I have made one phone call to my solicitor’s. And, so far, sent one email to his address…

I remember a gangster once saying to me: “I could bust your head, break both your arms and legs and I would still have to keep looking over my shoulder because you don’t give up”.

I chuckled because he was showing me respect. The McCanns did not show Madeleine respect for her right to life. I have no respect for Gerry and Kate McCann, this is why I am bringing court actions.

Update:

It is not one action but a combination. However, as always the devil is in the detail.

“IN THE MATTER OF MADELEINE BETH MCCANN

Judgment of Mrs Justice Hogg at the High Court, Family Division, RCJ, London,
7th July 2008, in open court

Madeleine went missing on 3 May 2007 just a few days before her 4th birthday, while she was holidaying with her family in the Algarve in Portugal.

On 17 May 2007 Madeleine’s parents invoked the jurisdiction of this Court under the Inherent Jurisdiction of the Court, and The Child Abduction and Custody Act, and the Hague Convention. They sought various orders and directions aimed at ascertaining the whereabouts and recovery of Madeleine. I became involved with the proceedings shortly afterwards.

On 2 April 2008 Madeleine became a Ward of this Court, and since that date has remained a Ward.

At all times jurisdiction was assumed by the Court because, there being no evidence to the contrary, it is presumed Madeleine is alive”.

When I first heard that the McCanns intended to apply to make Madeleine a Ward of Court I suspected that what was behind it was trying to protect the McCanns copyright to profit from the sale of Madeleine wristbands etc. In any event, I wondered how a dead child could be made a Ward of Court. As you can see from Mrs Justice Hogg’s partial judgment above her reasoning is based upon an assumption. Having studied critical criminology, the aim being to knock down the assumptions of the positivist’s approach to criminology, I attack the assumption. Ironically, with another assumption.

“In law, death in absentia is the status of a person who has been declared presumed dead when the person disappears but no identifiable remains can be located or recovered”. As I understand it, we are talking about the civil standard of on the balance of probabilities as opposed to the criminal beyond all reasonable doubt.

Mrs Justice Hogg has erred in law. Neither the The Child Abduction and Custody Act 1985, nor the Hague Convention apply in this case.

The correct legal position, in my view, is that Madeleine can be declared dead and a death certificate issued. Therefore, I am applying for this. There are two ways the authorities can respond, simply issue the death certificate and be done with it, or order an inquest with a coroner and jury. Obviously, I would prefer the latter.

Wow! I wonder what the chances are of getting an inquest opened?

I didn't realise a member of the public could apply for a death certificate when the case is still ongoing. eh

I know this has been discussed before on forums but maybe it is worth looking at this again. Why was Madeleine made a Ward Of Court?

When was this done before?? Are you referring to the case Mr. Bennett brought against the McCanns, wasn't that for child neglect?

The Court will not Declare her Dead Without a Final Report from Portugal or the Leicester Police Saying So. It Doesn't and the Prosecutor Even Just Testified it was "50/50". This Man scares Me Very Much. His Personal Background is Quite Lacking and His language is Scary and Violent.

As she was a British Subject missing, the court made her a ward Of Court to protect her interests. As it was a big media circus around the case at the time,it was better to do that, than not do it.

If he gets justice for Madeleine then it's something the British cops haven't done. It's their job, not his. But someone has to do it whatever he's done previously. I believe he's done his time whereas the McCanns have yet to do theirs.

So it is okay to have a convicted killer loose on the streets then. So it is okay to have a convicted killer trying to tell people bull shit about death certificates.

Fact is madeleine would have to be missing for over 5 years before a coroner can hold a inquest and before a certificate can be issued.

Fact is that it can only be done by the parents or the legal guardians.

And it's ok for child neglectors to be loose on the streets is it even though others are in jail for the same? And it's ok for doctors suspected of paedophilia to still be working loose in hospitals and treating unsuspecting people?

If JHL is wrong, I'm sure he'll find out soon enough, but he does seem very certain of his facts.

I say good on him for trying because someone has to.

Ready to hang on tthe words of someone who DID actually take the life of someone, while comparing the McCanns, who have not been convicted of anything, to two notorious evil child torturing murderers.

Is it any wonder the hardcore haters at PFA' take the piss out of 'pitchforking antis?

Lets not get into Forum Wars rubbish, do you really think anyone gives a stuff what the hardcore haters at PFA think. The 'picture' as I see it, is changing and the tangled spider's web of lies and deceipt is, at last, starting to unravel.

The picture as YOU see it isn't representative of all who don't buy the abduction theory Autumn.

This is how it started on 3A. An unhealthy mix of ill informed people spouting extreme views and being rabble roused by what I can only guess were infiltrators.

Many of those in the middle were caught up in a web of hatred and bile on both sides of the fence and eventually the forums fragmented. So yes I think many people do give a stuff and care that they are being pigeonholed. .

I have some very good friends who support the McCanns and think they are innocent of all wrong doing. Members of my own family are supporters. have given to the fund and have the 'don't you forget about me' stickers in their cars. While we have many a healthy discussion about the case, we'd never fall out in a million years.

There isn't just two sides to this case. There are many aspects to consider. So instead of painting the McCanns as the most hated people on the planet, you might want to consider all of the facts, one of which is that there is no evidence to support your claims.

Can I suggest then we all put our points across without delving into this hatred.

I personally will applaud anyone who has the sincerity to ask questions from those in authority regarding any aspect of this case. I dont want to be brainwashed by the McCanns and lets face it they get EVERY opportunity to spill out their opinions, vitriol and hatred of anyone who does not agree with their party line.

So - lets play nice and air our opinions and respect others who air theirs. And if something is posted you dont agree with and you cant post anything constructive then dont reply - simples!

And yet interestingly they don't.

I haven't seen vitriol and hatred being spouted by the McCanns. I don't think anyone else has either.

Sorry I beg to differ. Didnt they call people on internet forums "Nutters". Didnt Kate say Mr Amaral was "a drunk"
Kate McCann said the social worker who was attempting to help when Madeleine was first adbucted was "Boring"
Portugese Press as "sleasy"
These are all direct quotes from the mouth of Kate McCann

As for Gerry and the wider family circle???? lets just ask the dogs! :-)

Do you honestly not believe that there are nutters on the internet forums? I would say it's a pretty factual assessment. Luckily a lot of them seem to have disappeared after 3A disintegrated.

They also called some of the forums cess pits, and I think all of us here have witnessed that there are cess pit forums and blogs out there.

I'd appreciate a link for the drunk and boring comments - not that I distrust you, but I haven't seen these, and would like to.

Ty - I wonder what use of the word she meant to convey. Whether the woman was monotonously asking questions, or whether she was digging for information. Either way I suppose she was writing her own personal thoughts down in a diary, and therefore not publicly spouting hatred and vitriol.

Was there anything on the time she referred to Mr Amaral as a drunk?

The information of the Police Files has been there. It is just that certain people mis-translated it and also decided to miss bits out that did not suit them.


Going back on track. JHL or the Axe Murderer as he is known as, has shown NO REMORSE WHATSOEVER FOR WHAT HE DID.So in other words he is please with killing someone.

And as for not "losing a case" as he puts it. HE HAS ONLY DONE CASES FOR PRISONERS RIGHTS AGAINST THE STATE. HE HAS DONE NOTHING LIKE THIS. And he is wrong in what he says.
