence to support a finding of abuse was lacking, the court has decided to prefer the evidence of Dr Armour.

"Mr Worthington maintains that he has given a truthful account of the events of 12.12.12 and that he has not hurt his daughter."

The youngster was buried in February 2013, precluding a further post-mortem examination, after her body was released by then local coroner Ian Smith.

Cumbria Police announced in March last year that no charges would be brought against anyone over Poppi's death.

Lawyers representing Mr Worthington, who was not in court for the latest judgement, had told Mr Justice Jackson he was a "doting and loving" father and there was "no sufficient evidential basis" to suggest he abused his daughter before her death.

Based on medical evidence, Mr Jackson believes Poppi's father sexually assaulted the toddler before she died. But what happens next?

A new criminal investigation needs fresh and compelling evidence.

Paul Worthington was previously questioned by police and no charges were brought. He denies any wrongdoing.

The judge has also criticised the way Cumbria Police and Cumbria County Council investigated the case, adding neither Poppi nor her family "received the professional response to which they were entitled".



Mr Justice Jackson said: "Careful assessment of the meticulous pathological and paediatric evidence has clearly established that [Poppi's] injuries were the result of trauma from outside the body.

"My finding (in the previous judgement) was that the father perpetrated a penetrative ... assault on Poppi ... That remains my conclusion."

It emerged previously that senior detectives thought pathologist Dr Armour "may have jumped to conclusions" when she raised suspicions about Poppi's death as they decided not to investigate until the full post-mortem report was ready - but it was not finished until the following summer.

The Independent Police Complaints Commission (IPCC) is reviewing how Cumbria Police conducted its investigation into Poppi's death.

It has already emerged that officers failed to preserve vital items for forensic analysis, either at the home or at the hospital after Poppi's collapse, and the scene at the house was not properly secured.

There is now said to be an "absence of evidence" to find out how Poppi died or definitively prove if or how she was injured following the botched police investigation and her burial. All the medical experts who have reviewed the case agree the cause of death is "unascertained".

The IPCC is due to present its findings following a second inquest into the youngster's death, which is yet to be held.

Responding to the latest judgement, a Cumbria Police spokesman said: "The Constabulary are fully aware of Mr Justice Jackson's criticisms of the initial investigation and have assessed these.

"One officer was suspended and has since retired, another two were moved into different roles. One of those officers is currently undergoing performance proceedings and the second officer has been dealt with by management action.

"The Constabulary will support any future inquest or hearing into this death and have cooperated fully with the IPCC investigation.

"Whilst performance proceedings are active and an inquest is to be held we are unable to comment any further."

Mr Worthington, who claimed that his daughter could have died as the result of a viral infection, was informally interviewed by police in 1995 over his association with someone who may have committed offences against children and, in 2003, was the subject of an unrelated allegation which was later retracted.

It also emerged that he watched pornography on his laptop in bed in the hours before Poppi's death, which he described as "involving adults".

Cumbria's police and crime commissioner Richard Rhodes said: "Once these legal and statutory proceedings have concluded I will be holding the chief constable to account over this very serious matter."

I hope 13 month old BABY Poppi put up a good fight before he killed her.

Sad 

It's just to awful to think about what these poor babies and children go through at the hands of...their father!

My daughter has to deal with ar$eholes like this (sorry, Tony, I know you don't like this sort of language) in her capacity as a CID child protection police officer. She regularly goes home in floods of tears because of what she sees.

Police officers are thought to be made of steel, but they have feelings too, especially when it comes to babies and children.

I'm glad she gets to lock up creatures like this.

I find it somewhat astonishing of the apparent incompetence of Police Officers in not securing the family home in order to retain any evidence of any purported criminal actions that involved the Death of such a young child, there may be other sections of care that may have failed her in her demise?
What is most alarming is the amount of time that has passed in the revelation of facts that did not get reported on,why the delay? 
Was this some sort of subterfuge of these facts that could appertain to claims possibly taken against "Authority figures" if it can be proven that they ultimately failed in a duty of care towards Poppi's demise? 
It truly is a very unfair sad world that we live in, when person's cannot be held accountable for the children they have a duty of care for in our society?

Ministers have been urged to call a public inquiry into the case of a 13-month-old girl whose death may remain unsolved because of “grotesque” police failings which have denied her justice.

Probably nothing we didn’t already know or suspect, but the Coroner’s report is out today, but ‘a conclusion of unlawful killing was not available to him as he was not satisfied beyond reasonable doubt that Poppi died from an act of murder or manslaughter.’
 
OK, I suppose I can just about give him the benefit of the doubt on that one, but he states categorically that she ‘was sexually abused by her father before she died’ yet nothing is being done about it????????

Toddler Poppi Worthington was sexually abused by her father before she died, a coroner has ruled, finding her death was caused by asphyxia.
Coroner David Roberts said Paul Worthington assaulted his daughter in his bed, laid a cover over her and went to sleep.
He said she died because her ability to breathe was compromised as a result of "an unsafe sleeping environment."
Mr Roberts said her father's account of events did not "stand up to scrutiny".
 
Latest updates as the coroner delivers his inquest findings
During the three-week inquest at Kendal Coroner's Court, Poppi's father declined to answer 252 questions relating to the circumstances surrounding her death on 12 December 2012.
However, Mr Worthington did tell the hearing he had gone to get Poppi to get a fresh nappy and said a few minutes later he reached over and found her limp.
He said he then rushed downstairs and Poppi's mother, who was asleep there, called an ambulance.
The 13-month-old was pronounced dead at Furness General Hospital shortly after.
Mr Roberts said a conclusion of unlawful killing was not available to him as he was not satisfied beyond reasonable doubt that Poppi died from an act of murder or manslaughter.
He added Poppi was suffering from an upper respiratory tract infection which, along with being placed in her father's bed, compromised her ability to breathe.
In January 2016 - as part of family court proceedings involving Poppi's siblings - a judge revealed his findings that Mr Worthington "probably" sexually assaulted his daughter shortly before her death.
Mr Worthington has denied any wrongdoing and has not been charged with any offence, with the Crown Prosecution Service saying there is insufficient evidence.

Poppi's father 'considering next legal move'



A solicitor representing Paul Worthington, Poppi Worthington's father, said he is considering his options and has been advised not to say anything further.
Mr Worthington declined to answer the majority of questions put to him during the inquest into his daughter's death, and the coroner concluded his evidence "did not stand up to scrutiny".
The Crown Prosecution Service has twice decided it does not have the evidence to prosecute Mr Worthington and he has always denied any wrongdoing.

Police will ask CPS again about prosecution
 
Cumbria's Chief Constable Jerry Graham says he will be holding an early meeting with the Crown Prosecution Service after today's findings at the inquest into the death of the Barrow toddler Poppi Worthington.
 
The inquest heard that an investigation by Cumbria Police was so botched that vital evidence was lost, so exactly what happened to Poppi will never be known and no-one will be charged with any offence over her death.
Speaking at the end of the inquest in Kendal, Mr Graham said much of the evidence had been uncomfortable listening for the force and he repeated his apologies to Poppi's family for the deficiences in the police investigation.

‘Poppi and her family deserved a better standard of investigation than the one we conducted five years ago."

Poppi's mother 'now closer to the devastating truth'
 
Poppi Worthington's mother, who cannot be named for legal reasons, looked red-eyed and close to tears for much of today's three-hour hearing. 
She cannot be named, to protect both her and other members of the family.
But her lawyers told the hearing that she had been waiting five years to find out what had happened to her 13-month-old daughter.
Today, sitting alongside her legal team she left the inquest twice, the first time during graphic medical evidence about her daughter, and a second time after the coroner reached the point where he ruled Poppi had probably been abused before her death. (This appears to be incorrect – see below)
Afterwards she said through a solicitor that she was disappointed Paul Worthington refused to give evidence and “considers he should have given the coroner the crucial evidence on Poppi’s last few hours”.
The lawyer, Fiona McGhie, said: “(Poppi’s mother) is grateful to the coroner and relieved that, despite the gaps in evidence, she is now closer to the truth, however devastating that truth might be.”

Appalling, what justification can they not, I wonder what the CPS are really about, is it not wanting to spend money or just that they don't want to fail if they believe not enough evidence? What more evidence do they need; .the whole system in this case has failed this little baby girl!

my comment posted in the mail.
Any bets they won't post it?

She shows signs of physical abuse as in fractured limbs which had not been treated & signs of  recent sexual abuse.
The last person to see her & has admitted such is her father.
Her DNA was found on his penis where it should not have been.
He refused to answer over 250 questions to prevent himself incriminating himself, the UK version of pleading the 5th.
An innocent person would have  cooperated completely.
All the circumstantial evidence points to him abusing and raping his baby daughter.
If he did not do it then he would be able to prove such in a court of law, the evidence would clear him.
In his statement he does not make a reliable denial
I do wonder how old the fracture was to Poppy's leg & why she had not been taken to hospital as it was clear she would have been in pain.

I wonder just how much the mother knew since it would have been clear to her that Poppy was in pain.
This makes me wonder if DV was going on in the house & mainly the father were known to CPS & the police.
