COMPLAINTS TO IPSO ABOUT RECENT PRESS COVERAGE OF THE MADELEINE MCCANN LIBEL TRIAL RULING: No. 1 - Daily Express, 29 April 2015
I have studied and copied the last week's mainstream press coverage of the Lisbon judge's ruling in the long-running case of McCann & McCann v Dr Goncalo Amaral and others.
In my judgment, many of these reports contain serious inaccuracies and, on that basis, members of the public are able to make complaint to the new press standards body, the Independent Press Standards Organisation.
Given the intense media coverage of this case for the past 7 years, accuracy in reporting it should surely be the No. 1 aim of any journalist and his/her editor.
I should emphasise that the new press code does allow newspapers to be 'partisan'. Complaints must be limited in most cases to challenging the accuracy of any report.
With that in mind, below is my complaint to IPSO, already submitted.

re: Daily Express Front Cover, 29 April 2015 – Complaint
I wish to report the Daily Express for a breach of the Press Complaints Code, in its headline on the Madeleine McCann case of 29 April, which ran:
“MADDY Detective did lie about death cover-up claim”.
This is untrue. The detective (Dr Goncalo Amaral) did not lie. The court case in Lisbon which required him to pay the McCanns 500,000 euros compensation did not say that he lied about anything. I can say this as I have studied an English translation of the full, lengthy decision of the judge, which runs to over 50 pages of A4. There is no accusation within that judgment that Dr Amaral lied.

It is relevant also to point out that this judgment defies earlier rulings of the Portuguese Court of Appeal (October 2010) and the Portuguese Supreme Court (March 2011) which decided that Dr Amaral’s book should not be banned. Below I set out the core ruling in those two judgments:

The indicative facts that led to the McCanns being made formal suspects [arguidos] in the initial investigation were not deemed by the Ministry of Justice to be sufficient to lead to anyone being charged with any criminal offence. But those very same facts, seen through another prism and from another foundation, may well lead to a different conclusion from that reached by the Justice Ministry. The evidence that was deemed to be insufficient for a criminal prosecution can be understood in a different way, for example in an interpretation that can quite legitimately be published as a work of literature, so long as the said interpretation does not offend the fundamental rights of anyone involved. And as we have stated above, we have explained why the interpretation in Dr Amaral’s book does not offend the McCanns’ rights.
To sum up: The main purpose of the book at issue in these proceedings - ‘Maddie: The Truth About A Lie’ - which was written by the defendant, Dr Goncalo Amaral – is to defend his personal and professional integrity, as the author himself points out straightaway in his preface, and throughout the text. The contents of the book do not violate any of the McCanns’ [the applicants’] fundamental rights.
The actions of its being written and published are justified under the constitutional rights which belong to all of us by virtue of the European Convention on Human Rights and by Articles 37 and 38 of the Portuguese Republic’s Constitution.
Since that is the view we have taken on the matter, it follows that the decision made by the court [in September 2009 and confirmed by the court in February 2010] must be revoked.
The appeal by the defendant Goncalo Amaral in these proceedings is therefore allowed.

In both cases, these higher Portuguese courts awarded costs against the McCanns.
The Daily Express failed at the time (2010 and 2011) to report that ‘The Truth About A Lie’ had been unbanned. Similarly, on this occasion, the Daily Express filed to inform its readers about those decisions. It therefore, inaccurately, failed to inform its readers that the decision of the lower, Lisbon court flied in the face of the decisions of the two higher courts. As a consequence, it failed to inform its readers that the decision was perverse and stood every chance, once again, of being successfully appealed by Dr Amaral in the higher Portuguese courts. This means that Daily Express readers were thoroughly misled about the significance of this latest decision.
However, to return to the main charge against the Daily Express, it shouted on its front page to its readers that Dr Amaral was a liar who had lied to the court. This is an utter travesty. The judge simply ruled that, in her judgment, his opinion on the case should hot have been published. That is wholly different from the charge of ‘lying’ which the Daily Express has levelled against Dr Amaral.
The Oxford Dictionary defines a ‘lie’ as ‘a deliberately false statement’. There was nothing in the Lisbon judgment decision that remotely accuses him of making a false statement of any kind, deliberate or otherwise.
Remedy sought
The Daily Express must publish a withdrawal of their false claim than Dr Amaral lied and must apologise for it. It should explain in any correction which IPSO may authorise that the judge merely said that he was not entitled to publish his opinion. The Daily Express should add that the judge’s decision contradicted the earlier decisive rulings of the two highest Portuguese courts that under the European Convention on Human Rights Dr Amaral was entitled to publish its thesis.
I add that I do not complain on Dr Amaral’s behalf. My complaint is founded on a seven-year long in-depth study of various aspects of the disappearance of Madeleine McCann and a detailed working knowledge of the six-year-long libel trial of Dr Amaral in particular.

I've never bothered to complain officially but please give me an outline text to complain about the centre pages of The Sun calling Goncalo Amaral a monster and I shall.
What The Sun published was a step too far for me. It was immoral, unjust, unfair, unfounded and unbalanced.

Tony, mightn't it be a good idea to send IPSO a full copy of the April 28th ruling (if one is available in translation), so that it can be clearly seen that she didn't accuse him of lying?
Would it be possible to complain about the disgraceful article in The Sun at the weekend, or would that be considered a partisan matter, not a matter of accuracy?

But the ball is now in IPSO's and the Express's court anayway - as they will have to prove that the ruling says that Amaral 'lied'.

Many thanks to Tony Bennett and others like him for all the hard work on this case. It realy does show how the media and establishment work. Untill taking an interest and reading about the case Two or Three years ago i would never have believed how the media twist words about and lead folk in the wrong direction. How many things have they twisted/lied about in the past? I posted a similar comment on the fund site. Thanks to the internet people are becoming aware of how things realy work. I applaud you sir. Your steadfast adherence to justice in this case, your dogged perseverance despite all adversity is to be admired as is the hard work and tenacity you've shown over the past years.
Strong criticism has been leveled against you (as you well know), often resulting in downright personal abuse. Criticism is debatable providing it's to your face, which gives the opportunity to counter the criticism, rather than trivial nit-picking behind your back but if people find it necessary to abuse you personally - then you know you're winning.
I'm no sycophant but credit where credit is due. Bravo that man!

PRESS COMPLAINTS CODE - CLAUSE 1 - ACCURACY
IPSO has replied asking me which precise part of the new Press Code of Practice applies to my complaint against the Daily Express.
The complaint is made under CLAUSE 1: ACCURACY - as follows:

Clause 1 Accuracy
i) The Press must take care not to publish inaccurate, misleading or distorted information, including pictures.
ii) A significant inaccuracy, misleading statement or distortion once recognised must be corrected, promptly and with due prominence, and - where appropriate - an apology published. In cases involving the Regulator, prominence should be agreed with the Regulator in advance.
iii) The Press, whilst free to be partisan, must distinguish clearly between comment, conjecture and fact.

I may complain about the use of the word "Monster" if I can find the words to do so. At the moment I`m too angry.
Such a word is usually used for such people as ISIS and other fanatics, serial killers, perverts, paedophiles, psychopaths, etc.

Whereas BOTH McCanns DID lie,
Gerry corrected his first lie in his second statement, when he changed his alleged point of entry from Front door using his key - to unlocked patio door
Kate changed the wide open curtains of her police statement, to Tight closed and whooshing, but has never bothered to set the official Police record "straight"
Those were merely the first ones.
