Aiyoyo, sadly this is the state of the law. I find it digusting but that's how it is. To be on the sharp end of the bayonet of it is beyond belief from the parents of a missing child. I shall never understand how it came to this situation. I hope the McCanns put a stop to this, publish transparent accounts, tell us what exactly is being done in the search for Madeleine with donated money and money from libel cases. I can dream. I want Madeleine found. What a waste of time to sue people. IMO the McCanns would be better served by stopping suing people, publishing their accounts, telling people the situation in the search for Madeleine. I'm hoping for grace and humanity.

Aquila - completely agree with your comments. Isn't it tragic that these days 'ruthless' lawyers can allow guilty people to walk free on technicalities even though they know the culprit is guilty. I cannot believe that this pursuit of TB an GA has gone so far. IMO it's vindictive and for revenge. TM must know that their account of 3 May 2007 is just not believed by many people, but if you dare to question that account or print details of the police files you end up possibly losing your home and every penny you have. That is such an unchristian attitude. Why?

I notice Mike Spudgun wants to go to the press gallery. In such a small court/chambers I'm not sure there would be a press gallery. But if the press and Sky/BBC/ITN do not cover this there is definitely something wrong (yeah, we know that already). If this is in the media, even with CM spin I personally think it will show TM in a very bad light.

My thoughts are with Tony and his family. The sad thing is I presume Tony has to prove his writings were not in contempt or libellous and TM don't have to prove a thing. If they had to prove abduction by a stranger where is the evidence?

Just as a matter of curiosity, is Mike Spudgun a freelance journalist? Or which newspapers is he working for? Does anyone know?
It will be good if he can make it to TB's hearing to do the recording then report on it.

Aiyoyo, he may be able to write about it but whether it actually gets printed is another matter. If the McCanns have taken out a superinjunction which presumably they have as no newspaper will print anything about their backgrounds/friends/relatives etc I doubt very much that any newspaper will touch it.

All I can say that if the McCanns have taken out a superinjunction they must have a hell of a lot to hide.

As Mr Bennett is speaking for so many of us and has perhaps even used our words, thoughts and research the court should ask for our witness statements too. He is a repreentitive for those who expect freedom of speech and do not believe maddie was abducted, he didn't persuade us to do so, we did already could see there was a cover up.

Thank you Joelle T and good morning. What you've said is correct, I just wish someone else was up in the High Court instead of me, and I truly wish you all had a better representative than I am. Information, analysis, ideas, opinions, discussion, debate - the internet does it pretty well. And, yes, I've used others' words, thoughts, research and translations - just as some have also maybe used mine. Your witness statements are in effect, of course out there on the internet where (at the moment) anyone can read them. I'm sure the Court will be made aware that there are more then a few others out there who share my views, not least of course Goncalo Amaral, Tavares de Almeida and others, without whose reports and books we would have much less to go on.

Mr Tipp confirms the hearing will begin in Open Court

THE HEARING ON 8 FEBRUARY WILL BEGIN IN OPEN COURT, BUT EITHER PARTY COULD APPLY FOR IT TO BE HEARD IN PRIVATE

I clarified the position this morning regarding whether this hearing will be in open court or in chambers (in private), by speaking to Mr James Tipp, Deputy Court Manager in the Queen's Bench Division Listing Office.

Appaently Case Management Hearings are normally held in chambers (in private), but this particular Case Management Hearing is definitely listed as being in open court.

However, for the sake of completeness, Mr Tipp has pointed out that, at the beginning of the hearing, either party could make an application for the remainder of the hearing to be conducted in private. If they do, the Judge ['Master'] would then consider that application on its merits, after listening to any argument as to why the hearing should be held in private instead of in open court.
