McCanns to appear in libel trial on Monday 16 June

According to this article published less than an hour ago on the Mirror's website, the McCanns are going to appear in court next week in the libel case.

Apparently "The couple won the latest round in their long legal battle to silence ex-police chief Goncalo Amaral - who claims they were responsible for Madeleine's death." (Their demand for £1million is only mentioned much further on.)

Moreover, "The pair will describe how the cruel and malicious lies from Amaral have caused them unnecessary grief and hampered the search for Madeleine."

You wouldn't be able to say that in a British newspaper if the libel case were in England.

And it gets more ridiculous. "They have both been granted permission to give emotional statements in a Lisbon court on Monday." (Really?)

"Kate, 46, and Gerry, 45, learned they will be allowed to speak in court shortly after they told of their renewed hope that their daughter could still be alive."

So it is looking as if the latest dig effort may have been to help with their PR. Either that or they will feel the strong arm of the law when they go to Portugal. I dearly hope it's the latter but think that's unlikely.

"A source close to the McCanns said: 'Finally it looks like drawing to a close and they are hopeful they can win the case.'"

"'They both want to see an end to it. The poisonous lies said against Kate and Gerry have caused them great distress and have hindered the search for Madeleine.'"

"'It will be the final stage of the trial and there is not expected to be any cross examination.'"

So the man they've taken to court and are demanding £1million from won't get, or won't want, a chance to test their personal evidence against him? And nor will the judge? Really?

"Kate and Gerry have applied to give declarations, the court has now agreed and they have been asked to be present in person on Monday."

"They will describe the impact that Mr Amaral's comments have had on them and the wider family."

"The judge will listen, assess it and retire to consider a verdict. It is the final stage of the court procedure but judgement will be reserved."

The impact is entirely irrelevant to the question of whether there was a libel or not.
They have been given permission to make emotional statements - as opposed to factual ones ?

I am confident the judge will see right through it. She cannot be unaware of the continuing search which has so obviously NOT been affected by anything Dr Amaral wrote.

But as long as, (as JeanMonroe said on another thread) the judge doesn't get nobbled.

If she does and with the OverWhelming amount of video, Kate's book, interview, police reports, active investigations, PJ files in the public domain, the dogs signalling, and so on and so forth, then we will Definitely Know Know that there is political interference from on high.

A different tack will then be called for.  shark

Will SY or PJ have someone in the public gallery?

Might the judge have ordered the McCanns to be present?

If there really were going to be no cross-examination, even by the judge, then the only possible reason for them to give evidence orally would be so that the judge could assess from their verbal performance how much credit to give it. Otherwise they could give their evidence in writing.

Whatever standards Fleet Street have - and we all know they are pretty low standards - seem to go out of the window where the McCanns are concerned.

Not only has Snr Amaral's book "The truth of the lie" not hampered the search for Maddie

but A Scotland yard statement described the recent investigation as the

"largest ever undertaken by UK police overseas in a case of this type".

And wasn't it Andy Redwood of the MET who said recently that Madeleine may have not left apartment 5A alive?

Wasn't it also mentioned within the last few days by the MET that Madeleine could have been killed and then buried within a short distance of the OC?

"KILLED": a very strong word, not one to be ignored, by anyone.

Claimed they murdered M? I really don't think that is true. If I was GA I'd be suing.

Claimed they murdered M? I really don't think that is true. If I was GA I'd be suing.

Let's hope he sues all and sundry, there are numerous people, newspapers, TV news channels who have dragged his name through the mud.  If the McCanns can sue anyone and everyone and they stiill have not been proven as to if they had any hand in Madeleine's disappearance, it is right that GA should be able to sue for just doing his job and then being castigated for it.

If this were a Hollywood movie, the courtroom scene would be where the activities of the last week come to crescendo.  McCanns on the stand, under oath.  Police holding new evidence they've kept secret.  The phone records (possibly) putting the couple on scrubland the morning of May 4th.  The big reveal....  Alas, this is not a movie.  But I can't help but wonder why the McCanns stayed away this week but are travelling next week.  Something smells wrong, and not just in their wardrobe.

Didn't Goncalo Amaral also ask permission to speak?  I'm sure he did.

I don't know what the McCanns hope to achieve by appearing, imo, they are no more sympathetic than their witnesses, and I too have great faith in the Judge. 

They are huge risk takers if they go ahead with their trip, especially when we remember how they hotfooted it out of Portugal as soon as they became arguidos.  I'm still of the 'I'll believe it when I see it' train of thought, they have often said they would do things, then backed out.  A lie detector test for example.

However, the announcement was made by their 'Official Spokesman' and it would do their cause more harm than good if they back out.  It may of course be that they are in no more danger of being arrested in Portugal than they are in the UK - they may even wish to flaunt the fact that the police have no evidence. and use it in the same way they used the twisted version of the Portuguese shelving report to declare themselves innocent.  This could be a moment of 'told you so' from the Whitewashers, as they may claim lack of evidence found in digging rules them out the death in the apartment theory.  The McCanns have got away with whoppers for years, why should they not bring this one into play?

I am quite amazed at the confidence in this announcement, its a huge message to the haters that the McCanns have nothing to fear in returning to Portuguese soil  It is even more astounding when we look at all the rigid demands and conditions insisted upon by the Tapas group in order to return for the reconstruction.  Amongst other things, they demanded the 'McCanns' arguido status lifted, and assurance that they themselves would not be made arguidoes or arrested.  On legal advice they decided not to go.

The libel case however is a different kettle of fish  It involves a substantial amount of money.  Its not about how much they will win, it is about how much they will lose.  There are three Defendants to this action. Losing this case will probably wipe them out financially, not to mention loss of reputation, and a bucket load of counter suits, this case means everything to them.  They still have the mantra 'there is no evidence', even after two police forces have dug up half of PDL.  How smug they must be, and how infuriated must be those looking for the evidence to get justice for that little girl, they are certainly leaving no stones unturned - quite literally. 

But its all about the money.  The loss of a libel trial this size can and does lead to ruination.  Even if the police never find enough evidence to prosecute, the McCanns will still suffer a catastrophic financial loss - there is no way they can win the libel trial.  The Portuguese public, who have less sympathy for the McCanns than he British, have just seen two police forces dig for the child's body in the vicinity of where the McCanns were staying!  It would be political suicide for any Judge to award these two former arguidoes 1m Euros or whatever it is after the fraudulent claim for Madeleine was removed whilst the police are actively searching for her body. 

I have to say I will be astounded if they turn up.  Hopefully we have some friends in Lisbon who will keep us updated, though if they are both going to turn up, it may hit the mainstream.  I wonder if this is reminiscent of Gerry's call to the press when they were fleeing Portugal, 'we will be on early morning flight **** be there'.  There is certainly a touch of drama about all this, the final showdown so to speak.  Ooer, roll on Monday.

God only knows with this couple! Might it have been a slight of hand? Look here type of thing? Just speculating obviously. But the point remains how can they pursue Amaral for hindering the search for Madeleine with all this in the open. 

It's clearly self preservation because he called it as he saw it and implicated them in whatever it was that happened the poor child.

Apparently so, but ditched him pretty quickly (was that because he believed Madeleine to be deceased I wonder).

I'd be more impressed if he used a single hair rather than a hairbrush filled with Madeleine’s hair mixed with the twins (they shared a hairbrush as well as a toothbrush?!) to show how the tracking works, if only to discount the possibility of a magnet being hidden within the hairbrush. Can't help feeling though that he believes in what he's saying regards location.

If Andy Redwood quoted that "Madeleine may not have been alive when she was taken from apartment 5A" and SY have also stated recently that Madeleine "was killed and her body buried near the apartment", I wonder how that would leave the proceedings against AG in the libel trial as those statements are more or less backing up what AG said?

Bearing in mind that cadaver odour takes over an hour to form, therefore Madeleine must have been dead in the apartment for up to an hour for the cadaver dog to smell the odour.

Whether she was killed and then taken from the apartment and buried nearby doesn't make any difference as she would have still had to be in the apartment dead for at least an hour, or if she was not alive when she was taken from the apartment again she must have been dead in the apartment for at least an hour.

Whether she died on 3rd May or the 1st or 2nd of May is another matter, no doubt still being pursued by the PJ and SY.

I don't know what the McCanns hope to achieve by appearing, imo, they are no more sympathetic than their witnesses, and I too have great faith in the Judge. 

They are huge risk takers if they go ahead with their trip, especially when we remember how they hotfooted it out of Portugal as soon as they became arguidos.  I'm still of the 'I'll believe it when I see it' train of thought, they have often said they would do things, then backed out.  A lie detector test for example.

However, the announcement was made by their 'Official Spokesman' and it would do their cause more harm than good if they back out.  It may of course be that they are in no more danger of being arrested in Portugal than they are in the UK - they may even wish to flaunt the fact that the police have no evidence. and use it in the same way they used the twisted version of the Portuguese shelving report to declare themselves innocent.  This could be a moment of 'told you so' from the Whitewashers, as they may claim lack of evidence found in digging rules them out the death in the apartment theory.  The McCanns have got away with whoppers for years, why should they not bring this one into play?

I am quite amazed at the confidence in this announcement, its a huge message to the haters that the McCanns have nothing to fear in returning to Portuguese soil  It is even more astounding when we look at all the rigid demands and conditions insisted upon by the Tapas group in order to return for the reconstruction.  Amongst other things, they demanded the 'McCanns' arguido status lifted, and assurance that they themselves would not be made arguidoes or arrested.  On legal advice they decided not to go.

The libel case however is a different kettle of fish  It involves a substantial amount of money.  Its not about how much they will win, it is about how much they will lose.  There are three Defendants to this action. Losing this case will probably wipe them out financially, not to mention loss of reputation, and a bucket load of counter suits, this case means everything to them.  They still have the mantra 'there is no evidence', even after two police forces have dug up half of PDL.  How smug they must be, and how infuriated must be those looking for the evidence to get justice for that little girl, they are certainly leaving no stones unturned - quite literally. 

But its all about the money.  The loss of a libel trial this size can and does lead to ruination.  Even if the police never find enough evidence to prosecute, the McCanns will still suffer a catastrophic financial loss - there is no way they can win the libel trial.  The Portuguese public, who have less sympathy for the McCanns than he British, have just seen two police forces dig for the child's body in the vicinity of where the McCanns were staying!  It would be political suicide for any Judge to award these two former arguidoes 1m Euros or whatever it is after the fraudulent claim for Madeleine was removed whilst the police are actively searching for her body. 

I have to say I will be astounded if they turn up.  Hopefully we have some friends in Lisbon who will keep us updated, though if they are both going to turn up, it may hit the mainstream.  I wonder if this is reminiscent of Gerry's call to the press when they were fleeing Portugal, 'we will be on early morning flight **** be there'.  There is certainly a touch of drama about all this, the final showdown so to speak.  Ooer, roll on Monday.

I don't think there's any danger of them being arrested Cristobell and they know it. Now that the digs are out of the way it's no surprise that they're planning to turn up at the libel trial. In fact I'd be surprised if they didn't. They know this is a big one for the media, and now they've been given permission to speak in court it is a chance not to be missed. Their statements to the court will fill the newspapers and obliterate everything else. Has Amaral been given the same opportunity? I doubt it.

Who's to say the McCs wouldn't or couldn't turn a loss to their advantage?  There would be a clamour for tv interviews and press exclusives as the media queue up to pay handsomely to wring every last drop of pathos from this further tragedy.  Could the good folks of Britain stand back and see the parents and siblings of "our Maddie" beggared by those rotten and corrupt foreign courts?   Who knows, we could see Fighting Fund II save G & K from homelessness rise from the ashes if this trial fails to deliver.
