Libel Trial Postponement: The Truth about the McCanns' Lie - by Nigel Moore.

The truth about the McCanns' lie,

17 June 2014

The McCanns outside the Palace of Justice

By Nigel Moore. mccannfiles.com
17 June 2014

Yesterday, outside the Palace of Justice, in Lisbon, following the postponement of court proceedings, the 'furious' McCanns raged:

Gerry McCann: "This is the fourth time that this has happened, when we've travelled to Portugal."

Kate McCann: "...this has happened now about four times, as Gerry said this can't be seen as anything but blatant and cynical."

So, no ambiguity there.

Needless to say, the tabloid media were not slow in picking up the McCann baton and running with it. Gary O'Shea (The Sun) was typical of most of the coverage: 'The parents of Madeleine McCann spoke out yesterday after an ex-cop deliberately delayed his libel trial for the FOURTH time.'

But what is the truth?

On 12 September 2013 Kate McCann attended, for no obvious reason, other than to deliver an 'emotional' statement outside the court for the waiting media.
- There was no postponement.
The following day 13 September 2013 Kate McCann attended, as an observer, with her mother who was due to appear as a witness.
- Proceedings were halted at lunch time after the judge failed to return due to a personal issue.

On 27 September 2013  Gerry McCann attended court, with sister Trish Cameron, even though he was not due to appear as a witness.
- Postponed due to illness of Gonçalo Amaral's lawyer's son.

On 02 October 2013 Gerry McCann once again travelled from the UK in the hope of being admitted to the process as a witness, thus allowing him to give evidence. However, the judge decided she would not rule on whether he could give evidence until after October 16.
Kate's mother, Susan Healy, also made the trip, for her second time, but was not allowed to give evidence due to a blunder by the McCanns' lawyer, Isabel Duarte.

On 07 January 2014 the impending libel trial was postponed as Gonçalo Amaral's lawyer filed a request for the court to evaluate the McCann couple's legitimacy to file a lawsuit in their daughter's name, as she is a Ward of Court in the UK. He did not ask for any postponement. It was the judge that issued a 15-day deadline for him to submit the relevant documentation.

Afterwards, Isabel Duarte filed a document related to Mr Alan Pike, and asked for a postponement of the session. The McCanns did not travel.

And?

That's it.

- One half-day postponement due to a personal issue relating to the judge.

- One postponement due to the illness of Vitor Santos de Oliveira's son who required hospital treatment.

- One occasion when Kate's mother, Susan Healy, was not heard due to a blunder by the McCanns' lawyer, Isabel Duarte but proceedings were not postponed, as Trish Cameron was heard.

- One postponement at the request of the McCanns' lawyer, Isabel Duarte, when the McCanns did not travel.

In total: Kate travelled once. Gerry travelled twice.  On no occasion were they due to be heard as witnesses - it was their decision to travel .

On no occasion were they denied their 'day in court' due to the postponement of proceedings.

So the accusation that Gonçalo Amaral has manipulated the postponement of the trial for the 'FOURTH time' is a blatant and cynical lie by the McCanns, lapped up without question by the mainstream media .

The truth is, this is the FIRST time (get that, Mr O'Shea?) that a decision by Gonçalo Amaral has directly affected the proceedings.

But then, why tell the truth when you can sell stories?

Libel Trial Postponement: The Truth about the McCann's Lie by Nigel Moore.

Post by Monty Heck on 17.06.14 19:33

Thank you Nigel for setting the record straight so succinctly.  Even though KMcC had very much given the game away with her "about 4 times" comment (surely she should know exactly how many times this had happened) still no checking of facts before going to print.  Of course, GMcC turned up twice and wasn't due to be heard, his wife once, ditto does not a heartstring tug.  This happening once would have been inconvenience enough for most people after travelling a long way but it seems no media report on this case is complete without a disingenuous and preferably also xenophobic slant.  Poor show from all parties concerned but much as expected.

First class analysis of the truth. It would be fantastic if one of the few credible UK newspapers picked up on the truth of this subject and published it. This would sell papers and pigeon hole the McCann's for what they are...

Interesting that also on the Mirror page is a piece about Dunblane and a piece about a DNA hoax.

I wouldn't read any clever-clever  artifice into the juxtaposition of these other items, BlackCatBoogie. Had you heard the venomous bile Kevin Maguire (Daily Mirror)poured on Goncalo Amaral last night in the Sky paper reviews, ably supported by that other ill-informed windbag, Andrew Pearce of the DM, you would not waste any more time on that score.  Far too subtle an idea to attribute to these two, I'm afraid. No, the McCanns' version of events reigns supreme with these pseudo journalists and sycophants. The McCanns come before a dead child every time.

Come the day this pair bestir themselves to look at the other side of the story they will likely not have a newspaper to run -with any luck. And wouldn't that strike a positive blow for re-discovering our democracy?

Brilliant succint post!  Thank you!

This stuck out to me as one of the oddest parts of the press statement.

They likely couldn't tell the truth if their lives depended on it, imo. I think they actually believe their own **** now.

So it was just a temper tantrum at things not going their way. Petulant, childish antics that show them up for what they are. HadKate not said 'about four times' I wouldn't have picked up on it. As it stands she has made herself look utterly desperate.

They really don't like being played at their own game, do they.

Tasprin will you contact the msm with this superb observation?

I knew the moment that woman uttered the words "four times" that it was an outright lie. That breakdown by Nigel should be sent to every newspaper editor. Not that they would do anything about it. They've all had their shame glands removed.

The press may all be labouring under legal restrictions re the McCanns but it doesn't mean they have to go the other way and lie for them.

Journalists disgust me. I can't bring myself to read newpapers any more. What's the point? As soon as you pick one up you know you are reading a tissue of lies mixed with a smattering of truth. I don't have the time or inclination to go through picking out which is which any more. I go online, contrast and cross-reference to get the best chance of finding out what I need to know. I think this is happening more and more.

@Monty Heck wrote:Thank you Nigel for setting the record straight so succinctly.

Unfortunately, on this rare occasion, Nigel has not really set the record straight.

It appears he has clean forgotten the first occasion - when the libel proceedings due to be opened on 11 December 2009 were delayed - after the McCanns had travelled to Lisbon, when Goncalo Amaral announced that the proceedings must be adjourned because his lawyer had 'swine flu'.

Just to prove that this was the first such occasion, here (sourced from mccannfiles, where else?) are two of the press reports about this hearing:

+++++++++++++++++++++++++++++++++++++++++++++++

Influenza A may postpone the McCann hearing Jornal de Notícias

ALEXANDRA SERÔDIO
11 December 2009, 00h31m

Gonçalo Amaral's lawyer is in quarantine and has already notified the court. The McCanns arrived in Portugal yesterday.

[picture]

Gonçalo Amaral's lawyer is in quarantine at home, after learning that an employee of his office has influenza A. António Cabrita has requested the postponement of the trial of the book "The Truth About The Lie."

The first session of the trial process against the book by the former coordinator of the Judicial Police, is scheduled for 9:30 pm today, at the 7th Circuit Court Civil Court of Lisbon, in the Courthouse. The prevention of Gonçalo Amaral's lawyer can dictate the postponement of the trial, which would then be likely to occur in about 21 days.

The quarantine state of António Cabrita was known at the end of yesterday afternoon, a time when Kate and Gerry McCann were already on the plane to Lisbon. The couple, who arrived at the Portela Airport shortly after 23:00, were still unaware of the possible postponement of the session.

Confirmation will only be given today by the judge who will judge the case. It will be the judge's decision whether to postpone, or not, the start of the hearing and set a new date. Anyway, the seven witnesses called by Gonçalo Amaral and called for today's session are to appear in the Courthouse. The prosecutor of Portimão, Magalhães e Menezes, who signed the order to close the investigation into the disappearance of Madeleine, Luis Neves, Director of the National Counter-Terrorism who helped coordinate investigations and Guilhermino Encarnação, the former director of the PJ of Faro, are some of the witnesses for Amaral.

The trial process also involves the publishers Guerra & Paz, who edited the book "The Truth About The Lie", a media company that produced a video and a TV channel that aired a documentary.

The evaluation is based on the application for interim relief brought on by the McCanns in May on behalf of their three children, Sean, Amelie and Madeleine, in order to withdraw the book of Gonçalo Amaral and the documentary based on the same work. And to stop the sale of copyright abroad by publishers Guerra & Paz and also prohibit the former policeman from continuing to speak publicly about his thesis of the case.

"I came for the trial tomorrow. We're here to ensure that freedom of speech does not allow the truth to be distorted. And [Gonçalo Amaral] distorted the truth. We're not here because of him. The law will produce justice," said Gerry McCann on arrival at Lisbon airport.

+++++++++++++++

AFP

Gerry and Kate McCann's court battle with an ex-police chief who believes their missing daughter Madeleine is dead has been put on hold.

The couple were due to ask a Portuguese judge for a permanent ban on sales of a book by Goncalo Amaral in which he challenges their version of Madeleine's disappearance.

But the court hearing in Lisbon has been postponed for one month because Mr Amaral's lawyer has swine flu.

Before the announcement, Mr McCann told Sky News that he wanted to "make sure that freedom of speech doesn't allow the truth to be distorted".

"We believe the book has damaged the search for Madeleine," he said.

"If people read it and believe she is dead then they will not keep looking for her and may not come forward with information they may have."

The couple are expected to ask the judge for around a million pounds in damages which they will use to pay for their own continuing hunt for their daughter.

Madeleine was nearly four when she vanished without trace from the family's rented holiday apartment in Praia da Luz on the Algarve coast in May, 2007.

She had been left with her twin siblings in bed while her parents dined nearby with friends.

The McCanns are sure she was abducted and believe she is still alive.

Mr Amaral was a senior officer in the investigation but was removed from it before it was abandoned after 15 months.

In his book...

Chatelaine, you can be utterly amazing sometimes.

I provide this forum with a completely sourced correction of Nigel Moore's article.

And I am a 'pain' and asked: is it material?

I thought you were a great champion of 'the truth at all costs'.

Was I wrong?
